Mayor Thompson stated that this
is the regular monthly meeting of
the City Council for the purpose of
acting upon such business as may
properly come before the meeting.
And, Whereas, thereafter, a com-
mittee of three was aP1lointed as
by Sec. 544 of the Building Code of
the City of Dubuque provided, to
make a thorough investigation of
said building and report as to the
condition of said building to the
City Council.
And, Whereas, said Committee
filed its report with this Council,
dated September 27, 1945, stating,
among other things, that said build-
ing is a fire hazard, menace to ad-
joining property and recommended
its demolition.

greatest fire hazard throughout the
plant and stock yards, to be con-

ter Box would also give fire alarm
service to the other buildings in
this vicinity. The City of Dubuque
to connect the Master Box to its
regular Fire Alarm System. The
above plan has been agreed to in
its entirety by Mr. H. W. Wahlert.
It is my considered opinion that
the plan outlined above will give
the Dubuque Packing Company and
surrounding buildings adequate fire
alarm protection.

10, 1945, about 7:30 a. m. claimant,
walking on the west side of Bluff
Street where Seventh Street inter-
sects Bluff Street tripped and fell
over some shrubbery that was cut
off right next to the sidewalk and
sustained injuries, broke out one .of
her teeth and that because thereof
she was compelled to have the ser~
vices of a physician and a dentist
and lost three days time at work, all

opinion from this office in regard
to the following question
Has the city council of the town
of Ames, Iowa, the right to issue
a beer permit to the Ames Elk
Lodge which has recently been or-
ganized and has not been in con-
tinuous operation as a club for more
than a few months?
We understand the sole question
is as to whether or not such a per-
mit could be issued because of the
fact that the club was not in con-
tinuous operation as a club for at
least two years prior to the date
of its application and we are assum-
ing that all of the other provisions
of Section 1921-f110 (1937 Code now
Sec. 1921.111 of the 1939 Code) have
been complied with. Section 1921-
fl09 (1937 Code, now Sec. 1921.110
of the 1939 Code) grants the cities
and towns the right to issue Class
"BI" beer permits to clubs upon

Gentlemen: I have investigated
the claim of Alvin Haas that was
referred to me and I find that on
or about September 28, 1945, a tree
in front of 509 West Locust Street
fell across the street on his car
damaging the same considerably. I
further find that the City had notice
of the dangerous condition of this
tree and that the claimant had no
knowledge of the dangerous condi-
tion thereof. His car was damaged
and an estimate shows that the ap-
proximate cost of placing the car
in practically the same condition
it was before is somewhere in the
neighborhood of $125.00. He has
agreed to settle this claim for $85.00.

In re: Claim of Harvey Sinclair

Gentlemen: I have investigated
the above case and find that a rot-
ten and decayed limb fell from a
tree on to the top of the automobile
of Harvey Sinclair while the same
was parked in the street at or near
594 Jefferson Street. From my in.
vestigation I am of the opinion that
the City is liable. He claimed dam-
ages in the sum of $100.00 but upon
investigation I find that the car
can be fixed for $56.00. He has
agreed to accept $50.00 in full pay-
ment of his claim.
I recommend that the claim be
settled for the sum of $50.00 and
that a warrant be drawn in favor
of Peter W. Klauer, attorney for
Harvey Sinclair, and delivered upon
delivery to the City of a release
properly executed by Harvey Sin-
clair.

It is noted, however, that in the
last few lines of subsection "a" pro-
vision is made that the golf and
country clubs shall comply with the
restrictions contained in the suc-
ceeding paragraphs of the section.
There is no statement in subsection
"a" that the city clubs shall comply
with all of the restrictions of the
subsections after section "a". The
succeeding restrictions in c, d, e,
and f would therefore clearly be
applicable to golf and country
clubs but not applicable to appli-
cants by city clubs. This seems to
be the legislative intent for clearly
there is no reason for placing such
restrictions on city clubs. Such
Class "B" beer permits are issued
to other Class "B" applicants in the
city without such restrictions as
outlined in subseotions c, d, e, and
f and there would seem to be no
reason for placing such restrictions
on a city club application. We do
find, however, on examining other
statutes, that where the board of
supervisors issue permits, similar
restrictions are placed on such is.
suance. Thus we find the board of
supervisors is authorized to issue
permits in villages platted prior to
January 1, 1934. This is somewhat
similar to subsection f where the
right to grant the permit to a club
is based on the club having been
in operation since the first d,ay
of January A. D., 1934.
It is our conclusion, therefore,
that subsections b, c, d, e and f in
Section 1921-f110 are limitations on
the board of supervisor's right to
issue Class "B" beer permits to golf

any rules and regulations they may

Sec. 3. That the right to place
and maintain said stairway shall
be subject to the continuous con-
trol of the City Council, reserving
the right to said City Council to
impose restrictions and conditions
upon the enjoyment thereof as may
be reasonably necessary for the pro-
tection of the public interests, in-
cluding the right to revoke and re-
scind the grant hereby made, if at
any time the public interests should
so require.
Sec. 4. As a further consideration
of the rights and privileges herein
granted, said AMTAS Company, its
successors and assigns, assume any
liability for damages to persons or
property which may result from the
construction and/or maintenance of
said stairway, and said AMT AS
Company, Jts successors and as-
signs at its own expense, agrees to
defend any and all claims or actions
which may be made or brought
against the City because of the con-
struction and/or maintenance of
such stairway, and should the City
be required to pay any sum as dam-
ages, said AMTAS Company, its
successors and assigns, agree to
fully reimburse the City therefore
and to hold said City harmless from
any damages.
Sec. 5. Should the rights and priv-
ileges- herein granted be rescinded
or revoked, said AMT AS Company
its successors and assigns, at its
own expense and upon receipt of
notice by registered mail, agrees,
within 30 days after receipt of such
notice, to remove the structure
herein authorized and to restore
the alley in as good condition as it
was before said construction.

Avenue had been requested from
the Building Inspector by The Mur-
phy Companies and that the per-
mit could not be granted as the
panel when erected would be on
