Final Plat of Pinto Ridge Subdivision
INTRODUCTION
The purpose of this memorandum is to request City Council approval of the final plat of Pinto
Ridge Subdivision. A resolution, plat and staff report are attached to this memorandum.
DICUSSION
The final plat of Pinto Ridge Subdivision is being platted by Wayne and Lynn Stewart to create
five single-family lots on approximately 25 acres of property located near the southweSt comer of
Old Highway Road and Selppel Road. The property was recently annexed to the City of
Dubuque in July of 2000 to allow the property to be served by City water and sewer.
The subdivision will be served by a new public Street named Pinto Ridge Court. The street will
be designed to City standards for a local residential street with 50 foot of right-of-way and 31 feet
of paving. Pinto Ridge Court will intersect with Old Highway Road approximately 275 feet west of
the intersection of old Highway Road and Seippel Road.
The proposed subdivision will be served by City water which will be extended along Old Highway
Road to the west end of the subdivision. City sanitary sewer is currently not available to the site;
however, a capped system will be installed in the subdivision and homeowners will be required to
hook-up to the City sanitary sewer system once it is made available to the subdivision.
The Zoning Advisory Commission has reviewed and approved the preliminary plat of Pinto Ridge
Estates. The submitted final plat is in substantial compliance with the approved preliminary plat
and the subdivision regulations of the City of Dubuque.
RECOMMENDATION
I recommend approval of the attached resolution for the final plat of Pinto Ridge Subdivision.

Physical Characteristics: The subject property is located near the southwest corner of Old
Highway Road and Seippel Road. The subject property is above the grade of Old Highway
Road. The proposed Pinto Ridge Court connects to Old Highway Road and extends toward
the southwest with the property on either side sloping away to the north and south.
Proposed Phasing: None.
Previous Conditions of Zoning or Plats: None.
Dedication of Open Space or Public Amenities: None.
Proposed Streets and Grades: Pinto Ridge Court: 2-6%,
Recommended Motion: Motion to approve the final plat of Pinto Ridge Subdivision, as it is
in substantial compliance with the City of Dubuque Subdivision Regulations.
Conformance with Comprehensive Plan: The subject property was not included in the
City's 1995 Comprehensive Plan; however, the area was included in the City's 1997
Annexation Study. The 1997 Annexation Study designates the subject property as Area 4
and established it as Priority 1: Immediate Opportunity.

Impact of Request on:
Utilities: City water is available to the site. City sanitary sewer is approximately one mile
away from the subject property. Each lot will have a septic system. Individual property
owners will be required to hook-up to sanitary sewer when it's available.
Traffic Patterns: The proposed subdivision has frontage on Old Highway Road and
Seippel Road with the proposed Pinto Ridge Court street having access to Old Highway
Road. There are no traffic counts available for the surrounding roadways.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impacts to the environment
providing adequate erosion control is provided during all phases of development of the
subdivision.
Adjacent Properties: Staff does not anticipate any significant impacts to adjacent
properties as the proposed development will only create five additional single-family
building lots.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat of Pinto Ridge Subdivision is located near the
southwest comer of Old Highway Road and Seippel Road. Wayne and Lynn Stewart
annexed this property to the City of Dubuque in July of 2001. The proposed subdivision will
subdivide an existing 25-acre parcel into five tots, a minimum of 3.9 acres in size, for
development of single-family homes.
The City sanitary sewer main is approximately one mile away from the property; however, the
applicant has agreed to provide the necessary easements to accommodate extension of the
sanitary sewer system to serve the property in the future. In addition, a capped sewer system
will be installed as part of initial utility work to facilitate hooking up the subdivision to city
sanitary sewer service in the future.
The Engineering Division has indicated that once the homeowners have approved septic
systems they will have 15 years to tie into the city sanitary sewer system.
City water service is available to the property. An existing 12' water main is located within the
right-of-way of Seippel Road and will be extended along Old Highway Road and within the
subdivision.

RESOLUTION NO. 450-01
A RESOLUTION APPROVING THE FINAL PLAT OF PINTO RIDGE SUBDIVISION IN
THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a final plat of Pinto Ridge
Subdivision in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears a street to be known as Pinto Ridge Court
(Lot A), Seippel Road (Lot B) and Old Highway Road (Lot C) together with certain
public utility and sewer easements, which the owners by said final plat have dedicated
to the public forever; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon, subject to the owners agreeing to the conditions noted in
Section 2 below; and
Whereas, said final plat has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating to it, except that no streets or public
'utilities have yet been constructed or installed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Pinto Ridge Court (Lot A), Seippel Road (Lot
B) and Old Highway Road (Lot C), together with the easements for public utilities,
sanitary sewer, storm sewer and water mains as they appear upon said final plat, be
and the same are hereby accepted; and
Section 2. That the final plat of Pinto Ridge Subdivision, is hereby approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa, upon said final plat, provided the owners of said
property herein named, execute their written acceptance hereto attached agreeing:
(a) To reduce Pinto Ridge Court (Lot A) to grade and to construct
concrete curb and gutter and to hard surface with asphaltic

concrete, or with concrete paving with integral curb, all in
accordance with the City of Dubuque standard specifications, all in
a manner acceptable to the City Engineer, in conformance with
construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(b)
To install a capped sanitary sewer main system, with service
laterals into each lot, water mains and water service laterals into
each individual lot, storm sewers and catch basins, boulevard
street lighting and erosion control devices all in accordance with
the City of Dubuque standard specifications, all in a manner
acceptable to the City Engineer, and in accordance with
construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(c)
To construct said improvements, prior to two (2) years from the
date of acceptance of this resolution, at the sole expense of the
owners, or future owner;
(d)
To maintain the public improvements, for a period of two (2) years
from the date of the acceptance of those improvements by the City
of Dubuque, Iowa, at the sole expense of the owners, or futura
owner;
And, further provided that said that Wayne and Lynn Stewart, as owners of said
property, shall secure the performance of the foregoing conditions provided in this
Section by providing guarantees in such form and with such sureties as may be
acceptable to the City Manager of the City of Dubuque, Iowa.
Section 4. Sidewalk installation shall be the responsibility of the owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code 41-161 through 41-164. The responsibility shall extend to all successors,
heirs and assignees. Sidewalk installation will not be raquirad until the development of
the lot has been completed, except as required herein. In sparsely developed
subdivisions, sidewalks on developed lots will not be required until 50% of the lots
approved by the plat have been developed. All vacant lots shall have sidewalks
installed upon development of 80% of the lots approved by the plat. Sidewalks along
Old Highway Road will not be required until curb and cutter has been installed along
said roadway.
Section 5. That the final acceptance of all public improvements shall occur
upon certification of City Engineering to the City Council that all public improvements
have been completed in accordance with the improvement plans and City standard
specifications and accepted by City Council Resolution.

Section 6. That in the event Wayne and Lynn Stewart fail to execute the
acceptance and furnish the guarantees provided in Section 3 hereof within 180 days
after the date of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication and approval the plat shall not be effective.
