At the last regular monthly
meeting of the City Council, Mr.
and Mrs. Ervin Denlinger and
their son, Richard L. Denlinger,
appeared before the Council reo
garding their respective claims
for damages as a result of the
operations of Hennesey Brothers,
general contractors, installing the
Kaufmann Avenue storm sew( r.
The basis of their complaint was
that their respective claims for
damages had been ignored by
Hennesey Brothers.
At that time your City Attorney
gave you an oral report on the
status of the respective claims at
which time your City Attorney
advised you that nothing further
could be done on behalf of the
said Denlingers.
At said meeting your City At-
torney advised your Honorable
Body that he would make one
more effort by writing Hennesey
Bros. regarding the claims of the
Denlingers.
Attached hereto is the letter
dated October 30, 1962, from the
Hartford Fire Insurance Company
Group wherein they state that
they have paid the claim of Richard
L. Denlinger, but do not intend
to pay the claim of Mr. and Mrs.
Ervin Denlinger.
In view of the foregoing it is
the position of the City Attorney
that the file should be closed on
this matter as the City can do
nothing further on behalf of Mr.
and Mrs. Ervin Denlinger and
that they must seek their remedies
through other channels available
to them.

the platting of Wiegand Subdivi-
sion was referred back to this
office, and I beg to advise that
on October 15, 1962 I wrote the
attorney for the subdivider, a

Since that time I have heard
nothing further and therefore rec-
ommend that nothing further be
done on the subdivider's plat until
such time as special assessments
against said real estate are paid,

stated that service thereof had
been duly made and that this
meeting is the regular monthly
meeting called for the purpose of
acting upon such business as may
properly come before the meet-
ing.

Gentlemen:
It was the intention of your
staff to pave Peabody Street and
have it used as a parking lot. The
work was to be done at the same
time as Dodge Street paving. The
cost of the work was estimated
at approximately $2200. The lot
was laid out so that about 15 cars
could be parked on it. The intent
was to provide some off street
parking relief to residents living
in the no street parking zone along
Dodge.
The use of Peabody Street as
a parking lot, however, was ser-
iously objected to by abutters,
although it was pointed out that
access to rear lots would be main-
tained and that the parking would
be arranged to prevent encroach-
ment on private property.
The objection was presented
that a right of way dedicated for
street purposes could not be used
as a parking lot. This point was
presented to the City Attorney
on the basis that if construction
of the parking lot were under-
taken an unjunction would be
sought against the City to prevent
it.
Since the City Attorney has ad-
vised me that our legal position
is not certain, and since there
has been strong Objection to the
parking proposal, I have instruct-
ed that the parking lot proposal
be discontinued.

On May 7, 1962 the communica-
tion of your City Manager re-
garding the execution of an agree-
ment by and between illinois Cen-
tral Railroad and City of Dubu.
que, Iowa covering the construc-
tion and maintenance of a ten-
inch cast iron water main under
the tracks of the illinois Central
Railroad at Fremont Avenue was
referred to this office.
I made an investigation of this
matter and determined that the
rights of the City in and to the
Railroad right of way were such
as would not warrant the City
executing the proposed agreement
by and between the Railroad Co.
and tbe City.
This matter has been adj usted
by and between the Water De-
partment of the City of Dubuque
and the Railroad Company with-
out the necessity of executing the
formal written agreement sub-
mitted by the Company.
It is my understanding that the
Water Department has already in-
stalled the water main under th:;
railroad tracks at Fremont Ave-
nue and therefore there IS no
need for the City to execute the
proposed written agreement cov-
ering same between the Railroad
Co. and the City of Dubuque,
which agreement and letter of
April 19, 1962 from lllinois Cen.
tral Railroad to our City Mana-
ger and letter of May 3, 1962 by
your City Manager to the City
Council are herewith attached.

ing ramp program, I have found
that our present off-street park-
ing bond ordinance is restrictive
to the point of almost preventing
the proposed ramp program. There
are two requirements in the ordi-
nance which cause difficulty.
1. A lien is placed upon park.

are satisfied. These lots are the
southwest corner of 9th & Bluff;
the northwest side of 9th & Bluff;
the strip between 8tb and 9th; the

2. No additional bonds for new
off*street parking facilities can be
issued until the net revenue of
the parking system for the last
fiscal year is 1 If.3 times the max-

months. Under our present rate
of earnings, only an insufficient
amount of new bonds could be
issued for the ramp program.
Further, since our entire park-
ing program is in the planning
state, any future development be-
yond the proposed ramp will be
hampered by the ordinance fE;-
strictions. A greater flexibility
than that now permitted will be
required.
Finally, I have been advised that
the marketing of new bonds will
be greatly affected by the fact
that the parking system is already
obligated to bonds in the amount
of $310,000.00. This may be to the
extent of prohibiting a new issue.
In order to overcome the diffi.
culties I have sought the advice
and help of Quail and Company,
Incorporated. The i l' representa-
tives, Mr. Gadient and Mr. H.
Pickard, have advised me that they
believe that outstanding bonds can
be purchased. The company has
tendered this service in the form
of a contract with the city.
I recommend that authorization
be granted by the Council for the
city to enter into a contract with
the Quail Company to negotiate
the purchase of outstanding Off-
Street Parking Revenue Bonds.

There is another type of criti-
cism which any official has just
cause to resent. It is the type which
is not constructive, not honest and
certainly, not in the best interest
of the community. When the
bounds of propriety have been
over-stepped, when twisted facts
and purposeful distortions become
the means to an end, it is time
to challenge the authors and set
the community's thinking ~\raight.
I find this course necessary in
regard to John Waltz, Dock ~om-
missioner. This man who tt~rved
so ably for the past three years
has been cruelly and maliciously
attacked. His opponents represent
a very small but vocal segment of
the citizenry. They have been ahle
thru various means to confuse the
minds of many good citizens with
distorted facts and mis-statements.

Mayor Schaller stated that he

nothing to do with labor or Mr.
Kingsley. Even with controversy
Mr. Waltz has done a fine job. I
believe he is most conscientious
and will continue to be so. Council-
man Takos read the following state-
ment in support of Mr. Waltz's
appointment to the Dock Commis-
sion.
We who are in the service of
the public, are continually subject
to criticism. Our actions, our deci~
sions, and our ideas are constantly
analyzed, debated, praised and
criticized. The public official who
resents eriticism should hastily de-
part from public service. It is not
healthy for a community to be
devoid of criticism, I am, of course,
speaking of constructive criticism.

Mr. Waltz should be commended
for not fighting back. He realizes,
as good citizens do, that in such
a struggle there is only one loser
-the community itself. This at-
titude has produced for him still
wider support and the respect of
countless citizens who have se-en
thru the plan to discredit him. He
should also be commended for his
desire to continue to 3erv~ the
public. Many a man would be d!~-
allusioned at the unfair methods
employed against him.
At the outset, I want to point
out that my remarks are not direct-
ed toward Labor nor it's candidate.
This group seeks representation on
this board as they do on all city
boards and commissions. They
have not unfairly castigated Mr.
Waltz in advancing their candidate
and I highly commend them for
it. Labor, in general, knowns Mr.
Waltz is not anti-labor anymore
than he is quote anti-business un~
quote. Prior to Mr. Waltz's ap-
pointment there was intermittent
strife between the union and the
Dock commission concerning wages
and non~union labor. At the meet~
ing of May 23rd, 1960, Mr. Waltz
moved that skilled laborers be
hired from the specific locals for
tht jobs to be performed by thc
Commission. At the present time,
all employees are union men and
all are paid union scale wages.
Mr. R. F. Sefzik complimented
City Engineer White and com-
mittee on coming up with a set
of figures relative to the cost of
the proposed extension of Riker
Street, and hoped the parking
ramp committee could do likewise.

dustrial Director. It is his belief
that proper success in this field can
only be obtained by relying on

policy of seasonal purchasing and
the letting of bids in smaller quan-
titi~s to attract more competition.
This proceedure has also been of
significant value in producing thou-
sands of dollars of savings.

strated in hi~ dealings with busi-
ness and industry that while he has
their interest and success at heart
he has the deep concern of the
tax paper whom he represents offic-
ially. His position in this regard
can bE'st be demonstrated by his
own statement. Quote "The opera-
tion of the Dock Commission is uni-
que in so far as the other Commis-
sions of the City are concerned due
to the fact that we are dealing with
private industry whose primary in-
terest is profit. Therefore in deal-
ing with these bodies it is import-
ant thnt the Dock Commission con-
c"rn themselves with the protec-
tion of the taxpayer in as much as
we tying up city property for as
long as fifty years in some cases.
Farsightedness is absolutely neces-
sary in th~se dealings. We must
try to project the value of this
land as well as the use of the land
over the years. Changes in trans-
portation modes, tonnage crossing
our property which constitutes the
bulk of our income must be con-
sidered." Unquote.
This statement of Mr. Waltz's
contains wisdom and reflects the
kinrl of thinking Dubuque needs
now and in the future. This man
has brought a type of reform to the
Dock Commission which has pro-
duced progressive action and un-
told savings to the City. He has a
knowledge of the waterfront and
of the technical aspects of the
Dock Commission that few individ-
uals can equal. He has proven that
he cannot be controlled by individ-
ual or group pressure. To me, this
is a vital attribute. The city
Council and the City of Dubuque
can be proud of the three years
of service Mr. Waltz has rendered
to date.
In reviewing, Mr. Waltz's fine
record and after examining the

rock rip-rap on the East shore
south of the 16th street bridge.
They did the same on the new
pleasure boat harbor as well as
on the East bank of Area "A."
In addition, they now do the clear-
ing work necessary prior to dredg-
ing. This new approach to river
front development using city per-
sonnel has resulted in thousands
of dollars savings.
2) Office procedures have been
completely revamped in the past
two years. New equipment has
been purchased and reports are
now standardized and available to
anyone seeking information.
3) Locations of each boat and
float have been carded and a tag
identification system has been set
up, resulting in a morc efficient
method of rental collection which
has been a problem thru the years,
and boat and float owners are aid-
ed in times of distress by speedy
identification.
4) Communication between the
City engineering force and the
Water department was also a prob-
lem in the past. Now these two
agencies work directly with the
Dock commission to allow for bet-
ter and more carefully executed
planning.
5) There is now a continual ex-
amination and enforcement of the
minimum wharfage clauses in all
leases. This action alone has pro-
duced several thousands of dollars
of added revenue.
6) Since Mr. Waltz's appoint-
ment, there has been a careful ad-
herence to the budget. The yearly
budget now reflects a true picture
of the Commission's financial
transactions.
7) It is Mr. Waltz's belief and in-
tention, as well as the other two
commissioner's that the Dock com-
mission can and should be oper-
ated without city taxes. The tax
asking reduction started with the
1960 budget. This year the com-
mission received $8,000.00 in tax
monies as opposed to a yearly
average of $35,000.00 before 1960
budget, and Mr. Waltz's appoint-
ment. Riverfront improvement has
remained constant despite the low-
er requests for tax monies. Prior to
1961 budget, funds for riverfront
development were in addition to
yearly allotment of taxes for regu-
lar Dock operation.

If these claims contained any
truth whatsoever it would not be
possible to have this man continue
as a Commissioner, as he would
represent a liability which would
not be in the interest of the com-
munity. Who else would know bet-
ter what kind of a Commissioner
Mr. Waltz is, than the businesses
on the waterfront or citizens who
have an interest in its develop-
ment. Here is what they say about
Mr. Wallz.

I warmly thank each of the au-
thors for frankly stating their per-
sonal evaluation of a good citizen
doing an outstanding public ser-
vice. I do not believe there will
be any effort to discredit the in-
tention of the letter signers. Men
like Mr. Eckland, Mr. lbinger, Mr.
Belland Mr. Flynn as well as each
of the others are men of integrity
who did not have to advance a
supporting document. They did so
because they wish the public to
know of a great service being
rerfarmed by a conscientious and
c;:~able commissioner. They want
U;e public to know that Mr. Waltz
is not "messy" in handling Dock
Commission business and is not
"anti-business."
1) Upon his appointment, Mr.
Waltz advocated a reverse position
concerning the city dredge. It was
his belief that with qualified help,
the city dredge could perform an
unparalleled service with unparal-
leled lower costs. The city now has
a fine dock labor force and this
group has visibly produced as-
tounding results.
Now! I wish to become positive
and inform you and the publiC
what Mr. Waltz has stood for and
how the dty has profited during
his tenure of office.

With your indulgence, let us
examine the main arguments ad-
vanced against Mr. Waltz by the
vocal minority. They can be sum-
marized as follows:
When Mr. Waltz was appointed
in 1960 on a split vote, the argu-
ments used against him, and these
can be found in the official record,
were that he was against every-
thing done to date at the Industrial
park and secondly, that he had
personal interests which might
conflict with his official duties.
His great efforts of river front
development and the record refute
the first argument. As to his hav-
ing conflicting interests, the vocal
minority would have pounced on
this were there any truth or even
half-truth for that matter, in the
claim_ Both claims have no truth
as a basis and do not rate further
elaboration.
Another argument advanced is
that Mr. Waltz improperly con-
ducted himself in the payment of
bills contr,acted by the Dock Com-
mission. If I were in Mr. Waltz's
place, I too would have questioned
the bulk of those bills also. It was
not pointed out that the bulk of
these bills were old ones, con-
tracted for by the predecessors of
Mr. Waltz. That some of them were
older than two years, th~t some
of them were not lived up to. In
some cases there were outright
violations of the contract. The vo-
cal minority would have preferred
that Mr. Waltz not get inquisitive,
that, instead, he just sign his name
to warrants amounting to tens of
thousands of taxpayer's money. If
he handled the financial affairs of
the Commission as they would
have preferred, I would be here
fighting against his re-appoint-
ment. Today, after scrutiny and
negotiation, all the old bills are
paid. Today, the Dock Commission
is run on a business-like operation
that the public can be proud of.

to ten you tbat 1 think the Du-
buque Dock Commission, and you
especially, have been doing a fine
conscientious job.
From our past conversations and
negotiations, I know that you have
a keen awareness of the short, and
long term problems of business,
and the applications of sound busi-
ness procedures to the solution of
these problems.
I am also fully aware that the
tedious, monotonous and non-con-
troversial items you and the Dock
Commission are faced with, get
little or no attention, or praise.
While on the other hand, it is
easier for everyone to offer a bet-
ter solution, or worse, unfair criti-
cism, of any matter tinged with
controversy.
Again, I wish to state my appre-
ciation of your doing a thankless
job in a very commendable man-
ner.

NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of
the City of Dubuque, Iowa:
Section 1. That said sewer is
hereby accepted by the City of
Dubuqne and that the same be
hereafter a public sewer under
the exclusive charge and control
of tbe City of Dubuque.
Section 2. That the acceptance of
said sewer by tbe City of Dubuque
and the establishment of said sew-
er as a public sewer shall not
be construed to relieve Orchard
Hills Inc., Henry J. Kieffer, Pres.,
or their contractor, or their bonds-
men from their obligation, or the
obligation of anyone of them to
keep said sewer in good repair for
a period of not less than four years
from the date of this resolution as
provided in Resolution No. 279-61.
Section 3. That hereafter any
person or persons desiring to con-
nect with said sewer, shall first
apply to the City Manager for per-
mission to do so and such permis-
sion --shall be granted upon condi-
tion that the applicant sbal1 pay to
the City Treasurer for the account
of Orchard Hills, Inc., Henry J.
Kieffer, Pres., a connection charge
of $3.08 per front foot of land to
be served by said connection. How-
ever, nothing in this resolution
shall be construed to exact any
charge for any extension of said
sewer by the City of Dubuque or
its permittees.
Section 4. That the City Clerk
be and be is bereby authorized and
directed to record a certified copy
of this resolution in the Office
of the County Recorder of Du-
buque County, Iowa.
