Gentlemen: On March 15, 1943, Charles T. Landon filed a claim with the City for $320.00 for damages caused by one City T.uck going through a stop signal on West Third and Alpine Street and running into his car. The claim was referred to me and I recommended that the claim be denied on the ground that the City truck was being engaged in a governmental duty. The Coun- cil approved my recommendation. Since that time I have thorough~ ly investigated the law on this suo- ject and from my investigation and examination, I am of the opinion that the truck, at the time and place in question was acting in a corpo- rate capacity on behalf of the City and that the City is liable for any damage caused by the negligence of the operator of said truck. Gentlemen: The above action is now pending in the District Court, wherein plaintiff is asking for $300.00 on three separate divisioils of his Petition. The facts III this case are that a City owned truck, while being used to remove debris and obstructions from the streets, ran upon and over a sidewalk and struck a building located on the northwest corner of 15th Street and Central Avenue on or about June 12, 1944, said building being owned by Fank R. Lacy and occupied by John C. Beck in the operation of a drug store, causing damage to the build- ing and the contents thereof. Court of Iowa, in City of Sioux and 1188 and "The duty of the city with refer- ence to its streets is a corporate duty. The same ruling has been fol- lowed in the case of Leckliter vs. City of Des Moines, 211 Iowa 251. The City, while acting in a corporate capacity, is liable for the negli- gence of its servants.
