Minutes Zoning Bd Adj 9 27 01 MINUTES ZONING BOARD OF ADJUSTMENT REGULAR SESSION Thursday, September 27, 2001 4:00 p.m. Auditorium, Carnegie Stout Library 360 W. 11th Street, Dubuque, Iowa P~S~T: ABSENT: Board Members Randy Klauer, Jim Urell, Bill Gasper and Fred Beeler; Staff Members Kyle Kdtz and Wally Wemimont. Chairperson Mike Ruden. AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying the meeting wes being held in compliance with the Iowe Open Meetings Law. CALL TO ORDER: The meeting wes called to order at 4:02 p.m. MINUTES & NOTICES OF DECISION: Motion by Klauer, seconded by Beeler to approve the minutes of the August 23, 2001 meeting as submitted. Motion wes approved by the following vote: Aye- Klauer, Gasper, and Beeler; Nay - None. Motion by Klauer, seconded by Beeler, to approve the Notices of Decision for Dockets 68-01, 69- 01, 70-01, 71-01, 72-01, 73-01, 74-01 and 75-01 as submitted. Motion wes approved by the following vote: Aye- Klauer, Gasper, and Beeler; Nay - None. NOTE: Jim Urell entered at 4:06 p.m. DOCKET 78-01: Application of Joseph Lent for a special exception for property located at 10 Lindberg Terrace to add a 7 foot by 34 foot addition, 8 feet from the front property line, 20 feet required, in an R-2 Two-Family Residential zoning district. Joseph Lent reviewed his request to add an addition to the front of his home. Staff Member Wernimont reviewed his staff report, noting the unusual configuration of the subject lot, the limited impact of the addition on the adjacent property, and the visibility along the street. The Board reviewed aerial photos of the site to determine the location of the adjacent structures relative to the proposed addition. Motion by Klauer, seconded by Urell, to approve the special exception as submitted. Motion wes approved by the following vote: Aye - Klauer, Urell, Gasper and Beeler; Nay - None. DOCKET 79-01: Application of Steven & Maureen Kennedy for a special exception for property located at 2902 Muscafine Street to build an attached porch 3 feet from the front property line (Primrose Street), 20 feet required, in an R-1 Single-Family Residential zoning district. Minutes - Zoning Board of Adjustment September 27, 2001 Page 2 Steve Kennedy presented his request to the Board, explaining that the property'is located on a comer lot and that the contractor doing the project mede a mistake regarding the current required setbacks. Mr. Kennedy reviewed the location of the existing house and concrete sidewalk that would be replaced by the proposed walkway and new deck. Staff Member Wemimont reviewed his staff report, noting the request will not adversely impact visibility at the intersection of Muscatine and Primrose Streets. The Board reviewed the request, noting that the proposed addition will not encroach any closer to Primrose than the existing detached garage located on the lot. Motion by Ureil, seconded by Klauer, to approve the special exception as submitted. Motion was approved by the following vote: Aye - Klauer, Umll, Gasper and Beeler; Nay - None DOCKET 80-~1: Application of Charlie & V"m.,ki Glab for a special exception for property located at 804 English Lane to construct an 1,800 square foot detached garage, 1,000 square foot maximum allowed, and 18 feet high, 15 feet maximum allowed, in an R-1 Single-Family Residential zoning district. Charlie Glab presented his application. He discussed that he was denied a special exception for a previous application to erect a larger garage on the same lot. He stated that he has redesigned the garage and has submitted a new application.~ Mr. Glab discussed the garage design, noting that it would be one-story with a driveway that extends through the garage, and that there would be windows facihg Southern Avenue. Mr. Glab explained that lhere will be a vegetation buffer between the garage and Southem Avenue. He said that the structure will have asphalt shingles and siding that is very similar to a building located further up the street on Southern Avenue. Staff Member Kdtz presented his staff report, noting the location of the proposed garage, and that the Engineering Department has reviewed the site plan and will grant curb cuts for the proposed driveway. Motion by Klauer, seconded by Beeler, to approve the special exception as submitted. Motion was approved by the following vote: Aye - Klauer, Urell, Gasper and Beeler, Nay - None.
