Vacating Petition - Alley West of College Street and Southwest Corner of
West Fifth & College
In response to a request from The Finley Hospital for the vacating of an alley west of
College Street and the southwest corner of West 5th Street and College Street, Public
Works Director Mike Koch states that the City has no plans for the utilization of the alley
and right-of-way to be vacated, recommends the vacation, and that a public hearing be
set for October 15, 2001.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This is in response to a request from The Finley Hospital for the vacating of an alley
west of College Street and the southwest corner of West 5th Street and College
Street.
DISCUSSION
The attached plat shows the areas proposed to be vacated. The abutting
properties are owned by The Finley Hospital. Finley Hospital plans on expanding an
existing parking lot along the alley with future improvements planned to the east.
The area to be vacated is divided into two lots numbered Lots 7A and 8A of Finley
Home Addition in the City of Dubuque. Lot 7A is an existing 20-foot wide alley.
Lot 8A is an area of excess right-of-way located at the southwest corner of West
Fifth Street and College Street.
The property has been valued at 81.25 per square foot, for a total of 89,805. A
credit of 81,500 for surveying and platting, reduces the purchase price to 88,305.
RECOMMENDATION
The City has no plans for the utilization of the alley and right-of-way to be vacated.
I would recommend that the areas indicated by Lots 7A and 8A of Finley Home
Addition in the City of Dubuque on the attached plat be vacated, and that a public
hearing be set for the disposition of the City's interest in the subject area on
October 15, 2001. I would further recommend that the purchase price be
established at $8,305, plus platting, publication, and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the disposal of the property through adoption of the
enclosed resolutions and ordinance.

As per our phone conversation on Monday August 27, please consider this the "first step"
in the process to vacate.
To expand site parking for our Medical Office Btdlding, The Finley Hospital requests
that the City of Dubuque vacate the alleyway from College Street west to the intersection v, dth an
alleyway from 5th Street (see attachment). On October 1, 2001 Finley will take possession of all
the properties that border both sides of this alleyway. Also Finley requests that the City vacate
the triangle green space on the Southwest comer of the College Street and 5th Street intersection
(see attachment).
Finley has requested HGA, the Project architects, to develop site options for the
add/tional property we have acquired east of the Medical Office Building. The preferred site
option would then come to the City for approval from all'appropriate city departments.
We assume that the process for Finley to purchase the requested vacated property would
be similar to the Excluslve Option used in February 1999.

RESOLUTION APPROVING PLAT OF PROPOSED VACATED ALLEY WEST
OF COLLEGE STREET AND THE SOUTHWEST CORNER OF WEST FIFTH

Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated September 11, 2001, prepared by IIW Engineers & Surveyors, PC
describing the proposed vacated alley west of College Street and the southwest corner
of West Fifth Street and College Street; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the plat dated September 11, 2001, prepared by liW Engineers
& Surveyors, P.C., relative to the real estate hereinabove described be and the same is
hereby approved, and the Mayor and City Clerk be and they are hereby authorized and
directed to execute said plat for and on behalf of the City of Dubuque, Iowa.

City Council a plat showing the vacated portion of an alley west of College Street and
the southwest corner of West Fifth Street and College Street and assigned lot numbers
thereto, which hereinafter shall be known and described as Lots 7A and 8A of Finley
Home Addition in the City of Dubuque, Dubuque County, iowa;
Whereas, the City Council of the City of Dubuque, iowa has determined that the
alley west of College Street and the southwest corner of West Fifth Street and College
Street is no longer required for public use, and vacating of said alley known as Lots 7A
and 8A of Finley Home Addition in the City of Dubuque, Dubuque County, Iowa should
be approved.

the City of Dubuque, Iowa to The Finley Hospital be contingent upon the payment of
$8,305.00, plus platting, publication and filing fees.
Section 3. That the City Clerk be and is hereby authorized and directed to
cause a notice of intent to dispose of said real estate to be published in the manner as
prescribed by law.

Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa on day of ,2001, the
City Council of the City of Dubuque, Iowa met on the day of
2001, at 6:30 p.m. in the Public Library Auditorium, 11th and Locust, Dubuque',
Dubuque, County, Iowa to consider the proposal for the sale of real estate described as:
Lots 7A and 8A of Finley Home Addition in the City of Dubuque
Whereas, the City Council of the City of Dubuque, Iowa overruled any and all
objections, oral or written to the proposal to sell such real estate, except for easement
as noted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as Lots 7A
and 8A of Finley Home Addition in the City of Dubuque, Iowa to The Finley Hospital be
and the same is hereby approved for the sum of $8,305.00, plus cost of publication,
platting and filing fees. Conveyance shall be by Quit Claim Deed.
Section 2. That the Mayor be authorized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed
of conveyance to The Finley Hospital upon receipt of the purchase price in full.
Section 3. That the City Clerk be and is hereby authorized and directed to
record a certified copy of this resolution in the office of the City Assessor, Dubuque
County Recorder and Dubuque County Auditor.
