Disposal of City Property
in response to a request from Robert J. VanderMuelen to purchase City property on
Oneida Street, Finance Director Ken TeKippe states that the City has no plans for the
utilization this lot, recommends the sale for a purchase price of $300, and that a public
hearing be set for November 19, 2001.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Disposal of City Property
INTRODUCTION
This in response to a request from Robert J. VanderMeulen for the purchase of Lot
2-2-1-1-1-3 N 1/2 SE 1/4 NW 1/4 of Section 12, T89N, R2E, 5th P.M, Dubuque
County, Iowa.
DISCUSSION
The attached sketch shows the subject lot. The abutting properties are owned by
Larry Hurst on the north and VanderMeulen on the south.
The area to be disposed of was originally part of a 60-foot wide lot subdivided for
the extension of Oneida Street when it was in the County. Oneida Street was
never extended; and consequently, the northerly 50 was disposed of to the
property owner to the north (Hurst). The remaining southerly 10 feet had never
been transferred to the property owner to the south (VanderMeulen). Upon review
of a building permit for an addition to Mr. VanderMeulen's residence, it became
evident that existing improvements and the building addition encroached onto this
lO-foot wide lot owned by the City of Dubuque.
Mr. VanderMeulen has agreed to a purchase price of $300.00, plus filing of
publication fees.
RECOMMENDATION
The City has no plans for the utilization of the lot.
I would recommend that a public hearing be set for the disposition of the City's
interest in Lot 2-2-1-1-1-3 N 1/2 SE 1/4 NW 1/4 of Section 12, T89N, R2E, 55h
P.M., Dubuque County, Iowa area on November 19, 2001. I would further
recommend that the purchase price be established at $300.00, plus platting,
publication, and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the disposal of the property through adoption of the
enclosed resolutions.

RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT 2-2-1-1-1-3

Whereas, Robert J. VanderMeulen has requested the vacating of Lot 2-2-1-1-1-3
N ~ SE ¼ NW ¼ of Section 12, T89N, R2E, 5th P.M., Dubuque County, Dubuque,
Iowa.
Whereas, the City Council of the City of Dubuque, Iowa has determined that this
lot is no longer required for public use and sale of said real property known as Lot 2-2-
1-1-1-3 N Y2 SE ¼ NW ¼ of Section 12, T89N, R2E, 5th P.M. in the City of Dubuque,
Dubuque County, Iowa should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot 2-
2-1-1-1-3 N Y2 SE ¼ NW ¼ of Section 12, T89N, R2E, 5'h P.M., in the City of
Dubuque, Iowa.
Section 2. That the conveyance of Lot 2-2-1-1-1-3 N Y2 SE ¼ NW ¼ of
Section 12, T89N, R2E, 5th P.M in the City of Dubuque, Iowa to Robert J.
VanderMeulen be contingent upon the payment of $300.00, plus platting, publication
and filing fees.
Section 3. That the City Clerk be and is hereby authorized and directed to
cause a notice of intent to dispose of said real estate to be published in the manner as
prescribed by law.

Whereas· pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque· Iowa on .day of ,2001,
the City Council of the City of Dubuque, Iowa met on the day of
· 2001, at 6:30 p.m. in the Public Library Auditorium, 11 th and Locust,
Dubuque, Dubuque, County, Iowa to consider the proposal for the sale of real estate
described as:
Lot 2-2-1-1-1-3 N ~ SE ¼ NW ¼ OF Section 12, T89N, R2E, 5TM P.M.,
Dubuque County, Dubuque, Iowa
Whereas, the City Council of the City of Dubuque, Iowa overruled any and all
objections, oral or written to the proposal to sell such real estate, except for easement
as noted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as Lot 2-2-
1-1-1-3 N ~ SE ~A NW ~A OF Section 12, T89N, R2E, 5TM P.M., Dubuque County,
Dubuque, Iowa, in the City of Dubuque, Iowa to Robert J. VanderMeulen be and the
same is hereby approved for the sum of $300.00, plus cost of publication, platting and
filing fees. Conveyance shall be by Quit Claim Deed.
Section 2. That the Mayor be authorized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed
of conveyance to Robert J. VanderMeulen upon receipt of the purchase price in full.
Section 3. That the City Clerk be and is hereby authorized and directed to
record a certified copy of this resolution in the office of the City Assessor, Dubuque
County Recorder and Dubuque County Auditor.
