Van Milligen, City Manager Gus Psihoyos, City Engineer Dubuque trail All- America City 1 2007 FROM: Robert Schiesl, Assistant City Engineer SUBJECT: Port of Dubuque Marina Project Engineering & Architectural Design Services - Contract Amendment (CIPs 1011861, 1021861, 3501861) DATE: May 3, 2012 INTRODUCTION recommend execution of the Consultant Professional Services - Contract Amendment No. 4 with JJR which approves revisions to the original scope of services to the Consultant Professional Services Contract to complete engineering and architectural design services for the Port of Dubuque Marina Project. BACKGROUND The Port of Dubuque Marina project was split into two (2) bid packages. Bid Package No. 1 - Transient Docks and Utilities included dock fabrication, assembly and installation, fuel system installation, and the installation of dockside water, sewer and electric services. Bid Package No. 2 - Amenities Building and Site Work included the conventional vertical building construction elements, including furnishings, fixtures and equipment and landside improvements. When bids were received for Bid Package No. 1 - Transient Docks and Utilities, Newt Marine submitted the low bid in the amount of $1,737,732.15, which was 13.4% under the estimate of probable cost. Due to the favorable bids. for Bid Package No. 1, there was additional savings available that was re- programmed for the Bid Package No. 2. Following the award of contract for Bid Package No. 1, staff met with the consultant team to re- evaluate the programmed space for the amenities building. With the additional funding available, this allowed the building size to be increased which provided additional valuable retail floor space and allowed for increasing the size of the cooler and freezer areas. At the time of the changes to the building size, the construction documents for Bid Package No. 2 - Amenities Building and Site Work were already approximately 90% completed. Due to the timing of the change, this required significant redesign efforts on behalf of the architectural building elements in addition to the food service, mechanical and electrical systems. As a result of these changes, the consultant team prepared a new set of revised construction documents for Bid Package No. 2. Bids were received on the Port of Dubuque Marina Project, Bid Package No. 2 - Amenities Building & Site Work on August 9, 2011. Portzen Construction submitted the low bid in the amount of $1,539,000.00 which was 0.71% under the estimate of probable cost. DISCUSSION As a result of the building design modifications and the level of effort performed by the consultant to prepare revised construction documents for Bid Package No. 2, the original contract scope of services needs to be revised to reflect the additional services rendered. Staff has negotiated a fee settlement for the additional architectural services performed. Based on the level of effort performed by the consultant and considering the overall added value to the project, staff feels that additional compensation in the amount of $38, 820 is reasonable and justified. This compensation amount includes $30,000 for additional architectural services and $8,820 for mechanical and electrical services. RECOMMENDATION I recommend execution of the Consultant Professional Services - Contract Amendment No. 4 with JJR which approves revisions to the original scope of services to complete engineering and architectural design services for the Port of Dubuque Marina Project. BUDGET IMPACT The professional services fee to complete engineering and architectural design services Port of Dubuque Marina Project, including the proposed contract amendment No. 4 is summarized as follows: Description Amount Consultant Contract - Engineering Design (Base Contract) $ 315,000 Amendment No. 1 - Architectural Services (Add Building) 59,600 Amendment No. 2 - Electrical, Food & Laundry Services 9,250 Amendment No. 3 - Additional Engineering Services 15,000 Amendment No. 4 - Additional Architectural Services 38,820 Total Consultant Services Cost: $ 437,670 The funding to complete engineering and architectural design services, including the proposed contract amendment No. 4 is summarized as follows: CIP No. Fund Description 3501861 Boating Infrastructure (Tier II) Grant 3501861 Transient Boat Docks Available Funding: Fund Amount $ 323,875.80 113,794.20 $ 437,670.00 The increase in professional service fees will be covered by contingency funds programmed for the Bid Package No. 1 - Transient Docks and Utilities and Bid Package No. 2 - Amenities Building and Site Work. With funding allocated to cover the professional services contract amendment No. 4, there will be approximately $120,000 remaining in contingency funds which is sufficient to cover any additional costs which may arise as the final marina construction phases are completed. ACTION TO BE TAKEN The City Manager is requested to execute the Consultant Professional Services - Contract Amendment No. 4 with JJR which approves revisions to the original scope of services to complete engineering and architectural design services for the Port of Dubuque Marina Project through adoption of the enclosed resolution.
