The Zoning Advisory Commission has reviewed the above-cited request. The
application, memorandum and related materials are attached for your review.
Discussion
Staff reviewed the submitted plat of survey indicating that applicant is asking to waive
lot frontage for Lot 1.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the new plat of
survey does not materially change the lot layout or adversely impact developability of
adjacent lots.
Recommendation
By a vote of 7-0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted plat of survey is considered a simple plat; however, Lot 1 does not have
sufficient lot frontage as required by the City Subdivision Regulations. The Zoning
Advisory Commission and City Council must waive the lot frontage requirement to
approve the submitted plat of survey.
DISCUSSION
The submitted plat of survey of the West View Shopping Center Place No. 2 subdivides
two existing parcels to provide additional space for an expansion of the former FirStar
Bank branch at 1805 John F. Kennedy Road. Lot 1 is substandard in that it only has
50 foot of lot frontage, where 60 foot is required. However, this situation existed prior
to the submittal of the new plat of survey as Lot 1 was formerly known as Lot 1 of 1 of 2
of West View Shopping Center Place, and at that time, only had 50 foot of lot frontage.
The submitted plat of survey adds 100 by 125 foot section of property to Lot 2, which
does has frontage on John F. Kennedy Road.
The submitted plat of survey is in all other respects in compliance with the City of
Dubuque's Subdivision Regulations. The submitted plat allows for the expansion and
reuse of an existing commercial building along John F. Kennedy Road and the waiving
of the lot frontage requirement for Lot 1 will not adversely impact the development or
use of Lot 1.
RECOMMENDATION
Planning Staff recommends that the submitted plat of survey of West View Shopping
Center Place No. 2 be approved, as it is in substantial compliance with the City of
Dubuque Subdivision Regulations, except for waiving the lot frontage requirement for
Lot 1 to allow 50 foot of lot frontage where 60 foot is required.

RESOLUTION APPROVING THE PLAT OF SURVEY OF WESTVlEW SHOPPING
CENTER PLACE NO. 2
Whereas, there has been filed with the City Clerk a plat of survey of Westview
Shopping Center Place No. 2; and
Whereas, said plat provides Lot 1 with 50.10 feet of lot frontage, where 60 feet is
required, by Section 42-19(b) of the Subdivision Regulations; and
Whereas, said plat of survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said plat of survey has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE. IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 1 to have 50.10 feet of lot frontage where 60 feet is required.
Section 2. That the plat of survey of Westview Shopping Center Place No. 2 is
hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said final plat.
