rence Portzen and Lucille Portzen
has worked out a settlement in co-
operation with the City Attorney's
office in the amount of $250.00
with the understanding that City
Attorney would recommend contri-
bution to said amount by the City
in the amount of $125.00.
It is therefore recommended by
the City Attorney that the sum of
$125.00 as contribution of the
City's share of said settlement be
paid to American States Insur-

of $10,000.00 claiming injuries as
a result of a fall allegedly occur-
ring at 22nd & Jackson St. on Jan-
uary 23, 1961, claiming an alleged-
ly defective curb thereat by reason
of an accumulation of ice.
I have made an investigation of
this ",atter and fiud that there
was no negligence on the part of
the City of Dubuque as would be a
basis for a right to recover by Mr.
Auderer, and therefore recommend
denial of said claim.

present 50 foot wide pavement.
Parking shall be prohibited on
the minor street approaches for a
distance of 35 feet in advance of
the stop sign.
Parking shall be prohibited on
the exit sides of the minor streets
for a distance of 35 feet back of
the crosswalk.
In the event the City of Dubuque
fails to pass and/or enforce either
of the aforesaid ordinances, the
City agrees, upon demand by the
Commission, reimburse the Iowa
State Highway Commission in the
amount equal to the sum expended
by the Commission on the Project.
6. Within 90 days after approving
this agreement, the Council will
by ordinance establish access con-
trol under the provisions of Chap-
ter 306A, Code of 1958, prohibiting
ingress or egress to, from or across
said facility to or from abutting
lands, except at such designated
points at which access may be per-
mitted by the Commission, upon
such terms and conditions as may
be specified from time to time.
Access rights will not be destroyed
except by purchase or appropriate
condemnation proceedings thereof,
condemnation proceedings thereof.
However, such access rights shall
be subject to such regulations in
the interest of public welfare and
safety as the City and Commission
may agree upon, provided that no
additional access ways of change
of use shall be permitted by the
City without the consent and ap-
proval of the Commission. The
Council will also authorize the
Commission to acquire right-of-way
and access rights by purchase or
condemnation, as shown on the
plans for Project Number U-305,
and more specifically described as
follows: on Dodge Street (US 20)
from Grandview Avenue to Bluff
Street.
The Council authorizes the Com-
mission to contruct and preserve,
within the limits of the right-of-

AGREEMENT
TillS AGREEMENT is entered
into by and between the Iowa State
Highway Commission, hereinafter
called the Commission, and the
City of Dubuque, Iowa, hereinafter
called the City.
WHEREAS, it is deemed neces-
sary to resurface the extension of
Primary Road No. U.s. 20 on
Dodge Street from Grandview Av-
enue to Bluff Street with type "A"
asphaltic concrete three inches
thick.
NOW THEREFORE, be it agreed
by and between the parties hereto:
1. The City will prepare plans,
hold a public letting and supervise
construction according to Iowa
Highway Commission Specifica-
tions, current series.
2. The Commission will design
mix, inspect materials and test
samples during construction. Re-
cord samples will also be taken.
Copies of all reports to be sent
to the City for their files and use.
3. The City will finance the work
100 percent and the Commission
will reimburse the City, at the
completion of the project and ac-
ceptance by the City Engineer,
for one-half the cost of the actual
resurfacing items. Total cost of
the reimbursement is not to ex-
ceed $35,200.
4. Other items such as tree reo
moval, curb and gutter replace-
ment, widening sidewalk and drive.

January 1, 1964, an ordinance pro-

the south side of Dodge Street,
between Grandview Avenue and a
point immediately opposite Bissell

WHEREAS, the Iowa State High-
way Commission and City of Du-
buque, Iowa have reduced said
agreement to writing which agree-
ment sets out and specifies the
terms, provisions and conditions
of the Iowa State Highway Commis-
sion with respects to such improve-
ment as to the cost of such im-
provement and the payment there-
for and including, among other
things, parking restrictions to be
enacted by the City of Dubuque
and the limitations and regulations
governing access rights, and that
a copy of said agreement is here-
to attached and marked Exhibit
"A" and by reference incorporated
herein as though fully set out here;
and
WHEREAS, it would serve the
best public interest that the City
of Dubuque execute said Agree-
ment.
NOW THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL
OF DUBUQUE, IOWA:
Section 1. That the Agreement,
copy of which is hereto attached,
marked Exhibit "A" by and be-
tween the Iowa State Highway
Commission and City of Dubuque,
Iowa, covering "County of Du-
buque, Project No. U-305 be and
the same is hereby approved.
Section 2. That the Mayor and
the City Clerk be and they are
hereby authorized and directed to
execute said Agreement for and
on behalf of the City of Dubuque,

WHEREAS, Hartig Drug Com-
pany has made an offer to pur-
chase Lot 2 of Lot 1 of Rigi Sub-
division and Lot 2 of Lot 6 of Lot
12 of Mineral Lot 172, each in the
City of Dubuque, Iowa for the
sum of Fourteen Hun d red
($1400.00) Dollars; and
WHEREAS, the City Council has
made an examination and in-
vestigation of the proposed use of
the above described property by
Hartig Drug Company; and
WHEREAS, the City Council of
Dubuque, Iowa finds that it would
serve the best public interest that
said offer of Hartig Drug Company
to purchase the hereinabove de-
scribed real estate for the sum
of $1400.00 be accepted providing,
however, that the fOllowing provi-
sions be incorporated as the terms
of grant on the part of Hartig Drug
Company to be observed and com-
plied with and upon a branch or
failure to comply with said provi-
sions, said real estate shall revert
to the City of Dubuque absolutely,
without re-entry, demand or notice
of forfeiture, which provisions are
as follows, to-wit:
1. No building or structure shall
be erected on the property herein
conveyed.
2. No building shall be erected
on Lot 1 of Lot 6 of Lot 12 of
Mineral Lot 172 having any part
within four (4) feet of the east
property line of Lot 1 of Lot 6 of

3. No building shall be erected

ing Project No.1 pursuant to Reso-
lution No. 73-62 and notice to bid-
ders published in a newspaper pub-
lished in said City on April 23,
1962 and April 30, 1962; and
WHEREAS, said sealed proposals
were opened and read on May 14,
1962, and it has been determined
that the bid of Steger Construction
Company of Dubuque, Iowa in the
amount of $47,253.18 was the low-
est bid for the furnishing of all
labor and materials and perform-
ing the work as provided for in the
plans and specifications; now there-
fore,

Council of the City of Dubuque
that the contract for the above
mentioned improvement be award-
ed to Steger Construction Company
and the Manager be and he is

WHEREAS, the owners of an
area approximately 17.62 acres in
size immediately adjoining the
westerly city limits of the Oity of
Dubuque, Iowa, in the vicinity of
Pennsylvania Avenue, have made
application for annexation of said
territory to the City of Dubuque,
Iowa; and
WHEREAS, said territory is be~
ing substantially built up; and
WHEREAS, the inhabitants of
said territory will be enabled to
secure the benefits of city govern-
ment in the way of police and fire
protection in said territory if in-
corporated within the city limits
of the City of Dubuque, Iowa; and
WHEREAS, the inhabitants of
said territory will be enabled to
secure water. sewer and other
municipal services if said territory

The Shiras Avenue Storm Sewer
has been completed in accordance
with plans and specifications by
the Saffran Construction Company
of Dubuque, Iowa with the excep-
tion of the construction of four
catch basins. Your staff has de-
cided to delete the catch basins
from this contract and construct
them with the current concrete
curb and gutter project for Shiras
Avenue to assure proper alignment
and grade on the improvement.
I, therefore, recommend that the
Shiras Avenue Storm Sewer be ac-
cepted with the exception of the
four catch basins.
