sive covering activities since he
has taken over as Health Director,

hope of better health in our com-
munity. The average health cost
per capita as known by the U. S.
Public Health Service is $3.00,
compared to a Dubuque cost of
$1.30 per capita.

WHEREAS, the Health Director
has reported to the Board of
Health that the buildings and
premises located on the north 50
feet of Lot 1, Quigley's Subdivi-
sion of City Lot 712, owned by
Hazel Clark and known as 1749
Catherine Street in the City of
Dubuque, Dubuque County, Iowa,
are dangerous to life and health
because of their condition and
that demand has been made by
him upon Hazel Clark as owner of
said property that the condition
complained of be corrected and
that said owner has failed to cor-
rect the conditions within the time
provided; and
WHEREAS, on November 2, 1964
the Board of Health in regular
session at 7:30 o'clock P.M. in the
City Council Chamber in the City
Hall in the City of Dubuque, Du.
buque County, Iowa, did condemn
as unfit for human habitation the
structure at 1749 Catherine Street;
and
WHEREAS, a notice of the Ac-
tion of the Board of Health and
an order to vacate the premises at
1749 Catherine Street was sent to

by Certified Mail on November 19,

Fire Chief Dunphy addressed
the Council by staling that a
barge can be obtained and a large
pump mounted thereon to battle
fires from the river. A 750 gallon
per minute capacity pump could
be secured and installed for about
$2700. The need for snch appara-
tus is very apparent when during
the 1965 flood the Fischer ware-
house caught on fire. The build-
ing was surrounded by floodwater
at the time the fire broke out. A
fire fighting barge could also be
used to fight possible fires which
could start in the huge oil storage
tanks and equipment along the
river's edge.

Gentlemen:
On March 29, 1966 the City
Council referred to the Planning
and Zoning Commission, the pe-
tition of Hillcrest Investment Inc.
requesting approval of the final
plat of Picardy Park No. 2 and
the rezoning of same to Multiple
Family residential.

Dr. Link is further petitioning
for business zoning on 1000' of
frontage on the west side of Ken-
nedy Road north of Pennsylvania
Road. The Commission is opposed
to strip commercial zoning on this
major north-south arterial which
is designed to carry the major
share of the future north-south
traffic in the western part of the
city.
On March 24, 1966, Mr. Thomp-
son of Thompson Food Stores ap-
peared before the Commission and
stated that he had leased the
structure on the northeast corner
of the JFK and Pennsylvania
Roads from Dr. Link and had been
assured by Dr. Link that he could
conduct a drive-in business in
conjunction with the food store
operation at this location. Upon
application for a bUilding permit
to alter the structure to permit a
drive-in window, Mr. Bandy in-
formed Mr. Thompson that a
drive-in use was not permitted in
a Local Business "A" zone.
F.ollowing the discussion on
March 24th, the Commission in-
formed Mr. Thompson that it was
opposed to this proposed use at
this corner because a drive-in
would be incompatible in an area
that is developing into several
fine residential neighborhoods.
The Commission feels that a
drive-in destroys the quiet charac.
ter of a residential area and is an
attraction to traffic from a wide
area during late evening hours
and possibly on Sundays.
This letter is an attempt to in-
form the Council of the previous
action of this Commission and to
assure you that the Commission

The Planning and Zoning Com-
mission approved the final plat of
Picardy Park NO.2 on September
9, 1965 and turned it over to the
City Clerk for submission to the
Council. This plat remained in the
City Clerk's files until March 29,
1966 av,'aiting signatures of the
owners and their attorney. The
necessary signatures were ob-
tained on March 29, 1966 and the
Clerk placed the plat on the Coun-
cil agenda..
Please be advised that the Com-
mission has considered the peti-
tion for rezoning this property at
twelve separate meetings since
September, 1959. The petition for
rezoning was denied on each oc-
casion it was voted upon. A letter
from the Commission to the Coun-
cil dated October 28, 1965 advises
the Council of the action taken at
its last hearing on September 23,
1965 when the request was again
denied.
The Commission has considered
the development of this area, in-
cluding the Eagle Supermarket
site, on twenty-four separate oc-
casions since January, 1956.
It is the opinion of this Com-
mission that conditions in the area
have not changed to a sufficient
degree to warrant the zoning of
this property to a high density
residential use. The Commission
further believes that an injustice
is being done to the surrounding
property owners since they have
retained attorneys on eleven sep-
arate occasions to represent them
before the Commission to protest
this rezoning.
The Commission respectfully
requests that the petition for re-
zoning of this area be considered
a closed issue.

BE IT THEREFORE RESOLVED
that the City Council on its own
motion or upon petition of proper-
ty owners, deems it advisable and
necessary for the public welfare
to make the herein mentioned im-
provement, and unless property
owners at the time of the final
consideration of this proposed
resolution have on file with the
City Clerk objections to the
amount of the proposed assess-
ments, they shall be deemed to
have wavied all objections thereto.
Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Council
and are now on file with the City
Clerk, That the cost and expense
of making said improvement will
be assessed upon and against all
privately owned property lying
within assessable distance provided
by law and in an amount not to
exceed the amount provided by
law, property will be assessed
whether the same abuts thereon or
is adjacent thereto according to
area and in proportion to the spec-
ial benefits conferred thereby, and
any deficiency shall be paid out
of the street funds. Bonds shall be
issued and sold in anticipation of
deferred payments of assessments
when a contract has been perform-
ed and accepted and the proceeds
thereof used to pay the contractor.
The railway portion of any street
or assessment district shall be as-
sessed to and paid by the railway
company.
The above resolution was intro-
duced, approved and ordered plac-
ed on file with the City Clerk this
18th day of April, 1966.

vacating a portion of the alley
first north of South Grandview
Avenue from Dillon Street easter-
ly; and
WHEREAS, a portion thereof de-
scribed and platted as Lot 5A and
Lot 42A of Grandview Avenue Ad-
dition was conveyed to Charles T.
Landon as abutting owner subject
to easements for utilities now in
place; .and
WHEREAS, City of Dubuque did
execute Quit Claim Deed and did
deliver the same to Charles T.
Landon; and
WHEREAS, said Quit Claim
Deed has been lost, misplaced or
destroyed; and
WHEREAS, a new Quit Claim
Deed should be executed and de.
livered pursuant to the provisions

A Resolution Approving the Plat
of Glenwood Subdivision
Whereas, there has been filed
with the City Clerk a plat in which
is platted Lots 1 through 25 of
Glenwood Subdivision, by Andrew
J. Richard, as owner thereof, and
said plat has been examined by
the City Planning and Zoning
Commission and approved; and
upon said plat appear streets and
also easements for public utilities
which the owner upon said plat
has dedicated to the public for-
ever; and
Whereas, said plat has been
found by the City Council to con-
form to the Statutes and Ordi-
nances relating thereto, except for
the completion of the improve-
ments of curb and gutter, paving,
sewer and water services, and
sidewalks to be installed in and
along the streets;
Now, Therefore Be It Resolved
by the City Council of the City
of Dubuque, Iowa:
Section 1. That the dedication
of the streets together with the
easements for public utilities, as
the same appear upon said plat,
are hereby accepted.
Section 2. That the plat of the
subdivision of the aforesaid lots,
which will hereafter be known as
Lots 1 through 25, Glenwood Sub.
division, is hereby approved and
the Mayor and the City Clerk are
hereby authorized and directed to
endorse the approval of the City
