Whereas, a special municipal
election was held on April 2, 1945
in the City of Dubuque pursuant to
Special Ordinance No. 1-45 finally
passed by the City Council on Feb-
ruary 5, 1945, at which election the
following question or proposition
was submitted to the electors of
the City of Dubuque, as provided
by the Statute of Iowa, namely, to-
wit:
"Shall The Key City Oas Com-
pany, its successors and assigns, be
granted the right to retain, extend,
maintain and operate its exisiting
gas distribution system and to lay
and maintain its gas pipes and ap-
purtenances thereto, in, under,
through, across, along and upon
the streets, alleys, avenues, brid-
gey, Parks, highways and public
places in the City of Dubuque
and additions thereto for a period
of twenty-five (25) years as pro-
vided and upon the terms and con-
ditions stated in the ordinance
adopted by the City Council of Feb-
ruary 5th 1945, a copy of which
is printed hereon."
And, Whereas, the votes cast at
such election were canvassed by

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: At the session of the
city council held April 2, 1945 the
petition oY the Stampfer Building
Company requesting permission to
place a heating tunnel under the
alley pavement in the rear of the
store building and also for permis-
sion to attach a metal stack of a
proposed boiler room to the three
story brick Pire station at 9th and
Iowa Streets was referred to the
Council to view the grounds.
The council viewed the site and
decided to allow the heating tunnel
in the alley, but not the attachment
of the metal stack to the fire sta-
tion as shown on the plan. Since
then the plans for the stack con-
struction have been revised so that
no attachment to the fire station
will be necessary.
I recommend that the council
grant the petition of the Stampfer
Building Company for permission
to place a heating tunnel in the al-
ley between Main and Iowa Streets
connecting the South ~/a of City Lot
31 with the Lot 1 of the Subdivision
of City Lots 170 and the East 43
fee[ of 171 and the North 2 feet of
the East 43 feet of 172 by the pass-
age of a proper ordinance.

In re: Claim of Gussie M. Hagerty
Honorable Mayor and City Council,
City of Dubuque, Iowa.
Gentlemen: With reference to the
claim of Gussie M. Hagerty, I have
investigated the same and find that
on or about February 19, 1945,
claimant fell on the sidewalk cover-
ed with dangerous ice and snow and
sustained injuries to her back.
X-rays were taken and she was re-
quired to employ the services of a
physician, the actual cost was
$25.00.
From my investigation, the side-
walk was in a dangerous condition
and claimant is entitled to a recov-
ery. She has agreed to accept
$25.00 in full payment of her claim.
I recommend that a warrant be
made payable to her for that amount
and the same delivered to her upon
delivery to the City of a properly
executed release.

Gentlemen:-From my investiga-
tion Ifind that the claimant fell at
a spot on 6th and White Street
which was dangerous and suffered
injury to his kneecap which caused
him to be laid up for two or three
weeks. His doctor bill amounts to
$21.00 and from my investigation I
am of the opinion that the claim
should be allowed in the sum of
$21.00.
I recommend that a warrant be
issued payable to him Yor the
amount of $21.00 and delivered to
him upon delivery to the City oY a
release properly executed by him.

In re: Claim of Mrs. Lonie W.
Brown for $500.00.
Honorable Mayor and City Council,
City of Dubuque, Iowa.
Gentlemen: From my investiga-
tion, Ifind that on February 4, 1945,
- claimant, while attempting to get
on a bus at 4th and Main Street,
stepped on some dangerous ice and
snow on the sidewalk and fell and
suffered severe injuries to her hip
causing her to secure the services
of a physician and services ai the
_ hospital. She had X-rays taken at
the hospital and her hospital ex-
penses were $78.00. The doctor bill
--,~~", was $21.50. The rest of the amount
she claims for injuries, pain and
' f' suffering.
After consultation with her and
her husband, they have agreed to
accept $'r 5.00 in Yull payment of
their claim. I recommend that the
claim be allowed in the sum of
$75.00 and that a warrant be issued
payable to Mrs. Lonie W. Brown Yor
$75.00 and delivered to her upon de-
livery to the City of a properly ex-
ecuted release.

In re: Claim of Evelyn Crahan.
Honorable Mayor and City Council,
City of Dubuque, Iowa.
Gentlemen: With reference to
the claim of Evelyn Crahan, from
my investigation of this case, it ap-
pears that while claimant was walk-
ing east on Seminary Street on the
south side of the street just east
of the steps entering Clark College
she slipped and fell on some rough,
rounded and uneven ice and fractur-
ed above in her ankle. It is the fur-
ther claim that the sidewalk at that
place is raised on a alight angle
and further added to the dangerous
condition. That because of her in-
jury she sustained damages for
hospital bill, $15.50 and doctor bill
$31.00, taxi bill in the amount of
$12.40 and other items of expense
in addition to her pain and suffer-
ing. She has agreed to accept the
sum of $46.50, the same being the
amount of hospital and doctor bill.
I am of the opinion that this
claim should be paid in that amount
and recommend that a warrant be
drawn payable to Evelyn Crahan
for $40.50 and delivered to her up-
on delivery to the City of a proper-
ly executed release.
