the City for citizens and permits
of all types. We should review
this revenue realistically and ob-
jectively. While we should not un.
fairly penalize those citizens pre-
vailing on the City for these ser-
vices we should bring their charg-
es to date. Financial analysts point
out that many cities have neg-
lected to advance these charges
proportionally with the raises of
non-city charges. That it is incum-
bent for cities to check this area
of revenUe and advance it fairly
so that it is in the best interest
of all citizens.
In conclusion may I say that the
position of Mayor could be tedious
and exasperating. I can report to
you that such has not been true in
my case. With little exception, I
have found the citizens of Dubuque
to be highly indulgent and ex.
tremely cordial. My year as Mayor
has also been eased by Our highly
competent staff. I wish to thank
them collectively and particularly
those whom I have worked with
closely this year.
The final means of increasing
revenue is by .an increasing tax
base of property evaluations. Tbe
residential increase is Dot the an~
swer most people believe it to be.
More homes provide more taxes
but they also increase city ex~
pense greatly. More inspections,
fire and police personnel, more
equipment of all types, and greater
administrative needs. This type of
increase is important to an ex-
panding community but we need a
corresponding increase in commer-
cial evaluations. This type of
growth requires minimal increases
from the City and provides a more
desirable type of revenue. We
must expend every effort to en-
courage commercial re.building
and new building. We must be
ready to lend every type of assist-
ance in obtaining new industry for
our town. This means we must as.
sume a more active role in this
respect than we have in the past
because this is the most import-
ant task facing DUbuque. Greater
commercial evaluation will allow
our City to develop succeSSfully
without vast tax increases being
imposed on the already burdened
property owner.

City's growth and development.

tion will be made on the work and
effort of the City Manager. It
must not be forgotten that in the
Council-Manager form of govern-
ment the Council controls policy
and that policy in a large meas-
ure dictates the tempo.
In the area of revenue we face
our greatest problems. For this
year, 1961, we have provided the
taxpayer relief by holding taxes
to last year's level. Those familiar
with budget making, such as the
Chamber of Commerce tax com-
mittee, realize the effort to ac-
complish this feat. Balances were
diminished, certain fund allot-
ments were abolished and overall
efficiencies were injected. Future
budgets will not provide the same
degree of technique in all of these
same areas and it is an inevitable
fact that the cost of city business
will follow the dictate of inflation
just as it does in a business or in
a household.
We must re-evaluate our finan.
cial position. There are two areas
from which the City receives reve-
nues- Taxes and income from ser-
vices. It is the conclusion of mu.
nicipal financial analysts that the
property tax which supports most
cities financially is fast becoming
obsolete. Progressive states are
realizing this fact and are allow-
ing municipalities to levy newer
types of taxes to alleviate the bur-
den of the property owner. Nearly
all of the newer type taxes are
broader based and they include
the Don-resident who, thus, pays
his share for using the facilities
of the City. Sale taxes, service
taxes, and City income taxes are
a few examples. To augment a
change in tax levying, we must
actively present the problem to
the legislature. We are, at present,
attempting to persuade the legis-
lature to give us a fairer share of
the road use tax. A larger amount
6f the gas tax will allow city im-
provement of our streets, which
we need so badly as we prepare
for the future.

During the past year, the Coun-
cil hired a professional administra-
tor to actively direct the work of
the City. We have found that he
is a man well known in the ranks
of his profession and greatly re-
spected for his abilities. We have a
responsibility to provide him with
necessary up-ta-date administrative
tools to do the job he is highly
capable of doing. There is a great
need to re-design department ac-
commodations to correct over-
crowding and to improve the effi.
ciency of the staff. Added person'
nel will be required due to the
increasing volume of work. The
most obvious example is the pre-
ponderance of work of the City
Clerk's office and his need for an
assistant. It is expedient that we
start preparing for a fulHime plan-
ning staff. The need for such a
department is not off in the long
future but at the present time due
to the expansion of the City and
the multitude of problems there-
by created. The road study report
of the State, recently released, in-
dicated a recommendation for each
City of 50,000 or more people to
employ a full time traffic engi-
neef. Our problems with traffic
and it's circulation are just begin-
ning and it will not be sufficient
to cope with this engulfing prob.
lem as we have in the past. Prop-
er staffing and planning in this
area will bring greater efficiency
and less cost to the taxpayer in
the long run. We should develop
within our police force a trained
unit specializing in the handling
of juveniles. Cities which have
moved in this direction report
most favorably in this action.

We, the officials of the City must
increase our effort in public rela-
tions beyond the limits of the City.
Weare dependent upon the Coun-
ty, State and Federal governments
for aid and cooperation in many
areas. We can be more successful
by a concerted effort to improve
and extend our influence thru
wholes )me and sincere public rela-
tions.
This Council has started in the
right direction by having the out-
moded building and corrolating
codes revised and up-dated. We

stated that this is an adjourned
meeting of the regular meeting of
January 2, 1961, being the first
meeting of the fiscal year, for the
purpose of acting upon such busi.
ness as may properly come before
a regular meeting of the City
Council.
Mayor Takos read the follOwing
report and requested that it be
made a matter of record.
Gentlemen:
With your permission, I wish
to submit the following report as
my last as mayor. In 1960, we laid
the groundwork for a variety of
necessary projects including annex-
ation, urban renewal, downtown
improvements, flood control and
civil defense. The ultimate success
of these programs or any others
dealing with our citizens is largely
dependent upon healthy public re-
lations. Without the trust and con.
fidence of the citizenry many
worthwhile and necessary projects
are necessarily defeated. Officials
in this situation can only assume
they have failed in the pursuit of
their office. The Public is fully
entitled to know the direction their
officials are leading to. This is part-
icularly true of the projects of a
long range and comprehensive na-
ture which are vitally necessary
for the proper development of
the community. We should con.
tinualIy urge the public to keep
as informed of the business of the
City as it possibly cart. If our com-
munity is intelligently informed
and the people remain active in
seeking information, the Council is
in a much better position for ob-
taining civic betterments.
We must encourage a greater
degree of public relations between
the city work force and our citizens.
Every city worker must recognize
the necessity of this effort as well
as the department heads who

Mr. Richard Kaiser, president of
the firefighters association, ad.
dressed the Council by stating that
there was no objection to the
amount of the proposed raise in
the various steps of the pay plan
but they did object to procedure
and the present plan is deviating
from the original or former plan
on the various step raises. Fire-
man Strohmeyer stated that their
basic objection was the loss of a
concession that they had for years.
Mr. R. F. Sefzik addressed the
Council by stating that for the
amount of hazards involved the
fireman should be entitled to ad.
ditional compensation. Policeman
Gene Digman was of the opinion
that when a man is promoted he
should receive the pay, and patrol-
man Marc Lammer concurred in
his remarks. Mr. Wm. Pecoy of the
city garage groUp addressed the
Council relative to the loss of paid
hOlidays.

The Pay Plan is essentially the
plan adopted by the Council in
1958 except each classification has
been increased in amount by mov-
ing the 1958 plan upward two
steps.

and other sources of revenue to the expenditures for City Govern_
ment in the City of Dubuque, for the fiscal year beginning Janua.ry
I, 1961 and ending December 31, 1961 and authorizing certain transfers
of funds.
Be It Ordained by the City Council of the City of Dubuque:
Section 1. That there is hereby allocated and appropriated from
the estimated revenues from all tax levies In the City of Dubuque,
together with the estimated receipts from sources other than taxation
and unencumbered balances from the fiscal year of 1960. all aa
hereinafter set forth, to the payment of the necessary expenditures
of the city government in the fonowing amounts and for the purposes

of the course is completed it can
be estimated that operations and
maintenance expense will be $30,-
000 in 1962. I will use the latter
figure for the purposes of this

Council of the City of Dubuque
that pursuant to a resolution of
necessity No. 259-60 which w.as duly
passed by this Council, for the
construction of an eight inch (8")
sanitary sewer beginning at the
existing sanitary sewer in St.
Anne's Drive, thence northerly
through Lot 2 of Lot 1 of Lot 1 of
Chaney Place to Lot No. 1 of Lot
2 of Wilbricht Place, thence west-
erly to Lot NO.2 of Lot 1 of Lot 3
of Mineral Lot 261, be and the
same are hereby ordered and con-
structed by this Council upon its
own motion and with or without
the petition of property owners.
Ail the work shall be constructed
in accordance with the plans and
specifications heretofore adopted
and now on file in the office of
the City Clerk.
BE IT FURTHER RESOLVED
that the cost and expense of the
said improvements be paid for by
levying special assessments against
the privately owned property lying
within the assessable distance from
the improvements, whether such
property abut upon the same or
are adjacent thereto, according to
the area thereof and in proportion
to the special benefits conferred,
and any deficiency will be paid
out of the sewer funds of the city.
Payment will be made to the con-
tractor out of funds realized front
the sale of bonds or with Sewer
Bonds to be issued in anticipation
of deferred payments of assess~
ments as provided by law after the
work has been completed and ac-
cepted by the City Council.

the backing up of sewer into his
basement which occurred on Sep-
tember 18, 1960.
All of the foregoing claims were
referred to the City Solicitor for
investigation and report.
I have made aD investigation of
this matter. and conferred with
Mr. Cletus Allen, Street Commis-
sioner, and also conferred with the
Engineers and it is my opinion that
there was no actionable negligence
on the part of the City to support
the respective claims and it is the.
recommendation of the City Attor-
ney that said claims be denied.
My investigation discloses that
Mr. Walter Wilhelm, a local con-
tractor. who was extending the
Roosevelt Street sanitary sewer at
the north end thereof, permitted
a line to remain open and as a
conse.quence the rains caused mud
and sediment to be deposited in
said line and that thereafter he at-
tempted to flush out said line by
opening two fire hydrants which
caused silt and sewerage to back
up into the respective basements.
I have written to Mr. Wilhelm
on this date directing his attention
to this matter together with a copy
of this opinion and also dire.cting
him to take the appropriate mea-
sures with respect to the aforemen-
tioned claims.

constructed In accordance wit h

partment of Health and the City
Manager and under the supervi_

Manager and City Engineer;
(C) That Grantee has entered
into a contract for the construc-
tion of said sewer with a quali-
fied contractor which contract,
among other things, contains a
clause requiring the contractor to
obtain all necessary permits re-
quired by the City of Dubuque or
any other governmental agency,
a clause obligating the contractor
and his bondsmen to keep said
sewer in good repair for a period
of not less than two years from
the date of the acceptance of the
work, and a clause requiring the
contractor to furnish a surety
bond with the City of Dubuque
named as one of the obUgt>es,
guaranteeing the faithful perform-
ance of said contract;
(D) That upon completion of
said sewer and the acceptance of
the same by the City Council saId
sewer shall become a pUblic sewer
under the exclusive charge and
control of the City of Dubuque,
and its free use as such shall not
be interfered with by grantee or
his successors or assigns:
Section 2. That the authority
granted therein shaH terminate on
February 20, 1961, unless the terms
and conditions of this Ordinance
are accepted in writing by the
grantee prior to that date;
Section 3. After said sewer has
been completed aDd the total cost
thereof has been paid by grantee,
the grantee herein shall file with
the City Council a certified state-
ment, showing in detail all amounts
paid out by him in connection with
the construction of said sewer, in_
clUding engineering fees and the
cost of restoring the surface of the
street. Thereafter, any person or
persons desiring to connect with
said sewer except the grantee here-
In, shall first apply to the City Man-
ager for permission to do so, and
such permission shall be granted
upon condItion that the applicant
pay to the City Treasurer, for the
account of the grantee herein a
connection charge in an amount
wh1ch will be fIxed by resolution
of the City Council at the time
of the acceptance of the s aid
sewer. However, such connection
charges shall not he exacted for
any extension of said sewer made
by the City of DUbuque or its
permitees.
Section 4. This Ordinance shall
be In full force and effect from
and after its final passage, adop-
tion and publication as provided
by law.

WHEREAS, certain real estate
was acquired by the City of Du-
buque, Iowa, from the Dubuque
Community School District of Du-
buque County, Iowa, in connection
with the extension of North Grand-
view Avenue. and
WHEREAS, it appears to the
City Council that said real estate
hereinafter described is of no fur-
ther need to the City of DUbuque
and that same should be conveyed
to the Dubuque Community School
District of Dubuque County. Iowa,
and
WHEREAS, the proposal to dis-
pose of said real estate coming on
for hearing at the Council Cham-
ber of the City of Duhuque. on
January 16, 1961 at 7:30 o'clock
P.M. pursuant to published notice
and there being no written ob-

WHEREAS, the City Council of
the City of Dubuque, Iowa has by
Resolution No. 14-61 given its pre-
liminary approval on the proposed
plans, specifications and form of
contract and placed same on file
in the office of the City Clerk for
public inspection, for the construc-
tion of the Fengler Street Over-
pass and Approaches and,
WHEREAS, the proposed Reso-
lution of Necessity for said im-
provement has been introduced
and is now on file in the City
Clerk's office for public inspec-
tion,
BE IT THEREFORE RESOLVED
that the City Clerk be and he is
hereby ordered and directed to ad-
vertise for proposals for the con-
struction of the various improve-
ments herein provided for in the
manner provided by law, the said
improvements shall be completed
on or before 90 days after notice
to proceed is issued.
BE IT FURTHER RESOLVED
that on the 20th day of February,
1961, a public hearing will be held
at 7:30 0'e1ock P.M. in the Council
Chamber in the City of Dubuque
at which time the owners of prop..
erty subject to assessment for the
proposed improvement may appear
and make objection to the pro-
posed plans and specifications and
proposed form of contract and at
the same time to the boundaries
of the proposed district, to the cost
of the improvement, to the amount
proposed to be assessed against
any lot and to the passage of the
proposed Resolution of Necessity,
and the City Clerk be and he is
hereby directed to cause a notice
of the time and place of such
hearing to be published in some
newspaper published in the City of
Dubuque, the last of which shall
be not less than two (2) nor more
than four (4) weeks prior to the
day fixed for its consideration and
unless property owners at the time
of final consideration of said reso-
lution have on file with the Clerk
objections to the amount of the
proposed cost, they shall have
been deemed to have waived all
objections thereto, at which hear-
ing the Council will hear such ob-

BE IT THEREFORE RESOLVED
that the City Council on its own
motion or upon petition of prop-
erty owners, deems it advisable
and necessary for the public wel-
fare to make the herein men-
tioned improvement, and unless
property owners at the time of the
final consideration of this pro-
posed resolution have on file with
the City Clerk objections to the
amount of the cost of improve-
ment, they shall be deemed to
have waived all objections there-
to.
