Dear Mayor and City Council Members:
The Zoning Advisory Commission has reviewed the above-cited request. The application,
staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, indicating that he wanted to relocate his carpeting
business to the former Yankee Glove Factory.
Staff reviewed the rezoning, noting that the carpeting business is not an allowed use in the LI
Light Industrial District but is allowed in the CS District. Staff explained that the CS District is a
blend of industrial and commercial-type uses, and can serve as a transition between the
existing LI District and the surrounding C-2 District.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the surrounding property
is zoned a mixture of C-2 Commercial and LI Light Industrial and that the CS District will not
adversely impact adjacent property.
Recommendation
By a vote of 7-0, the Zoning Advisory Commission recommends that the City Council approve
the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The site was formerly used as the Yankee Glove Factory, but
recently has been vacant.
Physical Characteristics: The subject ~arcel has frontage on Garfield Avenue with a
large parking area in the rear of the building. The structure is an L-shaped
configuration that was built right on the Garfield Avenue right-of-way, as are several
other buildings in the neighborhood.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan did not
designate this area.
Impact of Request on:
Utilities: Existing utilities are adequate to handle the proposed use.
Traffic Patterns/Counts: Garfield Avenue is rated as a local street. There are no
vehicle counts available.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impacts to the environment by
the change in use.
Adjacent Properties: Staff does not anticipate any adverse impacts to adjacent
properties by the change in use of the building.

CIP Investments: None proposed.
Staff Analysis: The applicant is requesting rezoning of the subject parcel from LI Light
Industrial to CS Commercial Service and Wholesale District. The applicant wishes to
move Dubuque Wholesale Carpet to the proposed location to accommodate growth in
the business.
Carpeting stores are not specifically listed as a permitted use in any district within the
City Zoning Ordinance. Carpeting stores have been interpreted to be included under
furniture/home furnishing stores, which are a permitted use in the commercial zones,
including the Commercial Service and Whole District.
The surrounding property is used for a combination of commercial and light industrial-
type uses. The property is currently zoned LI Light Industrial which does not allow
retail-type uses other than those uses that would serve the daily needs of employees
within a large industrial district such as restaurants, banks or gas stations. The CS
Commercial Service and Wholesale District has a mixture of uses that is compatible as
a transitional zone between industrial and commercial uses. The subject area does
serve as a commercial node for the large residential population of the north end of
Dubuque. Planning staff does not believe that the proposed rezoning would adversely
impact the value of surrounding properties.
Planning staff recommends that the Zoning Advisory Commission review Section 6-1.1
of the Zoning Ordinance that establishes criteria for review of rezoning requests,

ORDINANCE NO. 74-01
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 430 GARFIELD
AVENUE FROM LI LIGHT INDUSTRIAL DISTRICTD TO CS COMMERCIAL
SERVICE AND WHOLESALE DISTRICT, WITH CONDITIONS.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter-described property
from LI Light Industrial District to CS Commercial Service and Wholesale District with
conditions described in the attached Memorandum of Agreement, to wit:
Lot 1 of Lot 2 of Lot 2 of Lot 2, Lot 3 of Lot 2 of Lot 2 of Lot 2, and Lot 2 of
Lot 2 of Lot 2 of Lot 2, all of Mineral Lot 106, and to the centerline of the
adjoining public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.
