that the construction of a new cen-
tral fire headquarters would help
maintain the present Class 3 Fire
rating for the City. If the Class
were changed to a higher range
it would materially effect the fire
insurance rates for all citizens of

matter of holding a special elec-

Fund" has not been established.

ble Company, a division of H & B Com-
munications Corporation, has heretofore
petitioned the City Council for a rate In-
crease; and
WHEREAS, on June S, 1967, the City
Council authorized a 2S cent per month
increase in the rate charged bY Du-
buque TV-FM Cable Company to Its
subscribers, and on July 14, 1967, the
said Dubuque TV-FM Cable Company
agreed to accept said 2S cent per
month increase in lieu of the amount of
increase petitioned for.
NOW THEREFORE BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1, That Ordinance No. 25-63 be
and the same is hereby amended by re-
pealing Section 9 thereof and enacting a
new Section 9 In lieu thereof as follows:
"9. Rates charged bY the company for
service hereunder shall be fair and rea-
sonable and designed to meet all nec-
essarY costs of services, including a
fair rate of return on net valuation of
the properties devoted thereto under ef-
ficient and economic management. The
company agrees that " shall be sub-
lect to all authority now or hereafter
possessed by the City Council or anY
other body having competent lurlsalc,
tlon to fix reasonable and compensatory
television signal distribution rates. The
rate schedule shall not exceed the rates
charged by the company in the City or
Dubuque as of August 1, 1967, which
rates shall not exceed 2S cents Increase
to the pre-existing rates."

alley is unimproved and because
of the grade it is not used for ve-
hicular traffic.
The Commission has found that
the Fire Department, Police De-
partment, Engineering Department,
Water Department, and Street De-
partment are making no use of
the alley and anticipate no future
use of the alley. The Telephone
Company and Electric Company
are using the alley for service lines
to provide service to properties
abutting the alley. Notices of the
proposal to vacate the alley were
sent to all owners of property abut-
ting the alley. No objections were
received.

tion on property annexed to the
City on July 3, 1967 upon request
of the Illinois Central Railroad and
by resolution of the City Council.
The property is located on Julien
Dubuque Drive, contains 17.432
acres and is occupied in part by a
blood-drying plant which is under
construction.
It is the recommendation of the
Planning and Zoning Commission
that the property be classified
Heavy Industrial.

ban Development upon the ad-
vice of the Secretary of the

be estimated on the basis of
daily closing market bid quota-

resolutions, the proper officers of
the Local Public Agency shall pre-
pare, execute, and deliver to the
Government the Project Tempor-
ary Loan Notes hereby authorized
and shall accept payment therefor
from the Government.
SECTION 8. That the proceeds
of the sale of all Project Tempor-
ary Loan Notes issued pursuant
to this Resolution shall be depos-
ited and disbursed only in accord-
ance with the provisions of the
Contract for loan and grant, unless
otherwise approved in writing by
the Government.
SECTION 9. That the Project
(which is designated Project No.
Iowa R-15 and is herein called the
"Project") includes and consists
of all undertakings and activities
of the Local Public Agency in the

be awarded to the best bidder
determined upon the basis of the
lowest total interest cost at the
rate or rates designated in his
bid from September 1, 1967, to the
respective final maturity dates,
after deducting any premium.
These bonds are being issued
pursuant to the provisions of Chap-
ter 407 of the Code of Iowa for the
purpose of constructing a new fire
station on John F. Kennedy Road
in said City and are payable from
the proceeds of the annual levy of
a voted tax not exceeding one-half
of one mill per annum upon all
the taxable property in said City as
approved by the voters at an elec-
tion held in said City on February
21, 1967. Delivery is expected with-
in thirty (30) days after the sale
at any mutually agreeable bank or
trust company in the City of Chi-
cago, nlinois, Dubuque, Iowa, or
Des Moines, Iowa, without expense
to the purchaser. Should delivery
be delayed beyond sixty days from
the date of sale for any reason ex-
cept failure of performance by the
purchaser, the City may cancel the
award or the purchaser may with-
draw his check and thereafter his
interest in and liability for the
bonds will cease.
The City will furnish the print-
ed bonds and the approving opin-
ion of Messrs. Chapman and Cutler,
Lawyers, Chicago, nlinois together
with the transcript and usual clos-
ing papers, including customary
non-litigation certificate, and all
bids may be so conditioned. Said
opinion will be printed on the
bonds, if requested by the purch-
aser, and will recite that, based on
current rulings and official inter-
pretations, the interest on the
bonds is exempt from present fed-
eral income taxes. Each bidder
must furnish a certified or cash-
ier's check drawn on a solvent
state or national bank or trust
company for $3800 payable to the
order of the City Treasurer as a
guarantee of good faith, this
amount to be retained pending
full performance by the successful
bidder and to be forfeited to the
City as agreed liquidated damages
upon failure to take up and pay
for the bonds when ready. The City

Sealed bids will be received until
12:00 o'clock Noon, Central Day-
light Saving Time, on the 18th day
of September, 1967, at the office of
the City Clerk in the City Hall,
Dubuque, Iowa, for the. purchase
of $190,000 Fire Station Bonds
of the City of Dubuque, Iowa, at
which time they will be referred
to the City Council of said City at
its meeting to be then held at the
Council Chambers in the City Hall
of said City. Open bidding will be
concluded not later than 1:00
o'clock P.M., after which the sealed
bids will be publicly opened and
the bonds will be sold to the high-
est bidder for cash. Sealed bids
will be fully protected.
Said bonds will be dated Sep-
tember 1, 1967, bear interest pay-
able June 1, 1968, and semiannual-
ly thereafter, and will mature in
numerical order $15,000 on Decem-
ber 1 of each of the years 1970
and 1971, $25,000 on December 1 of
each of the years 1972 to 1976, in-
clusive, and $35,000 on December
1, 1977. None of said bonds will be
optional for redemption prior to
maturity. Bonds will be coupon
bonds in the denomination of
$5,000 each, payable at the office

pal only. Each bid must be sub-
