Van Milligen, City Manager Acceptance of Public Improvements - Oak Meadow Second Addition, Phase 3 (Deerwood Circle) Public Works Director Mike Koch is recommending acceptance of the public improvements that Jim Stock Realty & Construction has recently completed in the Oak Meadow Second Addition - Phase 3 (Deerwood Circle), and that maintenance of said improvements be the responsibility of Jim Stock Realty & Construction for two years from the date of acceptance. I concur with the recommendation and respectfully request Mayor and City Council approval. Koch, Public Works Director Acceptance of Public Improvements - Oak Meadow Second Addition, Phase 3 (Deerwood Circle) INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements that the developer, Jim Stock Realty & Construction, has recently completed in Oak Meadow Second Addition - Phase 3 (Deerwood Circle). BACKGROUND As a condition of subdivision plat approval through Resolution No. 87-01, the developer of Oak Meadow Second Addition - Phase 3 (Deerwood Circle) was required to install certain public improvements including sanitary sewer and watermain, and to dedicate the improvements to the City upon completion. The developer of Oak Meadow Second Addition - Phase 3 (Deerwood Circle) has recently completed the sanitary sewer and watermain and has formally requested the City's acceptance of the public improvements which have been installed. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On July 22, 2001, Jim Stock Realty & Construction requested City's acceptance of the public improvements in Oak Meadow Second Addition - Phase 3 (Deerwood Circle). The sanitary sewer and watermain are the only public improvements in this development. The storm sewers and street are to remain private. Upon inspection by the City, it has been determined that all of the public improvements required by Resolution No. 87-01 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION I would, therefore, recommend that the City Council accept the public improvements. Maintenance of said improvements shall be the responsibility of the contractor and owner, Jim Stock Realty & Construction, for a period of two years from the date of acceptance by the City Council. Koch, Public Works Director Address: 50 W. 13th Street, Dubuque, IA 52001-4864 RESOLUTION NO. 511-01 ACCEPTING IMPROVEMENTS IN OAK MEADOW SECOND ADDITION - PHASE 3 (DEERWOOD CIRCLE) Whereas, pursuant to Resolution No. 87-01, certain public improvements including sanitary sewer and watermain were installed by the developer of Oak Meadow Second Addition - Phase 3 (Deerwood Circle). Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said sanitary sewer and watermain improvements in Oak Meadow Second Addition - Phase 3 (Deerwood Circle) be and the same is hereby accepted. Section 2. That all sanitary sewer and watermain fixtures shall be adjusted to final grade by the contractor and/or owner when the street paving is placed and backfilled. Section 3. That maintenance of said public improvements shall be the responsibility of the contractor and the owner for a period of two years from this date. As per paragraph (c) Sec. 42-24 "Sec. 42-24. Improvement guarantees. (c) Inspection: Upon completion of all required improvements, the owner shall notify the City Engineer, in writing, of the completion of improvements, and shall send a copy to the City Planner. The City Engineer shall inspect all improvements of which such notice has been given and shall file a detailed report, in writing, with the City Manager and property owner, indicating either approval or rejection of such improvements with a statement of reasons for any rejection."
