Van Milligen, City Manager Laura Carstens, Planning Services Manager-'~{~ Dubuque Ward and Precinct Plan: Revisions to Ordinance and Map On October 29, 2001, the Planning Services Department received a facsimile from Sandy Steinbach, Secretary of State, Elections Division, for the State of Iowa. Ms. Steinbach is responsible for reviewing reprecincting plans submitted to the state by counties and municipalities. After review of the ward and precinct plan submitted by the City of Dubuque, Ms. Steinbach has asked for some minor changes to the metes and bounds language of the ordinance, and one minor change to the boundary between precincts 13 and 16 as delineated on the ward and precinct map. The changes recommended include: 1) Changing street name types such as street, avenue, boulevard, etc. to insure consistency with the Census Bureau Tract maps. 2) Adding qualifying language to the metes and bounds description, such as "southwesterly~ versus ~southerly" and 'along the north fork of Catfish Creek" versus "along Catfish Creek'. Altedng the mapped boundary along McDonald's pdvate road between precincts 13 and 16 to more closely approximate the census block boundary. Tom O'Neill, Commissioner of Elections for Dubuque County, concurs with the changes requested by the state. Also, based on input from Ms. Steinbach, Mr. O'Neill has asked that the City incorporate the Old Highway Road/Fairgrounds area into Precinct 5 as an extraterritorial area. Mr. O'Neill stated that after review of the ward and precinct boundaries for Dubuque County, state officials determined that the Old Highway Road/Fairgrounds portion of County Precinct 33 transcends a legislative district boundary line. State redistricting regulations prohibit delineating precincts that cross legislative boundary lines. Precinct 5 already contains some extraterritorial area and 114 County residents. The population of the Old Highway Road/Fairgrounds area is 104 residents. The newly expanded Precinct 5 would have 2,861 residers, which complies with population requirements. The polling place for Precinct 5 will not be affected by the requested change. The changes recommended to Precinct 5 include: 1) Redrawing the official ward and precinct map to incorporate this area. Changing the extraterritorial population total for Precinct 5 to reflect incorporation of the new area. The changes listed above have been made to the metes and bounds description of the ordinance and the official ward and precinct map. A new extraterritorial precinct agreement has also been drafted and, if the amended map and ordinance are approved, should be signed by the Mayor and the Chairman of the Board of Supervisors. I recommend that the Mayor and City Council adopt the revised ordinance and map with the changes requested by the State of Iowa and Dubuque County. Chapter 17 of the City of Dubuque Code of Ordinances is hereby repealed. Section 2. A new Chapter 17 of the City of Dubuque Code of Ordinances, attached hereto and incorporated herein, is hereby adopted. Section 3. This ordinance shall take effect January 15, 2002. For the purposes of this chapter, unless the context otherwise requires, the following definitions and rules of construction shall be applied. Points of the compass are approximate unless otherwise stated. All names, boundaries, lines, features and fixtures, are to be construed as they existed on the effective date of this chapter. Annexed territory means territory annexed to the City after the effective date of this chapter. City includes all territory within the corporate limits and all annexed territories. Commissioner of elections means the county auditor of Dubuque County. Corporate limits means the corporate limits of the city on the effective date of this chapter. Peosta Channel means the waterway between the major portions of the City of Dubuque and the island known as Chaplain Schmitt Island. Street or similar language means the centeriine of the right-of-way, and a straight extension of that centerline. Section 17-2. Correction of errors. (a) Correction of errors. If this chapter fails to place any part of the city within a precinct or ward established by this chapter, the commissioner of elections shall assign the omitted area to an adjacent precinct or ward within the same legislative district. If this chapter places any part of the city in more than one precinct or ward established by this chapter, the commissioner of elections shall assign that territory to an adjacent precinct or ward within the proper legislative district, The commissioner of elections may also correct obvious clerical errors in this chapter. (b) Annexation of territory. When territory is annexed to the city, the city council may attach all or any part of the annexed territory to any established precinct or precincts, which are contiguous to the annexed territory; however, this subsection shall not prohibit establishment of one or more new precincts in the annexed territory. Section 17-3- 17-15 Reserved. ARTICLE II. PRECINCTS Section 17-16. City divided into twenty-one precincts. The city hereby is divided into twenty-one (21) precincts as described in this article. Section 17-17. First precinct. PRECINCT AGREEMENT between Dubuque County and the City of Dubuque This Precinct Agreement supplants the agreement previously agreed upon on August 20, 2001 by the Dubuque County Board of Supervisors and the Dubuque City Council. Residents of Dubuque Township within Legislative House District 28, south and west of the corporate limits of the City of Dubuque will vote in Precinct 5, with the exception of municipal elections.
