Approve Minutes of July 31, 2001
Commissioner Kluesner moved to approve the minutes of July 31, 2001.
Seconded by Duehr, passed unanimously.

Establish Passing Point for the Position of Park Ranger
Commissioner Kluesner moved to establish the passing point for the position of
Park Ranger at 80; he further moved that the agility test for the position of Park
Ranger be set for Wednesday, September 26, 2001 at 6:00 p.m. at the Loras
College Graber Sports Center. Seconded by Duehr, passed unanimously
Communications of Mike Horsfall and Kevin Grace Regarding the
Foreman's Test Administered on June 27, 2001
Kluesner moved to receive and file the communications. Seconded by Duehr,
passed unanimously. John Hail reported that for some reason the notice of the
Civil Service test was not posted in any Park area. He stated that both
individuals had taken the test when it was administered two years ago and had
passed the test. Randy Peck reported that there is no current vacancy. Also,
there are seven individuals on the list the Commission certified and up to ten
could be certified. The two individuals would need to take the test using the
passing score previously established. Kluesner moved to allow Mike Horsfall
and Kevin Grace to take the promotional test for Foreman and that the passing
point be as previously established. Seconded by Duehr, passed unanimously.
Communication of Dave Baker, Teamsters Local Union No. 421 Submitting
an Appeal to William Kelly's Termination from the City of Dubuque
Kluesner moved to receive and file the communication. Seconded by Duehr,
passed unanimously. The Commission Members and Dave Baker discussed
possible dates for hearing the appeal of William Kelly. After discussion,
Kluesner moved that this item be continued to Tuesday, October 2, 2001 at 2:00
p.m. in Conference Room A. Seconded by Duehr, passed unanimously.

Communication of Michael McMahon Regarding the Assistant Fire Marshall
Position
Chairperson Duehr stated there seemed to be two concerns expressed in Mr.
McMahon's letter- that Chapter 400.28 of the Code of Iowa had not been
followed and he had not received a certificate showing his years of service in the
position he was removed from and stating that he was honorably removed from
that position. The other concern was whether or not the Commission knew of
any other situation in which a person was removed from a position because it
was no longer available, the person did not pass the test for the newly created
position and, therefore, had to take a large decrease in pay.
Mr. Peck responded that he would supply the certificate and letter to Mr.
McMahon. He further explained that in similar cases the City has followed the
Code of Iowa and when employees are placed in a lower classification due to
their position being eliminated, they also must take the resulting pay decrease.
Mr. McMahon specifically brought up the situation in the Police Department a
few years ago when the Police Sergeant position was being eliminated and
those that did not pass the Lieutenant's test were retained as Sergeants and
maintained their same rate of pay. Mr. Peck explained that the Sergeant
position was not eliminated - it was phased out through attrition.
Commission Kluesner stated that he would like to have the Corporation Counsel
provide the Commission with a letter of opinion on how the Police Sergeant
situation differs from the Captain Inspector position. Kluesner moved that this
item be continued to a later date and that the Corporation Counsel be requested
to supply said letter of opinion.
There being no further business, Kluesner moved to adjourn. Seconded by Duehr.
Unanimously approved and meeting adjourned at 2:45 p.m.
