Koch, Public Works Director SUBJECT: White Street Reconstruction - 21st to 32nd Street INTRODUCTION The enclosed resolutions authorize for the public bidding procedure for the White Street Reconstruction Project from 21st to 32nd Street. DISCUSSION White Street was budgeted for reconstruction as part of the Fiscal Year 2001 Street Program. The project consists of the complete reconstruction of base and pavement surface. The pavement surface will be portland cement concrete with all new curbing. White Street will remain its current widths of 41-foot from 21st to 24th Street, and 28- foot from 24th Street to 32nd Street. White Street from 21st to 24th Street was originally constructed with asphalt in 1895, with an overlay of that section in 1925. White Street from 24th to 27th Street, and from 27th tO 32nd Street, was constructed of concrete in 1925 and 1926. The project will include the replacement of some watermain from 27th to 30th Street, and replacement of all water valves. The storm sewer will be modified to drain existing water ponding along the streets and at various Iow points. Eighty-nine (89) lead water services will be replaced. The project will incorporate the replacement of 5,937 feet of 8" and 12" of sanitary sewer. The sewer and most laterals are over 100 years old and are in poor condition. In addition, the replacements of all the 298 sanitary sewer laterals from the City main to the property line are scheduled. Each lateral replacement will be assessed individually to that -property. Not only are properties on White Street (122 laterals) being assessed, but other properties on Jackson (89 laterals) and Central Avenue (87 laterals), which tie into the White Street sewer line, will also need replacement. Therefore, properties that are not actually on White Street will be assessed for their lateral replacement on this project. Sanitary sewer lateral replacements are not normally part of a project; but due to the age and condition of the laterals, they are scheduled as part of this project to prevent future problems under the new pavement. The sewer and lateral replacement will also help reduce the current stormwater infiltration problem. As we have discussed, you will be recommending as part of the Fiscal Year 2003 budget process that beginning on July 1, 2002, the City will be initiating a program to assist Iow- and moderate-income families on the cost of sewer lateral replacements if they meet the required income guidelines. These program requirements will be identical to the City's Street Assistance Program for Iow- and moderate-income owner-occupied properties. The White Street project is assessable with 19.38 percent (19.38%) of the Street costs, being assessed, along with the assessment values of the water service lateral and sanitary sewer lateral replacements. The project, as outlined, will require $1,842,950.78 in City funds. City funds are available from the Fiscal Year 2001 budget in the amount of $1,102,283 and 91,010,922 from the Fiscal Year 2002 budget, for total City funds available of $2,113,205. This leaves $270,254 as a balance toward the sanitary sewer portion of the project. The sanitary sewer cost of $687,133, less the available funding of $270,254, leaves a shortfall in sewer funding of $416,879. This shortfall will be borrowed from a balance in the Keyway sanitary sewer interceptor project which is not currently needed. This current balance is $368,138. This amount will be re-appropriated in a future five-year CIP program, when the funds will be needed. This, however, still leaves an outstanding shortfall of $48,741, which will be funded from the High Bluff Sanitary Sewer Reconstruction Project. Low- to moderate-income property owners subject to street and sewer lateral assessments will be eligible for financial assistance ranging from 20 to 100 percent of the Street assessment for owner-occupied resident property depending on family size and income level. This financial assistance program is made available through the 1% Local Option Sales Tax. ACTION TO BE TAKEN The City Council is requested to establish the date of the public hearing and authorize the City Clerk to advertise for proposals though adoption of the enclosed resolutions. This program is a new program that will help residents with Iow to moderate income where old laterals must be replaced Jn the street right-of-way due to street reconstruction projects. This program will mitigate the burden of the upcoming White Street and other street reconstruction projects. JUSTIFICATION Based on the fact that the current street programs requiring total replacement of the sanitary sewer lateral from the main to the property line, RELATIONSHIP TO OTHER PROJECTS This project implements the Comprehensive Plan's Infrastructure Element: Goals 2.1 and 11.7; and Housing Element: Goals 4.1,4.3 and 5.1. Schneider, City Clerk NOTICE TO BIDDERS OF THE RECEIPT OF BIDS FOR THE RECONSTRUCTION OF WHITE STREET - 21sT TO 32"0 STREET Sealed proposals will be received by the City Clerk of the City of Dubuque, Iowa, at the Office of City Clerk in City Hall no later than 2:00 o'clock p.m. on the 7th day of February, 2002, for the reconstruction of White Street from 21st to 32® Street. Copies of the plans and specifications may be obtained in the City Engineer's Office at City Hall. Payment to the contractor will be made from funds as may be legally used for such purposes. All work herein provided for shall be commenced within ten (10) days after the notice to proceed has been issued, and shall be fully completed as follows: Phase I - Roadway, October 30, 2002; and Phase II - Final Completion, June 30, 2003. All bids must be submitted on the Bid Form bound in the specifications. Each bid shall be accompanied by a satisfactory Bid Bond executed by the Bidder and an acceptable surety; or a cashier's or certified check payable to the City Treasurer, City of Dubuque, drawn on a bank in Iowa or a bank chartered under the laws of the United States, in the amount often percent (10%) of the bids submitted as security that the bidder will enter into a contract for doing the work and will give bond with proper securities for the faithful performance of the contract in the form attached to the specifications. The successful bidder will be required to furnish a performance bond in an amount equal to one hundred percent (100%) of the contract price. Said bond is to be issued by a responsible surety company approved and acceptable to the City Council, and shall guarantee the faithful performance of the contract and terms and conditions therein contained, and shall guarantee the prompt payment of all materials and labor and protect and save harmless the City of Dubuque, Iowa, from claims and damages of any kind caused by the operations of the Contractor. Said bond shall also guarantee the material and the maintenance of the improvement(s) constructed for a minimum period of two (2) years from and after its completion and acceptance by the City Council. No bid submitted by any Contractor which contains a condition or qualification shall be recognized or accepted by the City Council and any letter or communication accompanying the bid which contains a condition or qualification upon the bid which has the effect of qualifying or modifying any provision of the specifications in any manner will be construed as a non-qualifying bid and will be rejected by the City Council as not responsive. All proposals must be made on blanks furnished by the City Engineer and each bidder will be required to state his prices for doing all the items in each section on which he makes a bid and for all things necessary to make a complete job. The Bidder's attention is directed to the City of Dubuque's Affirmative Action Program which is included in the Contract Specifications and the provisions thereof and hereby made a part of the Contract Documents by reference and incorporated therein. The Contractor, when requested by the City of Dubuque, will furnish a statement of his financial and practical qualifications as provided for in the General Requirements of the Specifications. By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the State of iowa and to Iowa domestic labor. The City Council reserves the right to reject any and all bids or to waive any technicalities and irregularities. Schneider, City Clerk CONSTRUCTION SCHEDULE AND LIQUIDATED DAMAGES Work herein provided for shall be commenced within ten (10) days after notice to proceed has been issued and shall be fully completed based on the following schedule: Phase 1 - Roadway, October 30, 2002; and Phase II - Final Completion, June 20, 2003. For each calendar day that any work shall remain uncompleted beyond the completion schedule, $500.00 per calendar day will be assessed, not as a penalty but as predetermined and agreed liquidated damages. The Contractor will be separately invoiced for this amount, and final payment will be withheld until payment has been made of this invoice. The assessment of liquidated damages shall not constitute a waiver of the City's right to collect any additional damages which the City may sustain by failure of the Contractor to carry out the terms of his contract. An extension of the contract period may be granted by the City for any of the following reasons: 1. Additional work resulting from a modification of the plans. 2. Delays caused by the City. Other reasons beyond the control of the Contractor, which in the City's opinion, would justify such extension.
