Koch, Public Works Director Main Street Reconstruction, 5th to 9th Streets INTRODUCTION The enclosed resolutions authorize the public bidding procedure for the reconstruction of Main Street from 5th to 9th Street. DISCUSSION The reconstruction of Main Street from 5th to 9th Street includes the complete removal of the existing Plaza surface in preparation of the construction of a two- way, 24-foot wide concrete pavement with sidewalks and amenities behind the curb. The Town Clock would remain in its present location and traffic would be diverted around both sides of the clock structure. The design will allow cars, busses, small trucks, and fire engines to maneuver around the clock in either direction. The street would include cutouts for short-term parking on both sides of the street in select areas. These parking areas were tailored for each business's needs. Diagonal parking will be provided in front of Graham's. In those areas without parking, there will be additional space for trees, benches, trash receptacles, and streetlights. Brick tree grates, rather than open grates, will be used for pedestrian safety. Tables will be placed at various locations throughout the Plaza. The benches will be black ornamental benches and would be placed back-to-back, perpendicular to the street. The benches should be located within 8 to 10 feet of the tree planters to allow for ease of conversation in various seating arrangements. The street will be constructed of standard concrete; the parking areas in red- colored concrete; the planting areas in stamped colored concrete in a brick pattern; and the sidewalk will be buff-colored concrete similar to the colors surrounding City Hall. The street amenities will include Iow monuments/kiosks which can be used to close Main Street during special events. It is anticipated that the closures would utilize some sort of banner strung between the two monuments. The monuments will be The bid will include an early completion bonus of $2,500 per day, with a 30-clay maximum for $75,000. The project is assessable, with 25 percent of the street cost assessed, less watermain, fiber optic conduit, and other typical City paid bid items. BUDGET IMPACT The estimate for this project is as follows: Construction Contract Contingency Inspection Construction Staking Early Completion Bonus $2,341,105.87 234,110.59 221,000.00 30,000.00 75,000.00 Total Project Cost $2,901,216.46 The project will be funded as follows: Street Construction Funds Local Option Sales Tax Fund Special Assessment To Property Owners Special Assessment To City-Owned Property $ 402,774.54 1,873,831.44 543,082.37 81,528.11 Total Project Funding $2,901,216,46 The estimate from Durrant was in the amount of $3,103,616. The City, however, felt this amount was higher than typical City costs; and, therefore, the City has reduced the project cost estimate and assessments to reflect a total project cost of $2,901,216.46. The project will be funded from the Street Construction and Local Option Sales Tax Funds, utilizing funds from Fiscal Year 2003 ($1,446,700) and 2004 ($781,903). The project, as outlined, will require $2,358,184.09 in City funds, leaving a negative balance of $129,531 in City funding. The Town Clock Plaza and Amenities Project - Phase II, which provided for opening Main Street from 8th Street to 5th Street, and was funded in the current CIP document for $1,928,855 in Fiscal Years 2002 and 2003. In addition, an amount of $781,903 was included in Fiscal Year 2004 for reconstructing the area west of the Town Clock, including the area currently used for festivals and special events. These two phases provide funding of $2,710,758, with $2,228,603 City funding, and the remaining balance funded through special assessments. Finally, an amount of $663,000 as provided in an out year for improving the 6th and 7th Street side streets and crosswalks. The current project for opening Main Street is estimated to require all of the local share provided in Fiscal Years 2002 through 2004. The additional funding of $781,903 will need to be reprogremmed into Fiscal Year 2003 (construction season 2002) through the new CIP process. In addition, the Town Clock area improvements will need to be rebudgeted in a future year since these funds are being used to complete the current Main Street Reconstruction Project. ACTION TO BE TAKEN The City Council is requested to give preliminary approval to the Resolution of Necessity, approve the preliminary assessment schedule, establish the date of the public hearing, and to authorize the City Clerk to advertise for proposals through the adoption of the enclosed resolutions. The successful bidder will be required to furnish a performance bond in an amount equal to one hundred percent (100%) of the contract pdce. Said bond is to be issued by a responsible surety company approved and acceptable to the City Council, and shall guarantee the faithful performance of the contract and terms and conditions therein contained, and shall guarantee the prompt payment of all materials and labor and protect and save harmless the City of Dubuque, Iowa, from claims and damages of any kind caused by the operations of the Contractor. No bid submitted by any Contractor which contains a condition or qualification shall be recognized or accepted by the City Council and any letter or communication accompanying the bid which contains a condition or qualification upon the bid which has the effect of qualifying or modifying any provision of the specifications in any manner will be construed as a non-qualifying bid and will be rejected by the City Council as not responsive. Said bond shall also guarantee the material and the maintenance of the improvement(s) constructed for a minimum period of two (2) years from and after its completion and acceptance by the City Council. All proposals must be made on blanks furnished by the City Engineer and each bidder will be required to state his prices for doing all the items in each section on which he makes a bid and for all things necessary to make a complete job. The Bidder's attention is directed to the City of Dubuque's Affirmative Action Program which is included in the Contract Specifications and the provisions thereof and hereby made a part of the Contract Documents by reference and incorporated therein. The Contractor, when requested by the City of Dubuque, will furnish a statement of his financial and practical qualifications as provided for in the General Requirements of the Specifications. By virtue of statutory authority, a preference will be given to products and provisions grown and coal .produced within the State of Iowa and to Iowa domestic labor. The City Council reserves the right to reject any and all bids or to waive any technicalities and irregularities. All bids will be publicly opened and read by the City Clerk at 2:00 o'clock p.m. on the 6th day of December, 2001, and will be submitted to the Council for final action at a meeting to be held in the Public Library Auditorium, at said City at 6:30 p.m. on the 17th day of December, 2001. A contract will be awarded at that time or such subsequent time as the City council may determine. Schneider, City Clerk CONSTRUCTION SCHEDULE AND LIQUIDATED DAMAGES Work herein provided for shall be commenced within ten (10) days after notice to proceed has been issued and shall be fully completed by August 31, 2002. For each calendar day that any work shall remain uncompleted beyond the completion schedule, $500.00 per calendar day will be assessed, not as a penalty but as predetermined and agreed liquidated damages. The Contractor will be separately invoiced for this amount, and final payment will be withheld until payment has been made of this invoice. The assessment of liquidated damages shall not constitute a waiver of the City's right to collect any additional damages which the City may sustain by failure of the Contractor to carry out the terms of his contract. An extension of the contract period may be granted by the City for any of the following reasons: 1. Additional work resulting from a modification of the plans. 2. Delays caused by the City. 3. Other reasons beyond the control of the Contractor, which in the City's opinion, would justify such extension.
