City Council Proceedings October 2001Regular Session, October 1, 2001 323 DUBUQUE CITY COUNCIL OFFICIAL PROCEEDINGS City Council, Regular Session, October 1, 2001 Council met in Regular Session at 6:30 P.M. in the Library Auditorium Present: Mayor Duggan, Council Members Buol, Cline, Markham, Michalski, Nicholson, Robbins, City Manager Michael Van Milligen, Corporation Counsel Barry Lindahl. Mayor Duggan read the call and stated this is the regular session of the City Council called for the purpose of acting upon such business which may properly come before the City Council. Invocation was given by Reverend Terry Simm, Pastor, First Presbyterian Church. PROCLAMATIONS: Domestic Violence Awareness Month (October) received by Lisa McCarthy; Crop Walk Day in Dubuque (October 7, 2001); Trick or Treat Night (October 31, 2001). CONSENT ITEMS Minutes Submitted: Airport Commission of 10/13; City Council of 9/4 and 9/17; Community Development Advisory Commission of 9/20; Five Flags Commission of 9/17; Housing Code Appeal Board of 8/21 and 9/18; Human Rights of 8/13; Library Board of 7/26; Long Range Planning Advisory Commission of 8/15; Mechanical Board of 9/12, presented and read. Fincel that a portion of his property which was involuntarily annexed to the City of Dubuque in 1979 be detached from the City, presented and read. Wilbricht Lane Storm Sewer - Acceptance: City Manager recommending acceptance of the Wilbricht Lane Storm Sewer Reconstruction Project in the final contract amount of $21,489.80, presented and read. Michalski moved that the communication be received and filed. Seconded by Nicholson. Motion carried 7- 0. RESOLUTION NO. 424-01 ACCEPTING IMPROVEMENT Whereas, the contract for the Wilbricht Lane Storm Sewer Improvements Project has been completed and the City Manager has examined the work and filed his certificate stating that the same has been completed according to the terms of the contract, plans and specifications and recommends its acceptance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said improvement be and the same is hereby accepted. BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby directed to pay to the contractor from the Fiscal Year 2001 General Fund in amount equal to the amount of 324 Regular Session, October 1, 2001 this contract, less any retained percentage provided for therein. RESOLUTION NO. 425-01 FINAL ESTIMATE Whereas, the contract for the Wilbricht Lane Storm Sewer Improvements Project has been completed and the City Engineer has submitted his final estimate showing the cost thereof including the cost of estimates, notices and inspection and all miscellaneous costs; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the cost of said improvement is hereby determined to be $21,489.80 and the said amount shall be paid from the Fiscal Year 2001 General Fund of the City of Dubuque, Iowa. RESOLUTION NO. 426-01 A RESOLUTION ACCEPTING A CONVEY- ANCE OF PROPERTY--A PART OF LOT 2-1- 1-1-1-1-2-1-4 OF MINERAL LOT 501 IN THE CITY OF DUBUQUE--ON MANSON ROAD TO THE CITY OF DUBUQUE Whereas, the City of Dubuque entered into an Acquisition Agreement with Rodney J. Krapfl and Mary Jane Krapfl, pursuant to which Rodney J. Krapfl and Mary Jane Krapfl, agreed to convey a part of Lot 2-1-1-1-1-1-2-1-4 of Mineral Lot 501 in the City of Dubuque, Iowa, as shown on the Acquisition Plat thereof; and Whereas, Rodney J. Krapfl and Mary Jane Krapfl, have executed a conveyance of said property. NOW, THEREFORE, BE IT RESOLVED B THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of, accepts and consents to the Warranty Deed from Rodney J. Krapfl and Mary Jane Krapfl, copies of which are attached hereto, as required by Iowa Code Section 569.7. Section 2. The Mayor is hereby authorized and directed to execute and acknowledge on behalf of the City of Dubuque any instruments in connection herewith. RESOLUTION NO. 427-01 A RESOLUTION ACCEPTING A CONVEY- ANCE OF PROPERTY (LOT A OF LOT 1 OF LOT 2 OF LOT 27, SECTION 2, T89N, R2E, 5TM P.M., DUBUQUE COUNTY, IOWA) TO THE CITY OF DUBUQUE FOR TANZANITE DRIVE EXTENSION Whereas, the City of Dubuque entered into an Acquisition Agreement with Harry J. and Mary E. Althaus, pursuant to which Harry J. and Mary E. Althaus agreed to convey Lot A of Lot 1 of Lot 2 of Lot 27, Section 2, T89N, R2E, 5th P.M., Dubuque County, Iowa, as shown on the Acquisition Plat thereof; and Whereas, Harry J. and Mary E. Althaus have executed a conveyance of said property. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of, accepts and consents to the Warranty Deed from H&M Realty, L.C., copies of which are attached hereto, as required by Iowa Code Section 569.7. Woodward Place - Plat of Survey: City Manager recommending approval of the plat of survey of Woodward Place to expand an off- street parking lot for use by Woodward Communication, Inc. employees and the Dubuque Museum of Art at the northeast corner of Bluff Street and 7th Street, presented and read. Michalski moved that the communication be received and filed. Seconded by Nicholson. Motion carried 7-0. RESOLUTION NO. 429-01 A RESOLUTION APPROVING THE PLAT OF SURVEY OF WOODWARD PLACE IN THE CITY OF DUBUQUE, IOWA. Whereas, there has been filed with the City Clerk a plat of survey of Woodward Place in the City of Dubuque; and Whereas, upon said plat of survey appears a lot to be known as Lot 2 Woodward Place, which the owners by said plat of survey have dedicated to the public forever; and Whereas, said plat of survey has been reviewed by the City Planner and had her approval endorsed hereon; and Whereas, said plat of survey has been examined by the City Council and they find that it conforms to the statutes and ordinances relating hereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the dedication of Lot 2 Woodward Place as it appears on said final plat, be and the same are hereby accepted; and, Section 2. That the plat of survey of Woodward Place is hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon said survey plat. America's River Project - Boating Infrastructure Grant: City Manager recommending approval of a grant application to the Iowa Department of Natural Resources (IDNR) for Federal Boating Infrastructure Funds for dredging and construction of transient boat docks in the Ice Harbor and construction of a riverfront boat pier as part of the America's River project, presented and read. Michalski moved that the communication be received and filed. Seconded by Nicholson. Motion carried 7-0. RESOLUTION NO. 430-01 RESOLUTION AUTHORIZING A GRANT APPLICATION TO THE IOWA DEPARTMENT OF NATURAL RESOURCES FOR FEDERAL BOATING INFRASTRUCTURE FUNDS FOR THE AMERICA'S RIVER PROJECT Whereas, the Iowa Department of Natural Resources (IDNR) has Federal Boating Infrastructure funds available to develop transient boat docks for nontrailerable vessels; and Whereas, the City of Dubuque has adopted a Comprehensive Plan and a Riverfront Plan that include goals for development of transient boat docks; and Whereas, the City of Dubuque has approved the America's River project that includes the development of transient boat docks in the Ice Harbor and on the Mississippi River. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the Assistant City Manager is hereby authorized to submit an application for Federal Boating Infrastructure funds to the IDNR for development of transient boat docks in the Ice Harbor and on the Mississippi River. Section 2. That the City of Dubuque agrees to maintain the transient boat docks used in accordance with the Federal Boating Infrastructure Grant Program. Heritage Trail Extension - Grant Application: City Manager recommending approval of a grant application to the Iowa Department of Transportation (IDOT) for Statewide Transportation Enhancement Funds for the extension of Heritage Trail from Heron Pond to the Dubuque Jaycees Trail, presented and read. RESOLUTION NO. 431-01 RESOLUTION AUTHORIZING A GRANT APPLICATION FOR IOWA DEPARTMENT OF TRANSPORTATION STATEWIDE TRANS- PORTATION ENHANCEMENT FUNDS FOR THE HERITAGE TRAIL EXTENSION FROM THE HERON POND WETLANDS NATURE TRAIL TO THE DUBUQUE JAYCEES TRAIL Whereas, the Iowa Department of Transportation (IDOT) has Statewide Transportation Enhancement Funds available to develop recreational trails in cities; and Whereas, the City of Dubuque has adopted a Comprehensive Plan and a Riverfront Plan that include goals for development of bike/hike trails; and Whereas, the City of Dubuque has adopted the Heritage Trail Master Plan that includes the Heritage Trail Extension. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the Planning Services Manager is hereby authorized to sign and submit this application for Statewide Transportation Enhancement Funds to the IDOT for the extension of Heritage Trail from the Heron Pond Wetlands Nature Trail to the Dubuque Jaycees Trail, on behalf of the City of Dubuque. Section 2. That the City of Dubuque agrees to adequately maintain the trail for its intended use and maintain the total trail used to justify the project in public use for a minimum of 20 years following project completion. Section 3. That the City Manager is hereby authorized to reallocate $100,000 from the FY02 Capital Improvement Program from the Highway 20 Landscaping project to serve as the local match for this grant. RESOLUTION NO. 432-01 RESOLUTION AUTHORIZING A GRANT APPLICATION TO THE IOWA DEPARTMENT OF TRANSPORTATION FOR FEDERAL RECREATIONAL TRAILS FUNDS FOR THE RIPROW VALLEY TRAIL HEAD ACQUISITION Whereas, the Iowa Department of Transportation (IDOT) has Federal Recreational Trails funds available to develop recreational trails in cities; and Whereas, the City of Dubuque has adopted a Comprehensive Plan and a Riverfront Plan that include goals for development of bike/hike trails; and Whereas, the City of Dubuque has adopted the Heritage Trail Master Plan that includes the Heritage Trail Extension to the Riprow Valley. RESOLUTION NO. 435-01 ACCEPTING IMPROVEMENT WHEREAS, the contract for the LANDSCAPING OF THE DUBUQUE INDUSTRIAL CENTER WEST PROJECT has been completed and the City Manager has examined the work and filed his certificate stating that the same has been completed according to the terms of the contract, plans and specifications and recommends its acceptance. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Dubuque, Iowa, that the recommendation of the City Manager be approved and that said improvement be and the same is hereby accepted. Depot Restoration Project: City Manager recommending that the City support the Dubuque County Historical Society's grant application to the State Historical Society of Iowa for the depot restoration project, presented and read. Human Rights Commission -Application for HUD Contract Funds: City Manager recommending approval of the Human Rights Commission application to the U.S. Department 328 Regular Session, October 1, 2001 of Housing and Urban Development (HUD) for contract funds for various proposed projects, presented and read. Michalski moved that the communication be received and filed and recommendation approved. Seconded by Nicholson. Motion carried 7-0. United Rentals Site - Restrictive Covenant: Corporation Counsel recommending execution of a Declaration of Restrictive Covenants on behalf of the City for the United Rentals property located at 301 Iowa Street, presented and read. Manson Road Bridge Reconstruction Project: Corporation Counsel recommending that the City issue a check to the Dubuque County Sheriff in the amount of $4,650 to complete the acquisition of property for the Manson Road Bridge Reconstruction Project, presented and read. Supplement No. 51 to the Code of Ordinances: City Manager recommending adoption of Supplement No. 51 to the City of Dubuque Code of Ordinances, presented and read. RESOLUTION NO. 437-01 ADOPTING SUPPLEMENT NO. 51 TO THE CODE OF ORDINANCES OF THE CITY OF DUBUQUE, IOWA Whereas, under date of July 17, 1989, the City Council,, pursuant to Ordinance No. 34-89, readopted the Code of Ordinances of the City of Dubuque, Iowa for ordinances adopted up to and including December 19, 1988; and Whereas, since December 19, 1988 the City Council of the City of Dubuque, Iowa has adopted certain ordinances amending the Code of Ordinances and said amendments have been printed as supplements to the Code of Ordinances; and Whereas, Section 380.8 of the Code of Ordinances provides that supplements by resolution, become part of the Code of Ordinances. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Supplement No. 51 of the Code of Ordinances of the City of Dubuque, Iowa, covering Ordinances through Ordinance No. 42-01 enacted through June 18, 2001 and prepared by the Sterling Codifiers, Inc, Coeur D Alene, ID hereto filed in the Office of the City Clerk of the City of Dubuque, Iowa be and is hereby adopted and becomes part of the Code of Ordinances of the City of Dubuque, Iowa. (5) Neutered: Shall refer to a surgical procedure that has been performed on a dog or a cat that renders it incapable of siring or bearing offspring. (6) At large: Includes any dog, cat or livestock, fowl or ferret found off the premises of the owner. A dog or cat shall not be deemed at large if the dog or cat is: a. Attached to a leash of sufficient strength and appropriate length to control the animal where such leash is held by its owner or keeper; or b. Restrained within an enclosed motor vehicle or by a crate or leash of sufficient strength and appropriate length to keep the dog or cat within the motor vehicle; or c. Housed in a licensed veterinarian's animal hospital; or d. Accompanied by the owner or keeper on the premises of another with such person's consent and restrained by an adequate protective fence or by leash, cord, chain or other similar restraint that does not allow the dog or cat to go beyond such person's property line or to come into contact with anyone outside such person's property line. (7) Kennel: Shall refer to a place or establishment where dogs or cats are kept or raised for the purpose of breeding, boarding, racing at a licensed pari-mutuel track, exchanged or offered for sale to the general public and which are kept under constant restraint. (8) Nuisance: A dog or cat shall be considered a nuisance if it: a. Damages, soils, defiles or defecates on private property other than the owner's or on public walks and recreation areas unless such waste is immediately removed and properly disposed of by the owner. b. Causes unsanitary, dangerous or offensive conditions. c. Causes a disturbance by excessive barking or other noise-making or chases vehicles, or molests, attacks or interferes with persons or other domestic animals on public property. (9) Vicious animal: A vicious cat or dog is deemed so when it shall have attacked or bitten any person on more than one occasion without provocation or when an attack or bite results in serious bodily injury. (c) Sec. 7-18 is amended to read as follows: Sec. 7-18. Nuisance: It shall be unlawful for any owner or keeper to permit a dog or cat to commit a nuisance. (d) Sec. 7-19 is amended to read as follows: Sec. 7-19. Female Dogs In Season: It shall be unlawful for any owner or keeper to allow a female dog in season to run at large or to so confine such dog as to attract male dogs to the area and by their presence cause a nuisance. (e) Sec. 7-23 is amended to read as follows: Sec. 7-23. Redemption: (a) Except as otherwise provided, the owner may redeem a licensed dog or cat seized or impounded pursuant to this Article by paying the sum of twenty-five dollars ($25.00) plus the separate daily fee for keeping such dog or cat each day or fraction thereof during the time that such dog or cat is impounded. Upon the second subsequent impoundment of the same animal within three hundred sixty five (365) days, an impoundment charge of thirty-five dollars ($35.00) shall be assessed, plus the separate daily fee for keeping such dog or cat each day or fraction thereof during the time which said dog or cat is impounded. 334 Regular Session, October 1, 2001 (b) Upon proper identification the owner may redeem an unlicensed dog or cat seized or impounded pursuant to this Article only after paying the license fee in addition to the charges required by paragraph (a). Use of Dog in Illegal Activity Prohibited: No person shall keep, maintain, control or retain custody of any dog in conjunction with, or for the purpose, whether in whole or in part, of aiding, abetting or conducting illegal activity or committing any crime. (j) The following new section is hereby adopted: Sec. 7-28.10. No person shall keep a dog or cat in the city of Dubuque unless such dog or cat is licensed by the City as provided in this Article. This section shall not apply to veterinary clinics and boarding facilities. (k) Sec. 7-32 is amended to read as follows: Sec. 7-32. Application: The owner shall make application for a license at the office of the City Clerk. The forms shall give the name, address, and social security number of the owner, the sex and description of the dog or cat, and if known, its breed and age. In the event of a change of ownership, the license holder shall notify the City Clerk of such change. All dogs and cats must be licensed at three (3) months of age. (I) Sec. 7-33 is amended to read as follows: Sec. 7-33. Dogs-License Fee: (a) The license fee per calendar year, or fraction thereof, for a dog license shall be eight dollars ($8.00) for each neutered dog and eighteen dollars ($18.00) for each dog not neutered. (b) The applicant or licensee shall furnish written proof from a licensed veterinarian that surgical procedures have been performed that render either male or female dogs incapable of reproduction. (m) Sec. 7-35 is amended to read as follows: Sec. 7-35. Cats-License Fee: (a) The license fee per calendar year, or fraction thereof, shall be eight dollars ($8.00) for each neutered cat, either male or female, and eighteen dollars ($18.00) for each male or female cat not neutered. (b) The applicant or licensee shall furnish written proof from a licensed veterinarian that surgical procedures have been performed that render either male or female cats incapable of reproduction. (n) The following new article is hereby adopted: ARTICLE IV. POTENTIALLY VICIOUS DOGS. Sec. 7-82. Potentially Vicious Dog. A potentially vicious dog is a dog that: (1) When unprovoked, on two separate occasions, has engaged in any behavior that has required a defensive action by any person to prevent bodily injury when the person and dog were off of the property of the owner or keeper of the dog; (2) When unprovoked, has attacked or bitten a person; (3) When unprovoked, has inflicted a serious injury or caused the death of a domestic animal, either on public or private property other than the property of the owner or keeper; or (4) When unprovoked, chases or approaches a person or domestic animal upon the streets, sidewalks, or any public or private property other than the property of the owner or keeper, in a menacing fashion or apparent attitude of attack. Sec. 7-83. Procedure For Declaration Of Potentially Vicious Dog. (a) The Health Services Officer may find and declare an animal potentially vicious based upon the following: (1) The written complaint of a citizen that the animal has acted in a manner set forth in Sec. 7- 82; (2) Dog bite reports filed with the Health Services Department; (3) Actions of the dog witnessed by any animal control officer or law enforcement officer; or (4) Other substantial evidence. (b) The declaration of a potentially vicious dog shall be in writing and shall be served on the owner in one of the following methods: personally, by certified mail to the owner at the owner's last known address, or if the owner Regular Session, October 1, 2001 335 cannot be served personally or by mail, by publication in a newspaper of general circulation in the county. (c) The declaration shall state: (1) The description of the animal; (2) The name and address of the owner of the animal, if known; (3) The whereabouts of the animal, if not in the custody of the owner; (4) The facts upon which the declaration of potentially vicious dog is based; (5) The owner's right to a hearing if the person objects to the declaration; (6) The restrictions placed upon the animal as a result of the declaration of potentially vicious dog; and (7) The penalties for a violation of such restrictions. (d) The owner may object to the declaration of potentially vicious dog by requesting a hearing before the Health Services Officer by submitting a written request to the Health Services Officer within ten (10) days of the date of mailing of the declaration, or within ten (10) days of the publication of the declaration. (1) If the Health Services Officer finds that there is insufficient evidence to support the declaration, it shall be rescinded, and the restrictions imposed thereby annulled. (2) If the Health Services Officer finds sufficient evidence to support the declaration, the Health Services Officer shall provide the owner with written notice of such determination within five (5) working days after the hearing. (3) Prior to the hearing, the owner shall confine the dog in a fenced enclosure on the owner's premises. It shall be unlawful for the owner of the potentially vicious dog to allow or permit such dog to go beyond the premises of the owner unless such dog is securely leashed and humanely muzzled or otherwise securely restrained. (4) If it is determined by the animal control officer or law enforcement officer that probably cause exists to believe the dog in question poses an immediate threat to public safety, then the animal control officer or law enforcement officer may seize and impound the dog pending the hearing to be held pursuant to this article. The owner or keeper of the dog shall be liable to the city or county where the dog is impounded for the costs and expenses of keeping the dog if the dog is later determined to be potentially vicious. When a dog has been impounded and it is not contrary to public safety, the animal control officer shall permit the animal to be confined at the owner's expense in a Health Services Department approved kennel or veterinary facility. Sec. 7-84. Notification Of Status Of Potentially Vicious Dog. The owner shall immediately notify the Health Services Department when a dog which has been classified as potentially vicious: (1) Is loose or unconfined; (2) Has bitten a human being or attacked another animal; (3) Is sold or given away, or dies; or (4) Is moved to another address. Prior to a potentially vicious dog being sold or given away, the owner shall provide the name, address and telephone number of the new owner to the Health Services Department. The new owner shall comply with all the requirements of this Chapter. Sec. 7-85. Exceptions To Classification. (a) No dog may be declared potentially vicious if: (1) Any injury or damage was sustained by a person who, at the time of the injury or damage was sustained, was committing a willful trespass or other tort upon, premises occupied by the owner or keeper of the dog, or was teasing, tormenting, abusing, or assaulting the dog, or was committing or attempting to commit a crime; (2) The dog was protecting or defending a person within the immediate vicinity of the dog from an unjustified attack or assault; or (3) The injury or damage was sustained by a person or a domestic animal, which at the time of the injury or damage was sustained, was teasing, tormenting, abusing or assaulting the dog. (b) No dog may be declared potentially vicious if the injury or damage to a domestic animal was sustained while the dog was working as a hunting dog, herding dog or predator control dog on the property of, or under the control of, its owner or keeper, and the damage or injury was to a species or type of domestic animal appropriate to the work of the dog. Sec. 7-86. Disposition Of Potentially Vicious Dog. (a) A potentially vicious dog shall be properly licensed and vaccinated. The potentially vicious designation shall be included in the registration records of the dog. The City may charge a potentially vicious dog fee in addition to the regular licensing fee to provide for the increased costs of maintaining the records of the dog. (b) A potentially vicious dog, while on the owner's property, shall at all times be kept indoors or in a securely fenced yard from which the dog cannot escape and into which children cannot trespass. A potentially vicious animal may be off the owner's premises only if restrained by a substantial leash, of appropriate length, and if the dog is under the control of a responsible adult and is humanely muzzled. (c) If a potentially vicious dog dies, or is sold, transferred or permanently removed from the city, the owner of dog shall notify the Health Services Department of the changed condition 336 Regular Session, October 1, 2001 and new location of the dog in writing within two (2) working days. NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA, AS FOLLOWS: Section 1. City of Dubuque Code of Ordinances is hereby amended by adopting the following new Sections: Sec. 33-23. Permit Required for Events on Private Property. No person shall hold an event on private property when the person knows or reasonably should know that the event will substantially affect public health or safety or the peace and quiet of a neighborhood by reason of the number of persons attending such event, the use of outdoor music or amplified noise, and the likely effect on traffic and parking, without first obtaining a permit from the City Manager, which permit, when issued, shall be without charge, and shall state the time, manner and conditions of such event. This Section shall not apply to an event held by a church or educational institution. Regular Session, October 1, 2001 337 Sec. 33-24. Permit Application. (a) An application for a permit containing the information required herein shall be filed with the City Manager by a person holding such an event. Applications shall be made on forms prepared by the City Manager, and shall contain the information required herein. The City Manager shall have a reasonable time to grant or deny the permit. The length of time that is reasonable shall be determined by the type of use requested; the information supplied; the time of filing of the application; and the extent of advance preparation or planning demonstrated and reasonably required. (b) The City Manager shall grant or deny the permit, in writing, according to the standards set forth in Section 33-25 of this Chapter and shall provide the written decision to the applicant by regular mail or personal delivery. Sec. 33-25. Application Form. The application form for the event shall contain the following information: (1) Name and address of the applicant and the sponsoring organization, if any. (2) The type of event that is planned. (3) Proposed location or locations. (4) Expected size of group. (5) Date, time and expected length of use. (6) Names and addresses of the person or persons to be in charge of the proposed use at the specified location. (7) Names and addresses of any persons to be featured as entertainers or speakers. (8) List of mechanical or electronic equipment to be used. (9) Number and type of any motor vehicles or other forms of transportation to be used, including bicycles. (10) Number and type of any animals to be used. (11 ) A description of any sound amplification to be used. Sec. 33-26. Standards for Issuance. The City Manager shall examine the application and shall grant or deny said permit based upon the following standards: (1) In light of the date and time of said proposed use, whether the use will unreasonably interfere with the privacy, safety, security, convenience and tranquility of the residents or inhabitants of the area. (2) Whether the proposed use or activity is compatible with the normal activity of the neighborhood at the requested time and date. (3) Whether the application demonstrates the applicant has the means, planning and coordination to hold the proposed event, considering the time of day, location, traffic control, parking requirements and any monitoring required to protect the public health and safety. (4) Whether the event will interfere with another event for which a permit has already been granted. (5) Whether the proposed use would substantially interrupt the flow of street and/or pedestrian traffic. (6) Whether the use would require the excessive diversion of police from other duties or substantially interfere with the City's firefighting operations. Sec. 33-27. Revocation. After a permit is granted, in the event it is determined that the applicant has misstated any material fact in the application, or that there is a substantial and material variance between the information in the application and the actual facts or those facts that appear reasonably to have occurred, the City Manager may review such application and revoke such permit if not in compliance with this Article. Such permit may also be revoked when it is determined by the Chief of Police that by reason of disaster, public calamity, riot or other emergency, the public safety requires such revocation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Appendix A of the Zoning Ordinance of the City of Dubuque Code of Ordinances is hereby amended by reclassifying the hereinafter described property as shown in Exhibit A, and to the center line of the adjoining public right-of-way, all in the City of Dubuque, Iowa, from R-1 Single-Family Residential District to R-2 Two-Family Residential District. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. BIES SUBDIVISION, DUBUQUE, IOWA Whereas, pursuant to resolution and published notice of time and place of hearing, published in the Telegraph Herald, a newspaper of general circulation published in the City of Dubuque, Iowa on the 21st day of September, 2001, the City Council of the City of Dubuque, Iowa met on the 1st and 15th day of October, 2001, at 6:30 p.m. in the Public Library Auditorium, 11th and Locust, Dubuque, Dubuque, County, Iowa to consider the proposal for the sale of real estate described as: Lot 4A of Block 3 C.J. Bies Subdivision and Lot 5A of Block 3 C.J. Bies Subdivision in the City of Dubuque, Dubuque County, Iowa Whereas, the City Council of the City of Dubuque, Iowa overruled any and all objections, oral or written to the proposal to sell such real estate, except for easement as noted. That the sale of City of Dubuque real property described as Lot 5A of Block 3 C.J. Bies Subdivision in the City of Dubuque, Iowa to Pamela A. Triolo, Roger G. Klauer, and Kathleen M. Sullivan be and the same is hereby approved for the sum of $18,553.00, plus the cost of publication, platting, and filing fees. Conveyance shall be by Quit Claim Deed. Section 3. The City of Dubuque reserves unto itself a perpetual easement including the right of ingress and egress thereto, for the purpose of erecting, installing, construction, reconstructing, repairing, owning, operating, and maintaining water, sewer, drainage, gas, telephone, t.v. cable, and electric lines as may be authorized by the City of Dubuque, Iowa, as shown in the Plat of Survey of Lot 4A and Lot 5A of Block 3 C.J. Bies Subdivision. Section 4. That the Mayor be authorized and directed to execute a Quit Claim Deed, and the Regular Session, October 15, 2001 355 City Clerk be and is hereby authorized and directed to deliver said deeds of conveyance to Pamela A. Yiannias requesting to address the City Council regarding his request to vacate Congress Circle, presented and read. Nicholson moved that the communication be received and filed. Seconded by Robbins. Motion carried 7-0 Mr. Yiannis spoke requesting a fair deal as to the sale price of the property. Direction was given to work with Staff and complete an appraisal of the property. COUNCIL MEMBER REPORTS Duggan invited concerned community citizens to a meeting hosted by Dubuque365 on Saturday, 10/20/01, from 9:00 to 11:00 A.M. at Irving School where Dubuque community efforts for assistance in the 9/11/01 tragedies will be discussed and considered. Markham stated he is going to Washington DC soon and will talk to the Legislators, and also that Airport officials are arranging a meeting in February with Legislators in the near future. At 7:55 P.M. Buol moved to go into Closed Session: Collective Bargaining Strategy- Iowa Code Chapter 20.17(3). Seconded by Michalski. Motion carried 7-0. At 8:01 Council reconvened Regular Session stating that staff had been given proper direction. There being no further business, Buol moved to adjourn. Seconded by Michalski. Motion carried 7-0.
