This is a claim in which the claimant states that a limestone curb, which was protruding
into the street, punctured his tire.
According to the report of John Klostermann, Street/Sewer Maintenance Supervisor, it is
his recommendation that the claim be approved because of the defects in the curb and the
Operation and Maintenance Department's prior knowledge of the construction defect. The
Legal Department concurs with this recommendation.

Dear Barry:
This letter will respond to the claim filed by Mr. Robert Reding.
The curbing in front of Mr. Reding's home at 3110 Lemon Street is limestone rock
construction with several sections missing. As Mr. Reding states in his claim, he has
contacted us several times about the condition of the curbing. Due to general condition
of the street and the amount of rock curbing on Lemon Street in the same condition, I
feel we should reconstruct the street and not just repair the curbing. Currently, Lemon
Street is not on the five- year reconstruction program, but is being considered for a
possible future project.
It is therefore my recommendation to pay the claim as filed because of the defects in the
cUrb and our prior knowledge of the construction defect.
