Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting the plat resubdivides three (3) lots on
the east side of Kebbie Drive and provides sufficient space to construct a cul-de-sac at the
end of Kebbie Drive.
Staff reviewed the submitted plat noting that it is considered a majOr plat because Mr.
Klauer is dedicating property to the City for right-of-way.
The Zoning Advisory Commission discussed the request, noting that the submitted plat is
in compliance with the City's subdivision regulations.
Recommendation
By a vote of 7-0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Final Plat of Lot A and Lots 1, 2, 3, 4 and 5, C.J. Bies Subdivision No. 2
INTRODUCTION
The submitted final plat has submitted by Roger Klauer to resubdivide property along
Kebbie Drive, and to provide additional right-of-way to allow for the construction of a
cul-de-sac for Kebbie Drive.
DISCUSSION
The submitted final plat resubdivides property along the east side of Kebbie Drive and
dedicates additional right-of;way to provide for a future cul-de-sac on Kebbie Drive.
The final plat creates three lots along the east side of Kebbie Drive that would be
developed for residential purposes. Lot 1 is zoned R-1 while Lots 2 and 3 are currently
being requested for rezoning to R-2 Two-Family based on a referral from the City
Council. The property encompassed by Lots 4 and 5 was recently rezoned by the City
Council to C-3 General Commercial with conditions.
The submitted final plat allows for sufficient building area to construct a residential
structure on Lot 3 as the dedication of additional right-of-way for a future cul-de-sac
encroaches on the former lots.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission approve the final plat
of Lot A and Lots 1, 2, 3, 4 and 5; C.J. Bies Subdivision No. 2, as it is in substantial
compliance with the City of Dubuque Subdivision Regulations.

RESOLUTION NO. 451-01
A RESOLUTION APROVING THE FINAL PLAT OF LOT A AND LOTS 1, 2, 3, 4, AND 5
OF C.J. BIES SUBDIVISION NO. 2 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a final plat of Lot A and Lots 1,
2, 3, 4 and 5 of C.J. Bies Subdivision No. 2 in the City of Dubuque; and
Whereas, upon said final plat appears a street known as Kebbie Drive (Lot A),
which the owners by said final plat have dedicated to the public forever; and
Whereas, said final plat has been reviewed by the Zoning Advisory Commission
and had their approval endorsed thereon, subject to the owners agreeing to the
conditions noted in Section 2 below;
Whereas, said plat of survey has been examined by the City Council and they
find that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Kebbie Drive (Lot A) and easement for
storm sewer and public utilities as they appear upon said final plat be and the same is
hereby accepted; and
Section 2. That the final plat of Lot A and Lots 1, 2, 3, 4 and 5 of C.J. Bies
Subdivision No. 2 is hereby approved and the Mayor and City Clerk are hereby
authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon
said final plat, provided the owners of said property herein named, execute their written
acceptance hereto attached agreeing:
a) To reduce Kebbie Drive cul-de-sac to grade and to hard surface
with asphaltic concrete, in a manner acceptable to the City Engineer, and in
conformance with construction improvement plans approved by the City Engineer, and
inspected by the City Engineer.
b) To construct said improvements prior to one (1) year from the date
of acceptance of this resolution, at the sole expense of the owners, or future owners.

Section 3. That the installation of sanitary sewer mains and sewer service
laterals into each lot, water mains and water service laterals into each lot, all in
accordance with the City of Dubuque Standard Specifications and City Codes, all in a
manner acceptable to the City Engineer, and in accordance with improvement plans
approved and inspected by the City Engineer, shall be the responsibility of the owner of
each individual lot and shall extend to all successors, heirs and assignees.
Section 4. Sidewalk installation shall be the responsibility of the owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code 41-161 through 41-164. The responsibility shall extend to all successors,
heirs and assignees. Sidewalk installation will not be required until the development of
the lot has been completed, except as required herein. In sparsely developed
subdivisions, sidewalks on developed lots will not be required until 50% of the lots
approved by the plat have been developed. All vacant lots shall have sidewalks
installed upon development of 80% of the lots approved by the plat.
Section 5. That in the event the owners shall fail to execute the acceptance
and furnish the guarantees provided in Section 2 hereof within 180 days after the date
of this resolution, the provisions hereof shall be null and void and the acceptance of the
dedication and approval of the plat shall not be effective.
