The application, staff report and related materials are attached for your review. Discussion Staff reviewed the submitted plat of survey, indicating that the applicant wishes to sell one of his two buildings to another party, but to do so requires that the building be placed on its own lot. The Zoning Advisory Commission discussed the request, noting that access to the second building is by way of an access easement that has been reviewed by the Fire Marshall. Recommendation By a vote of 7-0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Kritz, Associate Planner Final Simple Plat of Lot 1 and Lot 2 of Hughes Court Subdivision INTRODUCTION Hughes Investment Corporation has submitted a minor final plat for property located at the eastem terminus of Hughes Court. The proposed final plat reconfigures two existing lots into two new lots in an effort to place an existing steel building on a separate lot. DISCUSSION Lot 3, a 1.2 acre lot at the east end of Hughes Court cul-de-sac, was originally platted in 1996 as part of the Hughes Court Subdivision. Subsequently, Lot 1, which is a 4.65 acre landlocked parcel situated behind Lot 3, was rezoned to LI Light Industrial zoning district. After the rezoning, two warehouse buildings were constructed. The second building, a 12,000 square foot warehouse, was built on Lot 1. A portion of this building transcends the lot line and is built partially on Lot 3. The property owner wishes to sell the building that transcends the lot line. Therefore, the lot line must be repositioned so as to place the second building solely on a separate lot. The newly reconfigured Lot 2, as with the former lot, will be substandard because it has no frontage along a platted City street. Access to this building will be along an existing public utility easement along the south property line of Lot 1. The property owner could have replatted so as to create a flag lot with 60 feet of frontage on Hughes Court. However, a 60-foot access would interfere with parking for the building on Lot 1 and, therefore, staff advised against creating a flag lot. RECOMMENDATION The submitted minor final plat of Hughes Court Lots 1 and 2 is in substantial compliance with the City of Dubuque Subdivision Regulations. Staff recommends that the Zoning Advisory Commission recommend the approval of the subdivision, subject to waiving the lot frontage requirement for Lot 1. G~m~ Attachment Prepared by: Laura Carstens~ City Planner Address: City Hall= 50 W. 13th St Telephone: 589-4210 RESOLUTION NO 536-01 RESOLUTION APPROVING THE PLAT OF SURVEY OF HUGHES COURT SUBDIVISION Whereas, there has been filed with the City Clerk a plat of survey of Hughes Court Subdivision; and Whereas, said plat provides Lot 2 with 0 feet of lot frontage, where 60 feet is required by Section 42-19(b) of the Subdivision Regulations; and Whereas, said survey plat has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said survey plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 2 to have 0 feet of frontage, where 60 feet is required. Section 2. That the plat of survey of Hughes Court Subdivision is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said final plat. 17th Passed, approved and adopted this 17th day of December', 2001.
