On November 1, 1965, Mr. and
Mrs. Kamm of 2395 Rbomberg
Avenue filed claim against the
City of Dubuque in the amount of
$458.59, claiming damages aris-
ing out of the flooding of their
basement by faulty storm sewer.
I have made an investigation of
this matter and referred said claim
to the proper City Agency wbo ad.
vised me on June 29, 1966, that on
the basis of their investigation that
there was no negligence on the
part of the City for the reason that
the condition complained of was
caused from the flood waters of the
Mississippi River.
In view of the foregoing it is the
recommendation of the City At-
torney that said claim be denied.

On June 24, 1966, Mr. Howard
Koch, 856 Harlan Street, Dubuque,
Iowa, filed claim for damages as
a result of flooding of his base-
ment, which allegedly occurred on
June 16, 1966.
I have made an investigation of
this matter and referred Mr. Koch's
claim to the appropriate City ag-
ency who reported back to this
office on June 29, 1966, that their
investigation disclosed there was
no negligence on the part of the

plained and that therefore said
claim was denied by said agency.

The Council authorizes the
Highway Commission to con-
struct and preserve, within the
limits of the right-of-way, such
physical barriers as the High-
way Commission deems neces~
sary to prohibit or eliminate un-
lawful means of access to, or
use of the Highway facility by
pedestrian or veWcular traffic
or for any other purpose
Within sixty (60) days after
completion of the project, the
Iowa State Highway Commis-
sion shall determine, upon the
basis of an engineering and
traffic investigation, the reason-
able and safe speed limits.
Present speed limits will be in
effect until the investigation is
completed and the appropriate
signing is erected.
Upon completion of the pro-
ject, the Council agrees that-
A. Upon receipt from the High-
way Commission of a list of
driveways and entrances
provided for access under
the above improvement,
specified as Project No. FN-
20-9(2)21-31, said list will be
recorded under a supple-
mental ordinance
B. Signing affecting directional
traffic movements will be

Town of DUbuque, Iowa.
WHEREAS, it is proposed to
improve by P.C. concrete widening
to 24 ft. and A.C. resurfacing on
the extension of Primary Road No.
U.S. 20 within the City ITown of
DUbuque, Iowa in accordance with
plans filed in the office of the
Clerk of said City ITown of Du-
buque, Iowa, as follows: on the
eastbound lanes from Sta. 2404 +
07_3 (WCL) easterly to Sta. 2414 +
75.0, identified as Project No. FN-
20-9(2)21-31, and
WHEREAS, the Council has in-
formed itself as to the proposed
improvement and has examined the
plans thereof,
NOW, THEREFORE, be it resolv-
ed by the said Council of Du-
buque, Iowa as follows:
1. The Council hereby approves
the plans for the said project
and consents to the improve-
ment in accordance with the
plans.
2. The Council will take such
legal steps and prosecute to a
conclusion such legal action
and/or proceedings as are now
or may hereafter be required:
A. To prevent the erection of any
signboards:
(1) on public propecty
(2) on private property wben
they obstruct the view of
any portion of the publiC
highway or street or rail-
road track.
Council will notify, by mail, all
abutting property owners of the
parking and access control re-
strictions that are being estab~

gust 26, 1965, the City of Du-
buque, Iowa (herein referred to as
the Local Public Agency) and the
Department of Housing and Urban
Development, United States of
America (herein referred to as the
Government) entered into a cer-
tain contract; and
WHEREAS, pursuant to such
contract the Local Public Agency
is undertaking certain survey and
planning activities necessary for
the carrying out of the Downtown
Urban Renewal Project, Iowa R~15
(herein referred to as the Project);

WHEREAS, the Iowa National
Investment Company (herein re.

declared its intent to acquire a
portion of the cleared land in the
Project area for the purpose of

spection of this building and prem-
ises. This inspection was made
June 20, 1966, and the following is

On June 20, 1966, an inspection
was made of a vacant building at
827 White Street, located on the
south 25' of City Lot 325, owned
by Ida Mundt.
This is a two story frame build.
ing, roll brick siding and roll as-
phalt roofing. The window frames
are rotten, sills and some glass
missing. Chimneys are badly de~
teriorated, porch is rotten, sag-
ging, and parts are missing. Floor
joists are rotten and this floor
sags in all directions. Plaster is
missing and partitions are sagging.
The wiring is old, knob and tube,
and all the fixtures have been
damaged or removed. The plumb-
ing is old and the fixtures do not
operate.
We have padlocked this building
to try and stop trespassing.
The wooden shed at the rear is
dilapidated.
This building is a fire hazard
to the adjoining properties and we
recommend action be taken to
eliminate this undesirable condi-
tion.

Mrs. Ray Nagele of 2461 Central
Avenue stated that she objected
to people going around to get
signers in the neighborhood to
have the idea of rezoning aban-
doned. There is plenty of business
on Central Avenue across the
street from them that is disturb-
ing the peace and quiet of their
homes. Mrs. L. Meyers of 2447
Central AVe. stated that she was
in favor of Multiple Zoning as pro-
posed.

Attorney Dave Setter, as a rep-
resentative of the Herrmann Es-
tate, stated they have eleven ob-
jectors out of a possible seventeen
requesting that the present zoning
remain and this majority should
be considered. Also in this area
are the Fulton Apartments which
were purchased on commercial
property basis. Attorney Richard
Roedell objected to a change in re-
zoning as a representative of the
Walter Strandberg property. Mr.
Roedell was of the opinion that
a change would reduce values of
all properties in the area involved.

On May 18, 1966, an exterior in-
spection was made of a building at
350 Edith Street, located on Lot
121, Belmont Addition, owned by
Hilda Shireman.
Previous inspection of the inter-
ior was made November 19, 1965.
The original building and several
additions are a one-story frame
structure with a stone foundation
and no basement. The building is
not connected to the public sewer
or water supply. The water is
secured from a cistern and the sink
drain is just a pipe to the outside.
The sills are rotten, the siding
is asphalt, and the eaves are miss
ing and rotten.
The side of the structure :' s an
outdoor privy. The wiring is in-
adequate.
The general appearance IS one
of neglect and the general condi-
tions are such that it would be im-
possible to bring this building up
to minimum standards.
Many complaints have been re-
ceived on the condition of this
property.
The owner is a widow approxi-
mate age sixty-seven and the house
was occupied by her and her son
Leland Shireman.
Mrs. Shireman has recently un-
dergone surgery and was living
with a daughter, Mrs. Delbect (Vir.
ginia) Kohn, 2050 Elm Street, but
has moved back to 350 Edith.
This is a definite health hazard
to the whole neighborhood. We
recommend that action be taken
to eliminate this hazard.

requesting action on an old prob-
lem of water pressure for residents
of a section of the Park Hill area
mostly on Fulton and King streets,
presented and read.
Mr. Meyers of 320 King Street
stated that he was forced to put
in a pump to get needed water
which in his estimation is ridicu-
lous in the City. He only has twenty
nine pounds pressure in his base-
ment. Altitude valves were prom-
ised by the Water Department but
were never furnished.
Mayor Pregler moved that Mr.
Meyer's petition be referred to tne
Water Superintendent for investi-
gation and report. Seconded by

cised prior to August 31, 1966 if
funds are available.
(2) That the Library Board of

We can not stress too strongly
our feeling as a Board that the
acquisition by the City of Dubuque
of the optioned property is vital

future growth of the library. There
has been on expansion of the li-
brary building since its erection
in 1902, despite the increase in the
size of the city and the number
of library users. Fortunately the
City Council several years ago pur-
chased the propecty immediately

the interest coupons hereto at-
tached. Both principal and inter-

office of the City Treasurer in the
City of Dubuque, in the State of
Iowa. This bond is issued by the
City of Dubuque under and by vir-
tue of Chapter 396 of the 1954
Code of Iowa, as amended, and the
Resolution of said City duly passed
on the 18th day of July, 1966,

This Bond is one of a series of
11 bonds, 10 for $500.00 numbered
from 162 through 171, and one for
$55.00 numbered 172, all of like
tenor and date, and issued for
the purpose of construction of an
eight inch (8") sanitary sewer
from the Catfish Creek sanitary
sewer northerly through Lot 3 of
Lot 7 inclusive of Moore Heights
Subdivision as described in said
Resolution, in said City, which cost
is payable by the abutting and ad-
jacent property along said im-
provements and is made by law a
lien on all of said property. It is
payable only out of the Special As-
sessment Fund No. 1257 created by
the collection of said special tax,
and said fund can be used for no
other purpose.
It is hereby certified and re-
cited that all the acts, conditions
and things required to be done,
precedent to and in issuing this
series of bonds, have been done,
happened, and performed, in reg-
ular and due form, as required by
law and said Resolution, and for
the assessment, collection and pay-

WHEREAS the City Manager has
submitted a BUDGET ESTIMATE
as provided in Chapter 24 of the
1962 Code of Iowa and the City
Council had been duly considered
and caused to be prepared the bud-
get estimate of expenditures for
the fiscal year beginning January
1, 1967 and ending December 31,
1967, as a basis for the tax levy
for the year 1966, the same to be
collected in the year 1967, and said
budget having been duly approved
by it.

making said improvement shall
be assessed against all privately
owned property lying within the as-

plat in an amount not to exceed
the amount provided by law and in
proportion to the special benefits
conferred thereby and the remaind-
er of the total cost shall be paid
out of the Water Works Deprecia-
tion Fund.
3. Bonds shall be issued and
sold in antiCipation of deferred

contract has been performed and
