Gentlemen: On March 15, 1943,
Charles T. Landon filed a claim with
the City for $320.00 for damages
caused by one City T.uck going
through a stop signal on West Third
and Alpine Street and running into
his car. The claim was referred to
me and I recommended that the
claim be denied on the ground that
the City truck was being engaged
in a governmental duty. The Coun-
cil approved my recommendation.
Since that time I have thorough~
ly investigated the law on this suo-
ject and from my investigation and
examination, I am of the opinion
that the truck, at the time and place
in question was acting in a corpo-
rate capacity on behalf of the City
and that the City is liable for any
damage caused by the negligence
of the operator of said truck.

case are that a City owned truck,
while being used to remove debris
and obstructions from the streets,
ran upon and over a sidewalk and
struck a building located on the
northwest corner of 15th Street and
Central Avenue on or about June 12,
1944, said building being owned by
Fank R. Lacy and occupied by John
C. Beck in the operation of a drug
store, causing damage to the build-
ing and the contents thereof.

Whereas, the sad Dubuque
County, Iowa desires to sell the

Whereas, the sale of said proper-
ty by Dubuque County, Iowa to
William C. Avenarius for a sum
less than the total amount stated
in the Tax Certificate, including all

Gentlemen: In reference to the
claim of Margaret Mueller for
$200.00, from my investigation of
this claim I find that on January 27,
1945, Margaret Mueller was waiting
for a bus at Mike Sand's place of
business on Central A venue. That
she saw a bus coming east on Cen~
tral Avenue, left the place where
she was waiting, ran across the
street, slipped and fell near the
crosswalk. She sustained a broken
right ankle and has had conside:r,
able expense.
From my investigation I feel that
if there is any liability upon the
part of the City, which is doubtful,
that claimant herself was negli.
gent, and, therefore, not entitled to
recovery.
Gentlemen: I herewith submit

condition at this place and that
Mrs. McGough, because of the fall,
fractured her right wrist compelling
her to obtain the services of a
physician and the hospital; that she
is still going to the doctor and will
be compelled to do so f,or the next
two months. That her bills for the
hospital and doctor are $73.75. That
she has agreed to .settle this claim
for her actual expenses.

\Vhereas, Before any transfer may
be made from the Emergency Fund
to any other fund, an application
must be made to the State Comp-
troller for authority to make the
transfer and his approval secured
thereon; Now, therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that, sub-
ject to the approval of the State
Comptroller there be and there is
hereby transferred from the Emer-
gency Fund to the Consolidated
Fund the sum of $359.83 and the
State Comptroller is hereby peti-
tioned to authorize and approve
such transfer; and
Be It Further Resolved that upon
the approval of such transfer the
Auditor of the City of Dubuque is
directed to adjust his accounts ac-
cordingly and to notify the Treas-
urer of such transfer and such no-
tification shall be acompanied by a
copy of this resolution and the rec-
ord of its adoption.
The resolution was passed, adopt-
ed and approved by unanimous ac-
tion of the City Council of the 20th
day of March, 1945 and all mem-

RESOLUTION AND APPLICATION
FOR PERMANENT TRANSFER
OF FUNDS.
Whereas, An emergency tax levy
was made by the City Council of
the City of Dubuque, for use in sup-
plementing those funds embraced
in the consolidated tax levy which
require debt service during the fis-
cal year beginning April 1, 1944 and
ending March 31, 1945 upon author-
ity and approval of the State Camp.
troller; and
.Whereas, During the current year
Grading Bonds in the amount of
$30,000.00 and Improvement Bonds
in the amount of $35,000.000 mature
and Grading Bond Interest in the
amount of $675.00 and Improvement
Bond Interest in the amount of
$4,650.00 became due and payable;
and
Be it resolved by the City Coun-
cil of the City of Dubuque that said
detailed distribution of proposed ex-
penditures for the fiscal year begin-
ning April!, 1945 and ending March
31, 1946, as heretofore prepared, be

This department is operated from its receipts and
is not supported by thf' tax levy, hence no appropria-
tions from taxes is made. These appropriations shall
be paid from the "rater Works Fund.
Section 2. General Miscellaneous Revenues. General
miscellaneous revenues which are collected during the
fiscal year shall be allocated to the funds and purposes
as provided for herein and shan be used for the pay-
ment (If the expenses of such funds and purposes in the
sums herein shown.
Section 3. Surplus. Any surplus not specifically allo-
cated for a definite purpose in the budget and which
may exist in either the Consolidated Fund or the mIs-
ceUaneous revenues account shall be and the same is
hereby appropriated and sd apart to be applied as
contingencies arise or may be used for such proper
purposes as the Council may determine upon. Any
surplus not !'lpecifically distributed in the budget and
remaining in funds created by the levy of special taxes
shall be and the same is hereby approprIated for any
proper purpos€' incident to such funds, Any surplus
remaining in any fund at the close of the fiscal year
1944-45 (except taxes which have been levied for special
purposes) shall be transferred into and become a part
of the Consolidated Fund. Nothing herein contained
shall authorize the transfer of funds realized from
special taxes to a fund or purpose for which any SIIecial
tax leyy nas been made. except only with the apIIroval
of the State Comptroller.
Section 4. Emergency Fund, Transfers of money may
be made from the Emergency Fund to any other fund
for the purpose of meeting deficiencies in any such fund
arising from any cause; provided, however, that no
such transfer shall be made except upon written approval
of the Stat'" Comptroller and then only when such
approval is unanimously requested by the City Council.
Section 5. Delinquent Tax Collections, Delinquent
prior years' tax collections shall be allocated to the
respect! '-'e funds entitled to the same when and as the
fORme are received by the City Treasurer.
Section 6. Distribution. That the distribution and
division of thE' within appropriations shaH be made in
accordance with the detailerl distribution adopted by
the City Council on March ao, 1945, which detailed dis-
tribution is made a part of this ordinance by reference
thereto and shall be so considered in connection with
the expenditures of saia appropriations.

Resolution No. 26-45
A resolution designating the de-
positories for public funds of the
City of Dubuque.
Be Is Resolved by the City Coun-
cil of the City of Dubuque that the
following banks be appointed depos-
itories of the public funds, and the
City Treasurer if hereby authorized
to distribute such funds in such
banks in amounts not to exceed the
following: First National Bank,
$225,000.00; American Trust and
Savings Bank, $200,000.00; Dubuque
Bank and Trust Company, $175,-
000.00.
Gentlemen: As City Manager of
the City of Dubuque, the undersign.
ed begs to advise your Honorable
Body that all officers and em-
ployees whom he 'has the power to
appoint, who are now serving and
acting in their respective capacities
and assisting in the orderly admin-
istration of the City Government of
this City and of the various depart-
ments thereof, said officers and
employees beeing under my super-
vision, direction and control and
their appointments continuing at
the pleasure of the Manager, shall
be paid salaries in accordance with
the budget approved by the City
Council.
Be It Further Resolved that the
City Treasurer be and he is hereby
directed to file with the County
Treasurer of Dubuque County, Iowa,
a list of such depositories and to
keep such list on file with such
County Treasurer at all times.
