Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant, Dave Schneider, spoke in favor of the request, reviewing the area to be platted
and the location of the access easement relative to U.S. Highway 20 frontage.
Staff reviewed the staff report, noting the property was within the IDOT Highway 20 Corridor
Preservation Zone, and that the ]DOT has been consulted and indicated they have no interest in
acquiring the property. Staff noted that changes in the plat for the access easement required
the Zoning Advisory Commission to review the previously approved Plat again.
The Zoning Advisory Commission discussed the request and found it appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 12- 15
APPROVING THE FINAL PLAT OF SIEGERT'S PLACE FIFTH ADDITION IN THE CITY
OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk the Final Plat of Siegert's Place Fifth
Addition in the City of Dubuque, Iowa; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statues and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Final Plat of Siegert's Place Fifth Addition is hereby approved,
and the Mayor and City Clerk are hereby authorized and directed to endorse the approval
of the City of Dubuque, Iowa upon said Final Plat, subject to the following conditions:
1. William A. and Janet L. Siegert (Siegerts), owners of the property in Siegert's Place
Fifth Addition (the Siegert Property), have entered into a purchase agreement with
Richardson Investments (Richardson) for the purchase of Lot 3 in Siegert's Place Fifth
Addition. Siegerts and Richardson acknowledge that there is no access to Lot 3. It is
anticipated that the Iowa Department of Transportation will construct a frontage road which
will provide access to Lot 3. Siegerts and Richardson agree that the City of Dubuque by
approving the Final Plat of Siegert's Place Fifth Addition assumes no responsibility of any
kind for providing any access to Lot 3, and Siegerts and Richardson, jointly and severally,
agree to defend, indemnify and hold the City of Dubuque harmless from and against any
and all claims of any kind arising out of or relating to access or lack of access to Lot 3.
2. Siegerts and Richardson acknowledge that the existing farm access to the Siegert
Property in Siegert's Place Fifth Addition from U.S. Highway 20 may be eliminated in
connection with the reconstruction of U.S. Highway 20. By not later than June 1, 2016,
Siegerts and Richardson will provide the City of Dubuque with an executed copy of an
easement agreement providing access to the Siegert's property over and across Lot 3.
Siegerts and Richardson agree that the City of Dubuque by approving the Final Plat of
Siegert's Place Fifth Addition assumes no responsibility of any kind for providing any
access to Siegert's property, and Siegerts and Richardson, jointly and severally, agree to
defend, indemnify and hold the City of Dubuque harmless from and against any and all
claims of any kind arising out of or relating to access or lack of access to Siegert's
property.

SUBJECT: Final Plat Siegert's Place Fifth Addition
INTRODUCTION
The submitted Final Plat Siegert's Place Fifth Addition subdivides an existing 64.85
acres into three lots to facilitate the sale of Lot 3 for future development. The property is
located just southwest of the Menard's Store at 5300 Dodge Street. The property
included within the submitted Final Plat includes parcels on both sides of U.S. Highway
20. Lot 1, 14.29 acres, is located on the west side of U.S. Highway 20 and Lot 2, 37.08
acres, and Lot 3, 13.48 acres is located on the east side of U.S. Highway 20. A previous
version of this plat was reviewed and recommended for approval by the Zoning
Advisory Commission at their August 2014 meeting.
DISCUSSION
The submitted Final Plat of Siegert's Place Fifth Addition is to facilitate the sale of Lot 3
to Richardson Motors to provide a location for a new dealership. The subject property is
within both the U.S. Highway 20 Corridor Preservation Zone (CPZ) as well as the
Southwest Arterial Moratorium area.
The previously submitted Final Plat was submitted to the Iowa Department of
Transportation (IDOT) for their review as required by the U.S. Highway 20 CPZ. An
email from Sam Shea, Transportation Planner District VI, indicated that the IDOT would
not be exercising its acquisition authority under the U.S. Highway 20 CPZ at this time.
Mr. Shea noted that the IDOT will also review any future building permits for this
property. The revised Final Plat was resubmitted to Mr. Shea for the IDOT's review,
and the IDOT is still not interested in exercising their acquisition authority.
The three lots included within the submitted Final Plat all have the necessary frontage
on a public street as required by the Unified Development Code. Both Lot 1 and Lot 2
are served by existing farm access roads to U.S. Highway 20. Lot 3 will be seared by a
future frontage road constructed as part of the Southwest Arterial. Attached to this
memorandum is a preliminary plan from the IDOT that indicates the location of the

proposed frontage road that will serve Lot 3 in the future. No direct access to U.S.
Highway 20 from Lot 3 will be allowed by the Iowa Department of Transportation.
The projected timetable for beginning construction of the frontage road is 2016. The
frontage road and intersection improvements at U.S. Highway 20 and Old Highway
Road are funded as part of the U.S. Highway 20 Interchange Improvements for the
Southwest Arterial. The construction of the frontage road has been included in the Iowa
Department of Transportation's Five Year Transportation Program.
The resolution approving the Final Plat of Siegert's Place Fifth Addition is subject to two
conditions:
1) That should construction of the frontage road be delayed for any reason,
that neither the Siegert's nor Richardson Motors will file claim against the
City of Dubuque.
2) That an access easement be provided through Lot 3 to Lot 2 to facilitate
future use of Lot 2.
The second condition is important, as the IDOT will be purchasing the access rights
from the Siegert's for their existing farm access that currently serves the property
designated as Lot 2 on the submitted Final Plat. The second condition has been
complied with, and in fact necessitated the revision of the plat to accommodate the
access easement through Lot 3.
As previously mentioned, this property is also within the Southwest Arterial Moratorium
area. An amendment to the Southwest Arterial Moratorium area will be presented to the
City Council at their January 20 h meeting. The requirements of the moratorium
stipulate the City Council may not approve a plat within the moratorium area. The
proposed amendment would remove Lot 3 from the moratorium area. The review of an
amendment to the Southwest Arterial Moratorium is handled through the City Council.
No review by the Zoning Advisory Commission is required.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the submitted Final
Plat Siegert's Place Fifth Addition and recommend approval as submitted.
