and City Council,
Gentlemen:
The petition of Edward Frudden.
1651 Dodge Street etal requesting
rezoning of property adjacent to
Dodge Street from Booth Street to
Grandview Avenue has been COD-
sidered by thc Planning and Zon-
ing Commission.
Two meetings were held with
interested parties and the Commis-
sion viewed the grounds.
The petitioners stated as rea-
sons for rezoning the following:
Heavy traffic with its related
noise and congestion.
Parking restrictions.
Lowering of property values.
After full bearing and consid-
eration of all related matters the
Planning and Zoning Commission
recommends denial of the petition
of the petition for the following
reasons.
The devclopment of Dodge
Street for business through the
years has been gradual and ac-
cording to demand. The present
business area has not been fully
developed to cause a great de.
mand for new zones. The commis-
sion has moved to keep up with
the demand and has not zoned
with the idea paramount that just
because a street carried a major
highway that all adjacent property
should be business. IT that be the
case then all of Central, White,
Rhomberg and other highways
should be business zones. One of
the major reasons for zoning is
to control development and con-
gestion. To take a very substantial
desirable and attractive residential
area that is presently occupied by
very good dwellings and place
same in a business zone hoping
for orderly development and main-
taining or increasing property val-
ues is not good zoning nor the
proper approach to a desirable
business area.
Traffic generating within this
area is very minor. To saturate
this area with business concerns
would add much to the entrance
and exit to Dodge Street and the

(D) Aod reported that a parking
structure at the Locust, Bluff,
Eighth and Ninth Streets lo-
cation would fit into future
parking and master plans.
As the report is considered by
various groups, there will be gen-
erated diverse ideas like whether
or not a ramp should be con-
structed, its location, the amount
of parking, tbe parker to be
served, and other uses to which
the site under consideration can
be . put. These ideas of course, rep-
resent real problems which I am
certain can be solved in the pro-
cess of designing the project. 1
suggest to you that by good re-
search, survey and estimate, you
have been advised that a ramp at
the Locust Bluff location is feas-
ible; that you not be distracted
but rely on this guide to initiate
the project, coufident that the
tangental problems can be solved.
I believe that contained in this
project are more opportunities
for benefit to the whole commun-
ity than just off-street parking it-
self. I believe that this is an op-
portunity to use good architectural
design which will make our cen-
ter town look more attractive. I
believe this is an opportunity to
make the area more usable and
thus more profitable. I believe
this is an opportunity to stimulate
downtown development. I believe
this is an opportunity to reinforce
and continue the enthusiasm of
our community which has devel-
oped over the past several weeks.
I believe this is .an opportunity to
use this initial step as a catalyst
to spur other community projects
in the months ahead.
On the basis of confidence in
the workableness of the project
and its inherent community re-
enforcing opportunities, I urge the
Council to act promptly authoriz-
ing the land purchase and the de-
signing of the structure.

Mr. Frank Saunders, executive
secretary of the Chamber of Com-
merce, addressed the Council in
support of the resolution submitted
by the Chamber relative to the pro-
posed parking ramp. He submitted
a comparative report of cost of
ramps in Madison, Wis. and Water-
100, Iowa, to a proposed ramp here
in the City, showing ground area,
total area, number of cars, area
per car, cost per space and cost of
building only, on the basis of a
three level structure.
Mr. Eldon A. Pfohl of 2591 Cent-
ral addressed the Council by stat-
ing that the building of a parking
ramp will solve absolutely nothing
and tbe money could be used in a
much better fashion.

I submit to you the "Preliminary
Downtown Parking Report" dated
August, 1962, compiled by Victor
Gruen Associates. In the report the
investigators have:
(A) Established tbe fact that there
is a shortage of convenient
customer parking space in the
downtown core area;
(B) Indicated that the City can
solve this problem by con-
structing a parking ramp on
tbe block bounded by Locust,
Bluff, Eighth and Ninth
Streets;
(C) Estimated that the financing
of land and structure expense
can reasonably be supported
by the income of the parking
system:
Communication of Fischer Realty
Co. encouraging the proposed
building of a two story parking
ramp between 8th and 9th on
Locust Street and Bluff to spur new
construction and renovation of ex-
isting buildings in downtown Du-
buque, presented and read. Coun-
cilman Schreiber moved that the
communication be received and
filed. Seconded by Councilman
Kean. Carried by the following

a resolution endorsing and approv-

ing a three tier ramp and further

1821 Rhomberg Avenue, Dubuque,
Iowa, filed her claim for damages
alleging damage to her vehicle on
June 18, 1962 as a result of a tree
limb falling on top of her car
while parked at 1821 Rhomberg
A venue, said claim is in the
amount of $84.75.
I have made an investigation of
this matter and have conferred
with thc Park Board Superintend-
ent and find there is no actionable
negligence on thc part of the City
and therefore recommend denial
of said claim.

Gentlemen:
You have referred to me, M;r.
Maurice T. Humke's letter of Aug-
ust 6th, requesting that he be per-
mitted to purchase approximately
an acre of city land in the vicinity
of Moore's Mill.
Although I have not contacted
Mr. Humke, Dor has he been in
touch with my office, I do not rec.
ommend that the Moore's Mill land
be used for the type of operation
proposed.
I have discussed Mr. Humke's
petition with the Chairman of the
Dock Commission and he has in-
formed me that Mr. Humke has
been in touch with the Dock Board
and that the Board has shown
him spaces in Area "A", a space
near the city terminal building and
has suggested several private
sites.
The Chairman has informed me
that no final arrangements have
been arrived at with Mr. Humke.

The establishment of business in
this aera would seriously affect
the newer houses in the immediate
adjacent area.
Business uses on the two comers
at Grandview would certainly add
to the problems at this intersec-
tion with the school directly across
the street.
Many of the lots on the north
side extend to the rear lines of
the residences on Parkway and
this would create an unusuable
area if business were zoned for a
reasonable distance north of Dodge
Street.
Areas zoned for business should
be suitable for proper develop-
ment in order that the business
could bc supported which would
in some effect guarantee that the
area would not degenerate -and
become a blight area which could
seriously affect the whole district.

and health because of its condi-
tion and that demand has been
made by him upon Mike Nick as
tenant of said property and heir at

fact that the recorded owner of

tion complained of be corrected
and that said tenant has failed to

On July 3, 1961 the City Coun-
cil of DUbuquc, referred to the
City Solicitor a petition at law
filed by Agnes Ingles. Plaintiff
VB. City of DUbuque, which peti-
tion prayed for damages in the
amount of $15,000.00. alleging in.
juries suffered as a result of a
fall on alleged defective public
sidewalk in front of premises
known as 1671 Maple Street in the
City of Dubuque, Iowa, which al.
leged fall occurred on January 26,
1961.
Plaintiff suffered fractures at
thc right and left wrist and that
plaintiff's injuries are partially
permanent.
I have made an investigation of
this matter and have conferred
with plaintiff's attorney. who has
made an offer of settlement, on
behalf of plaintiff in the amount
of $4,000.00. 1 also have conferred
with other parties in this matter,
on whom the City has served no-
tice of liability over in accordance
with law, and said parties have
agreed to contribute to said set-
tlement, respective amounts to-
taling $3,450.00, leaving the
amount of $550.00 to be paid by
the City.
It is the recommendation of the
City Attorney that said offer of
settlement be accepted, and that
City Auditor be instructed to draw
a warrant in the amount of $550.00
payable to Agnes Ingles and Earl
Ingles, her husband and to trans-
mit same to the City Solicitor for
delivery to plaintiff upon receipt
of dUly executed releases and dis-
missal of plaintiff's petition at her
costs.

grams are out of order for the
City. He thought it best to build
the ramp on Iowa Street between
9th and 10th on city owned prop-
erty.
Mr. Herb Kicfer of 535 Chestnut
st. asked the question "why spread
the proposed ramp over a two
block area?" Mr. Eldon Pfohl of
2591 Central Avenue stated that in
his opinion the ramp should not
be built where it is proposed. The
tendency is toward free parking
that is why the shopping centers
are doing business. Mr. N. J. Yian-
nias of 505 Bradley Strcct statcd
that the proposed area is nearest
the greatest demand for parking.
The demand is not present at the
city owned lot at 9th & Central
Avenue. Mr. Frank Saunders, Sec-
retary of the Chamber of Commerce
stated that the retail industry is
the third largest in the State which
should be protected. Mr. Cy Lampe,
manager of the Fischer properties,

For, as a practical matter, we
note there is a basic inconsistency
in the Victor Gruen Report as re-
ported in the August 19th, 1962
issue of the Dubuque Telegraph-
Herald. On the one hand, Harold
Marks, parking and traffic engi-
neer for Victor Gruen Associates,
purports to state that a public
ground-level parking lot on the
one-block site would not be eco-
nomically sound because, "with
the high cost of property, you have
to spread the cost over a bigger
utilization of the space-by going
up in the air." Yet on the other
hand the recommendation is for
a faCility only two stories high.
We also note that the plan of
Victor Gruen Associates would
provide only 90 more spaces than
are now available to people now
using the ground level lots at a
cost, as estimated by them of
$329,000.00 for the additional
ground. This, plus the cost of the
ramp, would put the cost per stall
for additional spaces at a most ex-
cessive and unrealistic figure.
We would suggest an alternate
proposal, which would be in su b-
stance akin to the existing facility
in Waterloo, pictures of which were
shown in the Telegraph-Herald in
connection with the report of Vic-
tor Gruen. This proposal is also
within the suggestion of the Victor
Gruen Associates, that with the
high cost of property you have to
spread. the cost over a bigger utili-
zation of the space by going up
in the air. In other words we mean
the construction of a 4 story ramp
on the westerly one half of the
block of which thc City alrcady
owns a portion. Thus the same re-
sults could be accomplished at
much less expense.
This plan would also leave the
present Roshek property still avail-
able for private parking which is
extremely necessary to the oper-
ation of the Roshek Building. Our
office tenants, many of whom are
doctors, must have permanent park-
ing space, as immediate availability
of their cars is a MUST in the
practice of their profession.

net earnings of the municipal wa-
terworks plant and system of said

were heretofore issued under date
of May 1, 1955. of which bonds in
the amount of $1,200,000 are now
outstanding and mature serially
on December 1 of each of the
years 1962 to 1974, inclusive, and
Water Revenue Bonds, Series 1956,
of said City were heretofore issued
under date of December 1, 1956,
of which bonds in the amount of
$310,000 are now outstanding and
mature serially on December 1 of
each of the years 1962 to 1975, in-
clusive, all of said bonds ranking
on a parity, and in and by the pro-
ceedings authorizing the issuance
of said outstanding bonds, and as
recited on the face of each of
said bonds, the right was reserved
to the City to from time to time
authorize and issue additional wa-
ter revenue bonds ranking on a
parity with the bonds therein au-
thorized under certain conditions
and restrictions; and
WHEREAS there are no other
bonds or obligations now outstand-
ing which are payable from or
constitute a lien upon the net
earnings of said utility and the
conditions and restrictions with
respect to the issuance of addition-
al bonds ranking on a parity with
said outstanding bonds as set
forth in the proceedings authoriz-
ing their issuance can now be met
so that the additional bonds now
proposed to be issued may rank on
a parity therewith; and
WHEREAS it is necessary and
desirable that improvements and
extensions to said municipal Wa-
terworks be constructed consisting
generally of two steel standpipes
of approximately 2,400.000 gallons
capacity and 1,400;000 gallons ca-
pacity, respectively, together with
appurtenances, on pile foundations
at the Asbury aod Park Hill sitcs,
and a one-story concrete and ma-
sonry pumping station at the Park
Hill site, including two horizontal
centrifugal pumping units, meter-
ing equipment, electrical, plumb-
ing, heating and ventilating work,
the cost whereof is estimated to
be not Icss than $400,000, for
which purpose it will be necessary
