Attorney Marshall Thomas ad-
dressed the Council in behalf of
Hillcrest Investment Inc. by stat-
ing that denial of the rezoning of
the Picardy Park No.2 subdivision
is contrary to the view point of
City Planner Clyde Cook. The
Planning & Zoning Commission
have not been consistent in their
denial and opposition to the re-
zoning. Excuses are not reasons
as given by the Planning & Zon-
ing Commission. It is a question
of need and merit. A town house
in this area will not detract from
the values of the surrounding
area.
Attorney Hal Reynolds addressed
the Council representing citizens
opposed to the rezoning stated
that this is the eleventh time and
the fourth consecutive year that
this particular piece of land has
been denied rezoning. A town-
house should not be in the cen-
ter of the tract of land on the
periphery. The developer should be
told not to rezone to multiple clas-
sification.

the petition of Dr. John Link
and others to rezone 1000 feet
of frontage on the west side of
John F. Kennedy Road north of
Pennsylvania Road from single
family residential to Local Busi-
ness "B" be denied on the basis
that strip commercial develop-
ment along this main arterial
street would create traffic haz-
ards; and further, the Commis-
sion is attempting to cluster
commercial uses to serve exist-
ing and future neighborhoods.

the J. F. Kennedy and Pennsyl-
vania Road was actually part of
a shopping center planned in 1959
and taken into the City last year
as a non conforming use. Dr. Link
c- has shown an orderly development
of the area by placing buildings
there as considerable expense. He
requested a ruling from the City
Solicitor as to whether or not the
land has a non-conforming use.

cation was filed by certain inter-
ested property owners objecting
to the action by the Dubuque
Board of Adjustment extending
the business use on certain prop-
erty fronting on University Ave.

I have reviewed the matter with
the pertinent City Officials and I
have learned that the drive-in

the action of the Board of Adjust-
ment as the property in question
was zoned for such use.
It is my understanding that the

tional fifty feet.
In view of the foregoing I find

welfare to make the herein men-
tioned improvement, and unless
property owners at the time of the
final consideration of this proposed
resolution have on file with the
City Clerk objections to the amount
of the proposed assessments, they
shall be deemed to have waived
all objections thereto.
Said improvements shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared there-
fore by the City Engineer which
have been approved by the City
Council and are now on file with
the City Clerk. That the cost and
expense of making said improve-
ment will be assessed upon and
against all privately owned prop-
erty lying withhin assessable dis-
tance provided by law and in an
amount not to exceed the amount
provided by law, property will be
assessed whether the same abuts
thereon or is adjacent thereto ac-
cording to area and in proportion
to the special benefits conferred
thereby, and any deficiency shall
be paid out of the fund. Bonds shall
be issued and sold in anticipation
of deferred payments of assess-
ments when a contract has been
performed and accepted and the
proceeds thereof used to pay the
contractor. The railway portion
of any street or assessment district
shall be assessed to and paid by
the railway company.

motion or upon petition of prop-
erty owners, deems it advisable
and necessar~r for the public wel-
fare to make the herein mentioned
improvement, and unless property
owners at the time of the final
consideration of this proposed res-
olution have on file \vith the City
Clerk objections to the amount of
the proposed assessments, they
shall be deemed to have waived
all objections thereto.
Said improvements shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared there-
fore by the City Engineer which
have been approved by the City
Council and are now on file with
the City Clerk, That the cost and
expense of making said improve-
ment will be assessed upon and
against all privately owned prop-
erty lying within assessable dis-
tance provided by law and in an
amount not to exceed the amount

assessed whether the same abuts

I have made an investigation of
this matter and find that the con-
dition existing thereat was primar-
ily caused by loose gravel accumu-
lating on the sidewalk from the
parking lot abutting thereon and
therefore find no actionable negli-
gence on the part of the City and
recommend denial of said claim,
and respectfully submit that any
claim, if any, she has, said claim-
ant should assert against the
abutting property owner. Original
claim is attached hereto.

tion 19 of Ordinance No. 9-35, per-
mitting a minor to purchase and
consume beer upon a Class B Beer
Permit premises and on March 29,
1966 Mr. Crane entered a plea of
guilty to said charge in the Muni-
cipal Court of Dubuque County,
Iowa, and was fined $50.00 and
costs by the presiding Judge.
NOW THEREFORE BE IT RE.

Be it resolved by the City Coun-
cil of the City of Dubuque, Iowa

WHEREAS, it Is the policy and
intent of the City of Dubuque,
Iowa to maintain and encourage
harmonious relation between Man-
agement and Labor concerning
the construction and building con-
tracts, as well as Public Works
contracts, contracted for by the
City of Dubuque, Iowa with private
contracting firms; and
. WHEREAS, it is the desire of
the City of Dubuque not to in any
way interfere with the present es-
tablished and prevailing wage rates
in the City of Dubuque, Iowa, nor
by its contracting with private
firms to encourage inflationary
measures, nor to in any manner
be a party to the depression of
the standards of living of any em-
ployees in the City of Dubuque,
Iowa;
