Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, memorandum and related materials are attached for your review. Discussion Staff reviewed the proposed text amendment noting that the City has received two requests in the last six months to allow mini-warehousing facilities in a C-3 General Commercial District. The Zoning Advisory Commission discussed the request, noting that by making mini- warehousing a conditional use in the C-3 District, it will save applicants time and money compared with seeking a rezoning, and still allow adjacent property owners to have input. Recommendation By a vote of 7-0, the Zoning Advisory Commission recommends that the City Council approve the request. This is the second such request in the last six months. The Commission directed Planning Staff to prepare a text amendment to allow mini- warehousing as a conditional use in the C-3 General Commercial District. DISCUSSION Mini-warehousing is currently only specifically listed as a permitted use in a CS Commercial Service and Wholesale District. Planning staff has allowed also mini-warehousing facilities to be located within industrial districts as all the industrial districts list warehousing as a permitted use. In addition, the Commission, es noted at their October 3rd meeting, that moving and storage facilities is also a permitted use in a C-3 District. Moving and storage facilities are operated by moving companies and are intended to store clients' possessions on a temporary basis. Mini- warehousing, though, rents out small cubicles for storage of personal items on a month-to-month basis. Commissioners felt that mini-warehousing may often be appropriate in a C-3 District. However, Commissioners also fell that mini-warehousing may not be appropriate in all instances, depending on the mix of surrounding land uses. The Commission felt that allowing mini- warehousing as a conditional use in a C-3 Distdct would expand the available property within the community to develop mini-warehousing developments, but also allow surrounding property owners an opportunity to have input prior to their approval. The Zoning Board of Adjustment would review alt requests for conditional use permits, which does nut require property owners within 200 feet of the property to be notified. Commissioners felt that additional conditions should be attached to any mini-warehousing development in a C-3 District. The conditions recommended were as follows:' 1) 2) 3) 4) The entire perimeter be enclosed by security fence. All lighting for the facility utilize cut-off luminaries. All vehicle access and staging areas, be paved. Screening of at least six foot in height be placed along the property line between the mini- warehouse facility and all adjacent residential property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Appendix A (the Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by adding to Section 3-3.3(D) General Commercial District Conditional Uses, mini-warehouse facilities as shown below: 3) Mini-warehouse facilities provided that: a. The entire perimeter be enclosed by a secudty fence. b. All outdoor lighting for the facility utilize cut-off luminaries. c. All vehicle access and staging areas be paved. d. Screening of at least six (6) foot in height shall be placed along the property line between the mini-warehouse facility and all adjacent residential property. e. The parking group requirements can be met [47]. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4.
