MENT ADVISORY COMMISSION See. 15-46. Creat~dl Composition: Individuals who, by their professional or personal experience or interest, are knowledge- able of the development needs of the community at large and of low and moderate income per- sons in particular shall be considered qualified to serve on the Commission, subject to City Council review and consideration of other appli- cable information. (Ord. 83-92, 11-2-1992) There is hereby created a Community Devel- opment Advisory Commission whose primary purpose shall be to provide for citizen participa- tion in the development and evaluation of the City of Dubuque's Community Development Block Grant CCDBO") program. Sec. 15-48. Term; Filling Of Vacancies; Compensation: The term of office for a Commission member shall he three (3) years except as set forth be- low. The Commission shall consist of nine (9) members; five (5) of which shall be residents of one of each of the five (5) census tracts with the lowest median household inc6me as determined by the U.S. Department of Commerce, Bureau of the Census; three (3) of which shall be resi- dents of the community at large; and one of which shall be a member of the Housing Com- mission designated by the Housing Commission. (Ord. 83-92, 11-2-1992; Ord. 88-95, § 5, 12-18-1995, eff. 1-1-1996) Sec. 1ff.47. Application And Appointment Process: The process of appointment to the Commis- sion by the City Council shall include at least the following elements: (1) Submission of an application form con- taining the requested information on the qualifications and expectations of the applicant; and (2) Notice to and an opportunity for the general public to comment, in writing, on the qualifications of each applicant; and (3) A formal interview by the City Council to The initial terms of the Commission shall be as follows: (1) For each of the five (5) residents of the five (5) census tracts with the lowest median household income as determined by the U.S. Department of Commerce, Bureau of the Census; one shall be ap- pointed for an initial term of one year, two (2) shall be appointed for an initial term of two (2) years; two (2) shall be appointed for an initial term of three (3) years. (2) For the three (3) community at large residents; one shall be appointed for an initial term of one year, one shall be appointed for an initial term of two (2) years, and one shall be appointed for an initial term of three (3) years. (3) For the one member of the Housing Com- mission designated by the Housing Com- mission, the initial term shall be one year. A Commission member may be removed at any time with or without cause by a vote of two- thirds (213) of all members of the City Council. Supp. No. 29 941 § 15-48 DUBUQUE CODE A vacancy occurring on the Commission caused by resignation or otherwise, shall be filled by appointment of the City Council for the remainder of the unexpired farm. Members of the Commission shall serve with- out compensation except for actual expenses, which shall be subject to approval by the City Council. (Ord, 83-92, 11-2-1992) Sec. 15-49. Duties And Responsibilities; General: The Commission shall have the following duties and responsibilities: (1) To conduct public hearings in accordance with the minimum standards established in the CDBG program's citizen participa- tion plan to ensure meaningful citizen input in the planning, implementation and assessment of the City's CDBG pro- (2) To provide for and encourage the partici- pation of low and moderate income per- sons who reside in designated areas of slum and Might and residents of Iow and moderate income neighborhoods, as de- fined by the City Council, in the plan- ning, implementation and assessment of the CDBG program; (3) To identify community development needs, particularly the needs of persons of low and moderate income; (4) To serve in an advisory role upon the request of the City Council in policy decisions regarding funding priorities and program development and implemen- tation; (5) To monitor and evaluate program activi- ties to advise whether identified commu- nity development objectives have been met; (6) To undertake public information efforts to educate the citizenry of the availabili- ty of CDBG funded programs and to provide for a greater understanding of the City's community development forts; and (7) To assist in the preparation of the state- ment of community development objec- tives and projected use of funds, amend. merits thereto and required reports in- cluding, but not limited to, the annual grantee performance report (GPR) and the annual comprehensive housing assis- tahoe strategy (CHAS); (8) TO serve in an advisory role to the City Manager in the review of complaints and grievances received in accordance with the procedures established herein in Section 15-52; (9) To support, upon request, the efforts of the City Council and other City commis- sions in the assessment of the general development needs of the community. The City Council shall have the authority to establish or revise the priorities of the Commis- sion. (Ord. 83-92, 11-2-1992) Sec. 15-50. Duties And Responslbilities; Grievance Procedure~ Review Standards; Appeal Process: The Commission shall participate in the fol- lowing described grievance procedure estab. lished by the City Council for the community development block grant program. (1) All complaints regarding the community development block grant (CDBG) pro- gram shall be handled in accordance with the following described grievance procedure. Any aggrieved person shall file a grievance with the City Manager, Grievances shall be tiled in a timely manner and must be received by the City Manager within one year of the alleged occurrence. Supp. No. 29 942 DUBUQUE CODE (8) Participate with the Dubuque area chamber of commerce, the hotel and restaurant in- dustry and other interest groups to pro- mote and develop the convention and tourism business for the Dubuque area. (9) Execution of contracts and agreements for the use, operation and maintenance of the civic center facility; contracts and agree- ments for the use of the faciliw may be signed by the city manager, except that all contracts for usage of the facility involving a term of longer than five (5) days shall be subject to execution by the mayor with the approval of the city council. (Code 1976, § 10~-24) 13-15. Programs, projects and services, conformity to legal and policy re- strictions. All programs, projects and services to be devel- oped by the commission must conform to the pol- icies of the city and to applicable local, state and federal taws, rules and regulations. (Code 1976, § 10~-25) Soc. 13-16. Solicitation and acceptance of do- nations and gifts. The commission may solicit and otherwise ac- cept donations and gifts of money, personal prop- erty and personal services. All such monies and personal property as received shall become the property of the city for the general use for the support of the civic center and its programs un- less such items have been designated by the do- nors for specific purposes. (Code 1976, § 101A-26) SOc. 13-17. Membership, appointment. (a) The commission shall be comprised of a membership of five (5) persons, who shall be ap- pointed by the Dubuque City Council for terms of two (2) years. Two (2) of the initial appointments shall be for a term of one year, three (3) of such initial appointments shall be for a term of two (2) years. ih) Upon completion of their term of office, mem- bers of the commission shall continue to serve in their full capacity until a successor has been duly appointed. lc) Membership on the commission shall be lim- ited to persons who are residents of the city. (d) On and after July 18, 1983, the terms of members of the commission shall be for three (3) years. Terms of those members originally sched- uled to expire June 29, 1984, shall be extended to expire June 29, 1985, and terms of those members originally scheduled to expire June 29, 1985, shall be extended to expire June 29, 1986. Thereafter all terms shall be for three (3) years. (Code 1976, § 10%-27) SOc. 13-18. Vacancies in membership. A vacancy caused by death, resignation or oth- erwise on the commission shall be promptly filled by the Dubuque City Council for the unexpired term of office. (Code 1976, § 10~-28) SOc. 13-19. Attendance at meetings, fre- quency required; record of atten- dance. (a) Members of the commission shall attend at least two-thirds (%) of all regularly scheduled and held meetings within any twelve-month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the commission to recommend to the Dubuque City Council that said member be replaced. (b) The attendance of all commission members shall be entered upon the minutes of all meetings by the secretary. (Code 1976, § t01/~-29) Sec. 13-20. Compensation. All members of the commission shall serve without compensation except for reimbursement of necessary expenses.
