MEMORANDUM December 13, 2001 TO: FROM: SUBJECT: The Honorable Mayor and City Council Members Michael C. Van Milligen, City Manager Resolution of Necessity for an Amended and Restated Urban Renewal Plan for the Ice Harbor Urban Renewal District Economic Development Director Bill Baum is recommending adoption of a Resolution of Necessity finding that an Amendment to the Urban Renewal Plan for the Ice Harbor Urban Renewal District is necessary, in the interests of the residents of the City of Dubuque. Upon approval of this Resolution of Necessity, staffwill begin preparing an Amendment to the Urban Renewal Plan for the consideration of the City Council, which will identify additional properties for public acquisition and provide a set of design standards for development within the district. In January 2002, the City Council will be asked to consider for approval a Master Plan for the Port of Dubuque area, which will include design standards. On March 4, 2002, the City Council would hold a public headng on the Amended and Restated Urban Renewal Plan. The Long Range Planning Advisory Commission will review the amendment at their February 20, 2002 meeting, prior to City Council consideration. Van Milligen MCVM/jh Attachment cc: Barry Lindahl, Corporation Counsel Cindy Steinhauser, Assistant City Manager William Baum, Economic Development Director _© CITY OF DUBUQUE, IOWA MEMORANDUM December 6, 2001 TO: FROM: SUBJECT: Michael Van Milligen, City Manager William Baum, Economic Development Director Resolution of Necessity for an Amended and Renewal Plan for the Ice Harbor Urban Renewal District Introduction This memorandum presents for City Council consideration a Resolution of Necessity that begins the process of amending the Urban Renewal Plan for the Ice Harbor Urban Renewal District. The proposed amendment will do two things: 1) identity additional property for public acquisition within the District; and 2) provide a set of design standards for development within the District. Background The City Council adopted an Amended and Restated Urban Renewal Plan for the Ice Harbor Urban Renewal District on June 5, 2000. At that time, the district was expanded to include all of the 4th Street Peninsula with the exception of the Adams Company property. The plan also identified several key properties generally east of Bell Street for public acquisition to assist in the implementation of the America's River project. Discussion The proposed amendment will identify additional 4th Street Peninsula properties that may need to be acquired through eminent domain action to accomplish Port of Dubuque redevelopment objectives. While negotiations continue with property owners, acquisition through urban renewal authority may be necessary to secure property where negotiations are deadlocked. The proposed amendment will also create a mechanism for the implementation of the design standards stipulated in the Port of Dubuque Master Plan which is scheduled for City Council action in January, 2002. The design standards will apply to all properties located in the Ice Harbor Urban Renewal District. Compliance with the design standards will be determined by the City Manager based on recommendations from a design review committee comprised of persons serving on the master planning work group. They will not be part of the Zoning Ordinance. The attached Resolution directs staff to prepare an amended and restated Urban Renewal Plan and to forward the proposed amendment to the Long Range Planning Advisory Commission for their review and comment. This is required by Chapter 403 along with a consultation process that involves all affected taxing entities. Those taxing entitles, the County, School Board and community college, have an opportunity to comment on the proposed amendment prior to the required public hearing on the urban renewal plan, but they cannot block adoption of the plan. City Council public hearing on the amended and restated Urban Renewal Plan will be scheduled for March 4, 2002. This allows for City Council completion of the Port of Dubuque Master Plan process in January and inclusion of the final design standards into the amended and restated Urban Renewal Plan. The Long Range Planning Advisory Commission will review the amendment at their February 20, 2002 meeting, and staff will conduct the consultation with the taxing entitles during this same time period. Recommendation I recommend the City Council adopt the attached Resolution of Necessity that begins the process of amending the Urban Renewal Plan for the Ice Harbor Urban Renewal District. Additional public action is needed to stimulate and guide redevelopment activity on the 4th Street Peninsula. The amendment will provide the necessary tools to encourage rainvestment and redevelopment activities in the Urban Renewal District that support and complement the $188 million investment in the America's River projects. Whereas, the City Council of the City of Dubuque adopted an Amended and Restated Urban Renewal Plan for the Ice Harbor Urban Renewal District on June 5, 2000 by Resolution 241-00 to stimulate and guide public and private investment within the District; and Whereas, the City Council of the City of Dubuque has determined that an amendment to the Urban Renewal Plan for the Ice Harbor Urban Renewal District will provide redevelopment opportunities and design and development standards which will further the purposes and objectives of the Urban Renewal Plan for the Ice Harbor Urban Renewal District; and Whereas, the City of Dubuque shall undertake the urban renewal actions specified in the Urban Renewal Plan, pursuant to the powers granted to it under Chapter 403 of the Iowa Code, Urban Renewal Law, and Chapter 15A of the Iowa Code; and Whereas, Chapter 403 of the Iowa Code requires that before an urban renewal plan may be modified, the City Council must adopt a resolution of necessity and provide for a process of review and consultation prior to adoption of an amended and restated plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That an amendment to the Urban Renewal Plan for the Ice Harbor Urban Renewal Distdct is necessary and appropriate to facilitate the proper growth and development of the community in accordance with sound planning and local community objectives. Section 2. That the City Manager is authorized and directed to prepare an Amended and Restated Urban Renewal Plan for the Ice Harbor Urban Renewal District, to forward said Plan to the City's Long Range Planning Advisory Commission for review and comment and to begin the consultation process required by law with affected taxing entities. Section 3. That the City Clerk is directed to publish notice of a public hearing on the adoption of an Amended and Restated Urban Renewal Plan for the Ice Harbor Urban Renewal District to be held on March 4, 2002 at 6:30 p.m. in the Carnegie-Stout Public Library Auditorium, 360 W. 11th Street, Dubuque, Iowa 52001 and that said notice shall generally identify the area covered by the Amended and Restated Plan and the general scope of the amendment. Section 4. That the City Clerk is further directed to send by ordinary mail a copy of said notice of public hearing to the Dubuque Community School District, the County Board of Supervisors and the Northeast Iowa Community College, as the affected taxing entities.
