Van Milligen, City Manager SUBJECT: 2056 Washington Street DATE: January 26, 2015 In 2006, Jesseca L. Zaruba purchased the property located at 2056 Washington Street with the assistance of loans totaling $52,333.17 from the City through the CDBG Program. These loans consisted of forgivable loans, deferred loans, and low interest loans. The current outstanding balance is $36,919.00. Ms. Zaruba was unable to maintain payments on the loan beginning back in 2008. Several attempts were made to help the Owner get back on track financially and resume mortgage payments, but all efforts were unsuccessful. Fearing foreclosure, Ms. Zaruba abandoned the property and left Dubuque approximately two years ago. Additional efforts were made to work with the Owner following abandonment, but those efforts were also unsuccessful. To avoid the property falling into disrepair, to eliminate the presence of an abandoned property in the Washington Neighborhood, to avoid foreclosure for the owner, and to ultimately return the property to a new owner/occupant, Ms. Zaruba has executed a Quit Claim Deed transferring the property to the City in consideration for foregiveness of the balance of the mortgage and in lieu of foreclosure of the mortgage. The City will rehab and resell the property to an income qualifying family. This plan is consistent with the Washington Neighborhood Strategic Plan adopted by the City Council in 2009 and the City's efforts to increase homeownership opportunities in the Washington Neighborhood. Background In 2006, Jesseca L. Zaruba (the Owner) purchased the property located at 2056 Washington Street with the assistance of loans totaling fifty-two thousand three hundred thirty-three dollars and seventeen cents ($52,333.17) from the City through the CDBG Program. These loans consisted of forgivable loans, deferred loans, and low interest loans. The current outstanding balance is thirty-six thousand nine hundred nineteen dollars ($36,919.00). The Owner was unable to maintain payments on the loan beginning back in 2008. Several attempts were made to help the Owner get back on track financially and resume mortgage payments, but all efforts were unsuccessful. Fearing foreclosure, the Owner abandoned the property and left Dubuque approximately two (2) years ago. Discussion The property needs minimal rehabilitation and is eligible for rehabilitation under the Washington Neighborhood Incentives Programs. Staff expects a post-rehab sale price of approximately eighty thousand dollars ($80,000.00). Selling the property to an income qualifying household eliminates a vacancy in the neighborhood, and encourages home ownership in the neighborhood. Action Step The action requested of the City Council is to approve the attached resolution authorizing the City to accept a Quit Claim Deed to the property located at 2056 Washington Street. KLN 2 RESOLUTION NO. 29-15 RESOLUTION APPROVING THE ACCEPTANCE OF A DEED TO REAL ESTATE IN THE CITY OF DUBUQUE OWNED BY JESSECA L. ZARUBA Whereas, Jesseca L. Zaruba is the owner of certain real property located at 2056 Washington Street and legally described as: Lot 2 of HEART PROJECT PLACE, in the City of Dubuque, Iowa, according to the recorded Plat thereof and Whereas, the City of Dubuque, through its Housing and Community Development Department, granted the Owner a mortgage for the purchase and improvement of the Real Estate; and Whereas, in consideration for forgiveness of the balance of the mortgage and in lieu of foreclosure of the mortgage, the City of Dubuque and the Owner mutually agree that the Owner will convey all right, title and interest in the Real Estate to the City of Dubuque; and Whereas, the Owner has voluntarily executed a Quit Claim Deed, attached hereto, conveying the Real Estate to the City of Dubuque. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City Council of the City of Dubuque, Iowa hereby accepts the Quit Claim Deed attached hereto. Section 2. That the City Clerk be and is hereby authorized and directed to cause said Quit Claim Deed to be recorded in the office of the Dubuque County Recorder, together with a certified copy of this Resolution. Section 3. That the City Clerk be and is hereby directed to forward a copy of this Resolution to the Dubuque County Assessor and the Dubuque County Auditor.
