On December 26, 1963 original

DUbmeyer and Andrew Dubmeyer,
plaintiffs vs. City of Dubuque,
Iowa, Chester J. Starr, and Perfec-
tion Oil Company, was served on
Gentlemen:
During the past two weeks I
have requested the Building and
Fire Department to try and correct
the deplorable conditions that ex-
ists because of Fire Damage to
the Buildings at 952, 962, 972 and
976 Main Street.
A written report is here by sub-
mitted listing the action taken
during the last few weeks.
The report outlines the difficul-
ties encountered and recommends
certain legal action.
I recommend that due to the
notice not being complied with
that appropriate action be taken
to start condemnation proceedings
and that a public hearing be beld
by tbe City Council and a deter-
mination made. :I will also confer
with tbe City Solicitor to deter-
mine if more direct and positive
action can be taken to correct this
dangerous, unsightly and distaste-
ful condition.

to 651 English Lane has been reo
ferred to the Engineering Depart-
ment by you on May 10, 1965.
I have surveyed and laid out a
grade on this alley. The grade
would make it very difficult to
enter an existing garage built on
the north side of the alley. The
difference in grade from the
north side to the south side of
the platted alley is six (6) feet.
To make a 12 foot wide lane the
slopes would be three (3) feet high
on each side of the alley. The
slopes would be about 1 to 1 mak-
ing maintenance difficult. A wall
sbould actually be built for about
25 feet on each side of the alley.
Due to the steep side slopes, ob.
jections of abutting property own-
ers and existing garage location, I
do not recommend improving the
alley.

WHEREAS, the State of Iowa,
by and through its various agen-
cies, has conducted studies regard-
ing the practice of pricing of salt
by various companies selling same
to State of Iowa and various other
municipalities in the State of
Iowa; and
WHEREAS, as a result of such
studies the State of Iowa by and
through its Highway Commission
intends to institute legal action
against various saIl companies
arising out of their practices in
connection with the pricing of
said salt; and
WHEREAS, it would serve the
best interests of the City of Du-
buque to join with the Iowa State
Highway Commission as a party
plaintiff together with other cities
and towns in the State of Iowa
in an action proposed to be in-
stituted against said salt com-
panies.
NOW THEREFORE BE rr RE-
SOLVED BY THE CITY COUNCIL
OF CITY OF DUBUQUE, IOWA:
Section I. That tbe City of Du-
buque, Iowa, should join with the
Iowa State Highway Commission
and other cities and towns of Iowa
as parties plaintiffs in a proposed
legal action against various salt
companies for damages arising out
of the pricing practices of sald
various salt companies and the
City Manager and the City At.
torney are herewith authorized
and directed to represent the in-
terests of the City of Dubuque
in said litigation and to join there-
in the City of Dubuque as a party
plaintiff and are herewith author-
ized and directed to do any and
all things reasonable and necessary
and incidental in cooperation with
the Iowa State Higbway Commis-
sion and other cities and towns
in the State of Iowa to the end
tbat the best interests of tbe City
of Dubuque be fully asserted and
protected.

For some time now your City
Attorney, together with your City
Manager, have had under study
the matter of pricing practices of
various salt companies who fur-
nish salt to tbe City of Dubuque
as well as to other cities and State
agencies, and your City Attorney
was recently advised by the At-
torney General that his office was
looking into this matter with a
view toward taking some affirma-
tive action.
I have been in communication
with Ray Walton, Chief Counsel
for the Iowa State Highway Com-
mission of the Attorney General's
office and he has advised me that
the Iowa State Highway Commis-
sion intends to file an action in
Minnesota against the various salt
companies arising out of the pric-
ing practices of said companies
and has consented that the City
of Dubuque join the Iowa State
Highway Commission and other
cities and towns of Iowa as one
of the parties plaintiffs.
While it is premature and inad-
visable to give any formal opinion
at this time, it is my considered
judgment that it would serve_ the
best interests of the City that the
City of Dubuque join as a party
plaintiff in the contemplated ac-
tion and a proposed form of Res-
olution is hereto attached for con-
sideration and adoption by your
Honorable Body.
