INTRODUCTION
This memorandum transmits the Final Plat of Derby Grange Acres, a resolution, and
related materials for City Council review and approval. The submitted Final Plat of
Derby Grange Acres is a new subdivision located on the north side Derby Grange Road
in Dubuque County. The City and County of Dubuque are jointly reviewing this Final
Plat as it is within two miles of the city's corporate limits. The City Council approved the
preliminary plat for this subdivision on March 2, 2015.
DISCUSSION
The submitted Final Plat of Derby Grange Acres creates 14 new single-family building
lots and constructs two new private streets to be named Country View Drive and
Country View Court. Both private streets will be built with a 22-foot of paving width
rather than the County standard of 26-foot paving width. The smaller paving width
reduces the amount of permeable surface and 22-foot is still adequate to serve the 14
building lots.
The proposed new Country View Drive will access Derby Grange Road and complies
with SUDAS standards for sight visibility. The applicant's engineer has provided the
necessary documentation to the City Engineering Department, which has confirmed that
the new access will meet SUDAS standards.
The subject subdivision complies with the Unified Development Code's 40 points of
sustainability through a mixture of sustainable tools.
1) 22-foot wide private street— 5 points.
2) 50% of new dwellings will meet Iowa's Green Building Code — 5 points.
3) Minimum tree planting requirements on private property— 5 points.
4) Reduced grading — 5 points.

5) Amended soils on each building lot — 10 points
6) Compliance with the Dubuque County's Erosion and Sediment Control and storm
water management manual — 10 points.
TOTAL = 40 points
The submitted subdivision does provide sufficient easements to allow for the future
extensions of City water and sewer to the individual building lots. This ensures that the
City will not need to acquire individual easements from future property owners at such
time as City utilities are extended to serve the subdivision. The City Council approved a
pre-annexation agreement for the subdivision on March 2, 2015.
RECOMMENDATION
Staff recommends approval of the resolution for the Final Plat of Derby Grange Acres
subject to allowing 22-foot paving width for Country View Drive and Country View Court,
a 25-foot lot frontage for Lot 6, and waiving Sections 11-20 Water Supply, 11-21
Sanitary Sewer, 11-23 Obligation to Install Improvements, and 11-24 Improvement
Guarantees. The submitted Final Plat is in all other respects in compliance with the
Unified Development Code.

Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use Element Goal 1.2, 1.5, 1.8, 4.3, and 10.2.
Impact of Request on:
Utilities: The proposed Derby Grange acres Subdivision will utilize individual septic
systems for each building lot and will have shared wells within the subdivision for
water service.
Traffic Patterns: Access to the proposed subdivision will be off of Derby Grange
Road. Based on 2009 IDOT vehicle counts, there were 1,420 average daily trips
on this portion of Derby Grange Road's intersection with John F. Kennedy Road.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided there is compliance with the Dubuque County Erosion and Sediment
Control Manual.
Adjacent Properties: Staff anticipates the most noticeable impacts to adjacent
properties will be a change in the visual nature of this property with a change from
open space to residential housing, and an increase in vehicle trips on Derby
Grange Road. Staff estimates that the 14 new building lots, when fully built out with
single-family homes, will generate approximately 140 average daily trips.
Recommended Conditions on Plat: None.

Staff Analysis: The submitted Final Plat of Derby Grange Acres is located on the north
side of Derby Grange Road immediately west of the Derby Grange Recreation facility.
The proposed subdivision will include 14 new single-family building lots and the
construction of two private streets. The subject subdivision is jointly reviewed by both
the City and County of Dubuque as it is within two miles of the city of Dubuque's
corporate limits.
The Final Plat of Derby Grange Acres encompasses 18.5 acres. Access to this
proposed subdivision will be from a new private street to be named Country View Drive.
In addition, another street to be named Country View Court will create a T intersection
with cul-de-sacs at either end. The applicant's engineer has provided documentation
that the proposed intersection with Derby Grange Road will comply with SUDAS
standards for sight visibility.
The proposed private streets within Derby Grange Acres Subdivision will be built with
22 foot of paving within a 66-foot right-of-way easement. The proposed cross section
of the new floodways will have typical drainage swales to manage storm water. Both
private streets will be built with concrete.

The submitted Final Plat includes one single-family building lot with a substandard
street frontage, Lot 6. The street frontage at the right-of-way easement is 25-foot,
where the city standard is a 50-foot street frontage. Planning staff does not object to
this proposed layout given the size and layout of the subject lot.
Planning Services Department has reviewed the proposed Final Plat for compliance
with the City's sustainability requirements. The submitted Final Plat of Derby Grange
Acres proposed the following sustainable subdivision development tools.
Proposed Sustainable Development Tools:
1) 50% of new homes will be built in compliance with the State of Iowa
Green Building Code. — 5 points
2) The two proposed private roadways will be built to 22-foot wide reducing
storm water runoff— 5 points
3) The covenants for the subdivision will require minimum tree planting on
each lot— 5 points
4) The site grading will be reduced to the minimum necessary to construct
country View Drive and country View court— 5 points.
5) Compliance with Dubuque County stormwater management ordinance —
10 points.
6) Use of amended soils on each building lot— 10 points
TOTAL: 40 points
Planning staff is willing to allow the 10 points for compliance with the County
stormwater management. The County Ordinance requires that the first 1.25 inches of
rain be infiltrated on site. This requirement is more stringent than current City
requirements. j
The developers of the proposed subdivision were required to sign a pre-annexation
agreement with the City. This agreement stipulates that when the City proposes to
annex the property, the property owners, existing and/or future, will agree to the
annexation. In return, the City portion of property taxes will be discounted on a sliding
scale for 10 years. The pre-annexation agreement was signed by the developers and
approved by the City Council at the March 2, 2015 meeting.
The proposed subdivision also provides sufficient easements to extend water and
sewer into the subdivision without the need of acquiring individual easements from each
property owner in the future.

RESOLUTION NO. 98-15
RESOLUTION APPROVING THE FINAL PLAT OF DERBY GRANGE ACRES IN
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Derby Grange
Acres; and
Whereas, said Final Plat provides for a 22 -foot pavement width for Country View
Drive and Country View Court, where 26 -foot paving width for a private street is required
by Section 11-15 of Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code; and
Whereas, said Final Plat provides 25 feet of frontage for Lot 6 on a public street or
an approved private street, where 50 feet is required by Section 11-14 of Title 16 of the
City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and has its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-15 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow two 22 -foot wide paved private
streets.
Section 2. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 25 feet of frontage on a public
street or an approved private street for Lot 6
Section 3. That the City Council hereby waives Sections 11-20 Water Supply, 11-
21, Sanitary Sewer, 11-23 Obligation to Install Improvements, and 11-24 Improvement
Guarantees.
Section 4. That the Final Plat of Derby Grange Acres is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein
named, execute their written acceptance hereto attached agreeing:
a) To construct private street improvements in accordance with improvement plans
approved by Dubuque County and certified upon completion by a professional
engineer licensed by the State of Iowa.
b) To maintain the private street improvements constructed as part of Derby
Grange Acres until such time as a homeowners association is formed and is
responsible for maintenance of the same.
Section 5. That in the event Arboretum Development, LLC fails to execute the
acceptance within 180 days after the date of this Resolution, the provisions hereof shall
be null and void and the approval of the plat shall not be effective.

of Survey for, DERBY GRANGE ACRES, comprised of Lot A and Lots 7 thru 11, inclusive, of Derby
Grange No. 3, located in the SE %, Section 8, T89N R2E of the 5th PM, Dubuque Township, Dubuque
County, Iowa; and
WHEREAS, said final plat will create fourteen (14) residential lots, namely Lot 1 through Lot 14,
inclusive, of Derby Grange Acres in Section 8, Dubuque Township, Dubuque County, Iowa; and
WHEREAS, said final plat has been examined and approved by the City of Dubuque and the City
of Dubuque Planning & Zoning Department; and
WHEREAS, said final plat has been examined by the Dubuque County Planning and Zoning
Commission, Dubuque County Board of Health, Dubuque County Engineer, the Dubuque County
Treasurer and the Dubuque County Plats Officer and has their approval endorsed, thereon;and
WHEREAS, said final plat has been examined by the Board of Supervisors of Dubuque County,

Section 2.
That the above described property is within the R-3, Single Family Residential district
and subject to all the requirements of that district.
That each lot will have a separate septic system and there will be no more than 3
shared wells. The covenants include management oversight of the water and
wastewater systems for this subdivision and will require a 3 -hole perc test on each
lot to be performed at the expense of the lot owner.
Section 3. That the streets shown upon said final plat are not accepted as Dubuque
County Streets and that Dubuque County shall assume no liability for their
design, construction and/or maintenance.
Section 4. That all of the lots will access off of the private roads. No additional access to
county roads will be allowed.
Section 5. That covenants, engineered road plans, erosion control, and stormwater plans
have been submitted and are approved. Each lot owner will be responsible for
retaining a 1.25" rainfall over a 24 hour period on their lot using a county approved
Best Management Practice (BMP).
Section 6. That the above described final plat be and is hereby approved and the
Chairperson of the Board of Supervisors is authorized and directed to endorse
the approval of Dubuque County, Iowa upon said final plat.
