The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Staff reviewed the enforcement history of the site and also noted that the property is
currently owned by the City of Dubuque. A cul-de-sac will be constructed at the end of
Liberty Street and the adjacent lot deeded to Habitat for Humanity to construct a single-
family home.
The Zoning Advisory Commission discussed the request, noting that the plat is in
compliance with the City's Subdivision Regulations.
Recommendation
By a vote of 7-0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Plat of Survey of Clarke's Subdivision No. 2
INTRODUCTION
The City of Dubuque has submitted a plat of survey for an approximately 1/3 acre parcel at the
eastern terminus of Liberty Street. A portion of the property will be dedicated for an offset cul-de-
sac, which will be incorporated into Liberty Street.
DISCUSSION
The submitted final plat represents the consolidation of five former residential lots into one single
lot (Lot 1) and the consolidation of existing City right-of-way with a small portion of the original lot.
The small lot will be a dedicated city street and form an offset cul-de-sac at the eastern terminus
of Liberty Street (Lot A).
The five former residential lots, which now comprise Lot 1, were taken in forfeiture and dedicated
to the City of Dubuque by the United States Attorney's Office. The City has replatted this
property utilizing a small portion of the former residential lot (Lot A) as an offset cul-de-sac. This
will enable City sanitation trucks and snow plows to turn around at the eastern end of Salem
Street, which has a 40-foot right-of-way with 20 feet of pavement, without entering private
residential driveways. The remainder of the property, which is shown as Lot 1, will be dedicated
to Habitat for Humanity for one or two single-family homes.
RECOMMENDATION
The submitted plat of survey of Clarke's Subdivision No. 2 is in substantial compliance with the
City of Dubuque Subdivision Regulations, and staff recommends that the Zoning Advisory
Commission recommend approval of the plat of survey.

RESOLUTION NO. 534-01
A RESOLUTION APROVING THE PLAT OF SURVEY CLARK'S SUBDIVISION NO. 2
IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a plat of survey Clark's
Subdivision No. 2 in the City of Dubuque; and
Whereas, upon said final plat appears a street known as Liberty Avenue (Lot A),
which the owners by said plat of survey have dedicated to the public forever; and
Whereas, said plat of Survey has been reviewed by the Zoning Advisory
Commission and had their approval endorsed thereon, subject to the owners agreeing
to the conditions noted in Section 2 below;
Whereas, said plat of survey has been examined by the City Council and they
find that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Liberty Avenue (Lot A) as it appears upon
said plat of survey be and the same is hereby accepted; and
Section 2. That the plat of survey of Clark's Subdivision No. 2 is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa, upon said plat of survey, provided the
owners of said property herein named, execute their written acceptance hereto
attached agreeing:
a) To reduce Liberty Avenue cul-de-sac to grade and to hard surface
with asphaltic concrete, in a manner acceptable to the City Engineer, and in
conformance with construction improvement plans approved by the City Engineer, and
inspected by the City Engineer.
b) To construct said improvements prior to one (1) year from the date
of acceptance of this resolution, at the sole expense of the owners, or future owners.

Section 3. That in the event the owners shall fail to execute the acceptance and
furnish the guarantees provided in Section 2 hereof within 180 days after the date of
this resolution, the provisions hereof shall be null and void and the acceptance of the
dedication and approval of the plat shall not be effective.
