Chief of Police Mark Dalsing recommends City Council approval of the School Year
2014/2015 DARE Agreement between the City of Dubuque Police Department and the
Dubuque Community School District. The Dubuque Community School District agrees
to provide financial support for the DARE Program by contributing $6,320.

Dubuque Community Schools, School Year 2014/2015
INTRODUCTION
The purpose of this memorandum is to seek approval of the FY2014/2015 DARE
agreement between the City of Dubuque Police Department and the Dubuque
Community School District. Dubuque Community Schools agrees to provide financial
support for the DARE Program by contributing $6,320.
BACKGROUND & DISCUSSION
For the past several years the Dubuque Police Department has provided DARE (Drug
Awareness Resistance Education) to the Dubuque Community Schools. Through the
DARE Program, the Dubuque Police Department provides specially trained police
officers to teach life skills and resistance techniques to middle school students with the
intent to better prepare the students to resist the pressures to use illegal drugs. As part
of this cooperative arrangement, Dubuque Community Schools will contribute $6,320.
Additionally, the agreement outlines the instruction and parent components of the
program. The normal practice is to obtain council approval at the beginning of the
school year; however, the review process by Dubuque Community Schools took longer
than anticipated. The contract was received from Dubuque Schools on January 14,
2015.
RECOMMENDATION
We recommend approval of the attached agreement between the City of Dubuque and
Dubuque Community Schools for the 2014/2015 school term, and accept the school
district's financial support of$6,320, retroactive to the start of 2014/2015 school year.

FOR
DRUG ABUSE RESISTANCE EDUCATION COOPERATIVE PROGRAM
FOR
SCHOOL YEAR 2014-2015
This Agreement, executed in triplicate, is entered into this 12th day of January,
2015, by and between the City of Dubuque, through its Police Department (City), and
the Dubuque Community School District (School District).
WHEREAS, City and School District have a strong desire and commitment to
reduce and prevent substance use among school children of the Dubuque community
through the continued implementation of the Drug Abuse Resistance Education
Cooperative Program (D.A.R.E. Program); and
WHEREAS, City presents D.A.R.E. Program to schools within the School District;
and
WHEREAS, School District desires to present D.A.R.E. Program at schools
within School District.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES AS
FOLLOWS:
1. Designated Schools. City will present the D.A.R.E. Program to Thomas
Jefferson, Eleanor Roosevelt, and George Washington Middle Schools.
2. Term. The term of this Agreement is from August 10, 2014 through June
14, 2015.
3. D.A.R.E. Program.
A. City will provide a ten (10) week D.A.R.E. Program that will teach
children at Thomas Jefferson, Eleanor Roosevelt, and George
Washington Middle Schools life skills and resistance techniques to better
prepare the children to resist the pressure to use drugs. The D.A.R.E.
Program will be taught by specially trained officers and the curriculum will
be designed to give students learning experiences through audio, visual,
and kinesthetic learning modalities, utilizing role playing and role modeling
as reinforcement tools.

B. City will spend informal time with the students during recess and
lunch to build rapport and encourage interaction.
C. City will provide a graduation program for those students
successfully completing the D.A.R.E. Program.
D. City will provide a Parent Training Program at least one (1) hour in
length. The Parent Training Program will provide an overview of the
D.A.R.E. Program, address parenting skills, identify some of the common
drugs used in Dubuque, and address gang concerns/prevention.
E. City will provide all D.A.R.E. Program materials and supplies,
including workbooks, graduation materials, and information packets, with
the exception of some art supplies used for some follow-up assignments.
4. Evaluation. City, in cooperation with School District, will provide evaluation
of the D.A.R.E. Program. Such evaluation will be available to School District and
City. City will provide feedback to the school staff and School District, and School
District will provide feedback to City.
5. D.A.R.E. Program Location.
A. School District will provide the premises and classroom time required for
the proper implementation of the D.A.R.E. Program. Premises will include the 6th
and 8th grade classrooms, other classrooms as agreed upon, the gym as
required, and other such premises as needed for student/parent education in
regard to the D.A.R.E. Program.
B. Classroom time. Classroom time (45-60 minutes) will be allotted for the
middle school curriculum class in each school. School District will further allow
City to use the furniture and equipment contained in the areas defined above and
other equipment such as audio visual equipment.
6. Consideration. School District will provide financial support to City for use
in implementing the D.A.R.E. Program in the amount of Six Thousand Three
Hundred Twenty Dollars ($6,320.00) as follows.
A. City will invoice School District by November 15, 2014.
School District will pay City by December 15, 2014.
Amount due is 50% ($3,160.00) of contract.
B. City will invoice School District by March 15, 2015.
School District will pay City by April 17, 2015.
Amount due is 50% ($3,160.00) of contract.

7. Termination. Any party may terminate this Agreement for any reason by
providing written notice of intent to terminate this Agreement to the other party
not less than ten (10) days prior to the beginning date of each semester of the
school year.
8. Compliance with applicable Laws. City and School District will not engage
in discriminatory hiring or any other employment practices that conflict with any
local, state, or federal laws.
9. Insurance and Indemnification.
A. City must maintain its membership in the Iowa Communities
Assurance Pool and add School District as an Additional Member. If City
discontinues its membership in ICAP, City will provide proof of a similar
policy of commercial general liability form coverage not less than
$2,000,000 naming School District as an additional insured on a primary
and non-contributory basis.
B. School District must provide proof of a policy of commercial general
liability form coverage not less than $2,000,000 naming City as an
additional insured on a primary and non-contributory basis.
C. City will indemnify and hold School District, its staff, and students
harmless from and against any and all claims, liability, and causes of
action arising from or related to the City's negligence in the performance
of this Agreement and the negligence of City's officers, agents, or
employees.
D. School District will indemnify and hold City harmless from and
against any and all claims, liability, and causes of action arising from or
related to the School District's negligence in the performance of this
Agreement and the negligence of School District's officers, agents, or
employees.
