WHEREAS, Citizens of Dubuque
have been hurt, maimed or killed
in auto accidents, and
WHEREAS, it is known that con.
certed citizen action can reduce
this needless loss of life, and
WHEREAS, The American Vet.
erans of World War II, in National
Convention in 1961, did adopt a
Resolution calling for effective
highway safety, and since conven-
tion, all levels of their organization
have carried forward a continuing
program toward the following ob.
jectives:
1. To encourage all states to
adopt and maintain a statewide
motor vehicle inspection code
cOnforming with recommended
national uniform standards.
2. To encourage all states to con-
sider the necessity of main-
taining m i n i mUm physical
standards for drivers through
periodic physical examinations,
and
3. To encourage greater public
acceptance and utilization of
automobile safety belts as a
life saving device, and
WHEREAS, the National Com.
mander of the AMVETS, Edwin P.
Fifielski, did, during the week of
March 26th, bring to the attention
of Dubuque citizens and officials,
their safety campaign and its ob-
jectives. Therefore, the City Coun-
cil of the City of DUbuque, Iowa,
On this 7th day of May, does pro-
claim its whole-hearted support of
the safety objectives sought by the
American Veterans of W orId War
II Organization.

purchase of the sale of city land
at the corner of Delhi Street and
Gr~ndview Avenue by the Hartig
Drug Company hr the purpose of
negotiating the terms of the sale.
r recommend that the offer of
Mr. David Hartig of the HartiB"
Drug Company be accepted and
that title of Lots 2 of 1 of Rigi
Subdivision and Lot 2 of Lot 6 of
Lot 12 of Mineral Lot 172 be trans-
ferred to the Hartig Drug Com-
pany. I recommend that the sale
be subject to the following condi-
tians which the purchaser has
agreed to:
1. That no building will be erected
upon the property to be conveyed
and that any building on Lot 1
of 6 of 12 of Mineral Lot 172 be
kept at least four feet west of the
cast line of this lot.
2. That any erection of a building
on Lot 1 of 6 of 12 of Mineral Lot

At your meeting on March 7th,
you referred to the City Solicitor
and myself, the petition of My-Cap
Vendors, Inc. requesting a refund
on the unexpired balance of the
cigarette license issued in behalf
of Dorothy Heinen. The petition
stated that Dorothy Heinen had
left town and they were unable to
find the cigarette license in order
to turn it in for the refund.
Since Cigarette License #307
issued on November 7th, 1961, to
My-Cap Vendors, Inc. for Dorothy
Heinen, 2730 Dodge Street, and
My-Cap Vendors paid the fee of
$75.00 and same is evidenced by a
City Treasurer's Cigarette Receipt
#5030, My.Cap Vendors would he
entitled to the refund of $25.00.

Whereas, a petition requesting
the calling of an election on the
proposition of establishing a mu-
nicipal court has been filed with
this council and has been duly ex~
amined and found to be signed by
qualified electors of said City in
number equal to at least fifteen
per cent of those who voted at the
last regular municipal election in
said City, and said petition has
been found to be in all respects
sufficient and in compliance with
the provisions of Section 602.2 of
the Code of Iowa; and

Section 602.50 of the 1958 Code
of Iowa provides that the City
Council shall provide suitable place
for holding court and such other
rooms and offices as may be neces-
~ary for the transaction of the busi-
ness of the court.
Section 602.50 of the 1958 Code
of Iowa provides that cities having
a population of fifty thousand or
over shall have power to erect a
municipal court building and to
purchase ground therefor, such
building when constructed to be
used for the housing of the munici-
pal court and such other like pur-
poses as the Council from time to
time may by ordinance direct, in-
cluding the housing and retention
of persons charged with offenses
against the laws of the City and
State. Provided that no such
grounds shall be purchased nor any
building erected thtreon until the
question has been submitted to the
people at a regular or special elec-
tion, and approved by a majority of
the votes cast at such election vot-
ing on said question.
Section 602.53 of the 1958 Code
of Iowa provides that such build-
ing and grounds shall be financed
and paid for in the same manner as
jails and station houses.

On April 14, 1962 the petition
of qualified electors to submit the
question of establishing a Munici-
pal Court at a General Municipal
Election or Special Election was
referred to the City Attorney for
investigation and report.
Section 602.2 of the 1958 Code of
Iowa provides that upon filing of a
petition of not less than fifteen
percent of the qualified electors,
the Mayor shall by proclamation
publiSh once a week for three
consecutive weeks in two news-
papers of general circulation pub-
lished in said municipality, or in
one newspaper if two not be pub-
lished, submit the question of es-
tablishing a municipal court at a
general municipal or special elec~
tion to be held at a time specified
therein, which time shall be with-
in two months after said petition is
filed.
Section 602.5 of the 1958 Code
of Iowa provides that in municipal
court districts having more than
forty thousand inhabitants and less
than sixty thousand inhabitants,
there shall be two municipal
judges.

tween Mr. Hail and the Railroad.
Although some of the terms of the
Agreement seem stringent from
the city point of view, the Agree-
ment appeared to be the only con-

place a pipe under the tracks of
the Railroad Company.

Dodge was in disagreement as to
a statement made as to snow re-
moval of Dodge Street. Joe Ros-
camp of 1405 Dodge stated that
his rental property would be worth-
less without any parking privi-
leges. Merlin Apel asked the ques-
tion "Who paid for assessment
from Devon to Grandview?" and
was of the opinion that the State
should pay the whole paving as-
sessment. Adolph Raska and F.
Fesler made inquiry as to the ap-
proximate amount of assessment.
Mrs. Roger Luchterhand of 1280
Dodge Street also made inquiry
as to the assessable amount. Mr.
Frank Kelly was of the opinion
that action on the proposed paving
should be delayed.

the Agreement from the State be

further negotiation with the State,
with the viewpOint that we attempt

car owners on the street, outside
of business; only twelve are with.
out driveways. There is a possibil-
ity of providing approximately
futeen parking spaces on Peabody
Street and west of Savary's Tap
there is a possibility of twelve to
fifteen more spaces. Mr. Frank
Kelly congratulated the City Man-
ager on his efforts in their behalf
so far.

WHEREAS, by Resolution adopted
November 7, 1960, in connection with
the improvement of Primary Road No.
20, the City Council has agreed that
upon receipt from the Highway Com-
mission of a list of driveways and en-
trances provided for access under said
improvements, the list would be re-
corded under a supplement Ordinance,
and
WHEREAS, the City Manager has
submitted to the City Council the list
of driveways and entrances referred to
in said Resolution.
