Duggan and Members of the City Council October 15, 2001 Claim Against the City by Karen Ludovissy Date of Claim Date of Loss 10/3/01 9/21/01 Nature of Claim Vehicle Damage This is a claim in which the claimant states that the tire and rim of her vehicle were damaged after driving over a manhole cover, which allegedly was lying in the street. According to the report of John Klostermann, Street/Sewer Maintenance Supervisor, the Operations and Maintenance Department did not receive notice of a problem with a manhole lid on the date the claimant indicates in her claim. It is his recommendation that the claim be denied due to a lack of prior knowledge. The Legal Department concurs with this recommendation. Ms. Ludovissy claims to have damaged her tire when she hit a manhole c~over while driving northbound on Central Avenue at 30th Street. Our records show that we did not receive any notice of a problem with a manhole lid on Central on September 21 during the day, or at any time throughout the night. It is therefore my recommendation to deny the claim due to the lack of prior knowledge. If you need additional information concerning this claim, please contact me.
