Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer DATE: March 27, 2015 SUBJECT: City Acquisition of Utility Easements — Furuseth Property CIP 7102409 Granger Creek Sanitary Sewer Extension INTRODUCTION This memorandum seeks City Council approval of the Easement Agreement for the Furuseth property and to authorize the City Manager to execute the Grant of Easement for the proposed construction of the Utility Extension to the Dubuque Regional Airport. BACKGROUND The Furuseth Easement Agreement has been negotiated over the last year. An appraisal and review appraisal were completed for the easement area. Two separate appraisals were completed to value the walnut tree plantation and the spruce trees that are on and adjacent to the proposed sanitary sewer alignment. The walnut trees were valued as a crop (forestry approach) and the spruce trees were valued as a landscape feature because of the screening that they provide from the U.S. Highway 151/61. We propose to acquire permanent easements, temporary construction easements and access easements created for the purpose of constructing the sanitary sewer, performing clearing and grubbing and erosion control construction activities related to the construction of the sanitary sewer. Said proposed easement plats are shown in Exhibits A, B and C of the attached Offer to Buy We propose an 8" water main extension with a hydrant located adjacent to the Furuseth property. The extension will provide water service for a future subdivision on the Furuseth property. The subdivision is currently platted but undeveloped. The extension is shown in Exhibit D of the attached Offer to Buy. DISCUSSION The terms of the Offer to Buy are as follows: • Total purchase price: $33,338.75 payable at closing, comprised of: a. Permanent and Temporary sanitary sewer and Access easements: $7,026.00. b. Reimbursement for walnut trees: $16,814.00. c: Reimbursement for spruce trees: $ 9,498.75 BUDGET IMPACT The agreed cost for the permanent and temporary sanitary sewer easement along with the access easement and reimbursement for the trees being removed is $33,338.75. The budget fund code to support this portion of the project is: CIP 7102409 - Granger Creek Sanitary Sewer Extension Budget Amount: $4,294,090.94 Current Fund Balance: $4,174,113.52 Easement Amount: $ 7,026.00 Tree Reimbursement: $ 26,312.75 RECOMMENDATION I recommend approval of the easement agreement for the total of $33,338.75; and adoption of the attached resolution authorizing the City Manager to take such further action as is required to complete the purchase of the Easements. I also recommend accepting the Grant of Easement from Patricia F. Furuseth and adoption of the attached resolution accepting the Grant of Easement. ACTION TO BE TAKEN I request approval of the easement agreement for the total of $33,338.75; and adoption of the attached resolutions authorizing the City Manager to take such further action as is required to complete the purchase of the Easements. FURUSETH This Easement Agreement ("Agreement") is made and entered into this if day of itor2.044 , 2015 by and between the City of Dubuque, Iowa ("City") and Patricia F. Furuseth, the owner of certain property situated in Dubuque County, Iowa. WHEREAS, Patricia F. NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS: SECTION 1. PROPERTY OWNER APPROVAL. This Agreement is subject to final approval and execution by the Property Owner by not later than ky, I o53, MW , 2015. In the event that the Property Owner does not approve, execute, and deliver this Agreement to the City's City Manager by such date, the City in its sole discretion may determine whether or not to proceed with this Agreement. If the City determines not to proceed, then this Agreement shall be null and void. SECTION 2. CITY COUNCIL APPROVAL. This Agreement is subject to final approval by the City Council by not later than AM 1 I , 2015. If this Agreement is not approved by such date, it shall be null and void. SECTION 3. ADMINISTRATIVE COSTS. City agrees to pay the administrative costs associated with this Agreement, including the filing and recording costs. SECTION 4. EASEMENTS. 4.1 Property Owner will grant to City a permanent utility easement over 0.67 acres for extension of sanitary sewer ("Permanent Easement"). The Permanent Easement is described and set forth in the attached Exhibit A. 4.2 Property Owner will grant to City and its agents access to the Real Estate for the establishment of the temporary construction easements over 1.07 acres prior to receiving compensation. The temporary construction easements ("Temporary Easements") are described and set forth in the attached Exhibit B. 4.3 Property Owner will grant to City and its agents a permanent ingress-egress easement located in Lot 33 of Furuseth's Sixth Subdivision in the Northeast Quarter (NE 03102015maq '/4) of Section 23, Township 88 North, Range 2 East of the 5t" Principal Meridian, Dubuque County, Iowa. This permanent access easement ("Permanent Access Easement") is described and set forth in the attached Exhibit C. 4.4 City will pay Property Owner the appraised property value for compensation for the Permanent Easement and Temporary Easements granted to City. 4.5 Compensation: Permanent Easement $5,025.00 Permanent Access Easement $165.00 Temporary Construction Easement $1,836.00 Total Compensation $7,026.00 SECTION 5. WALNUT TREES. 5.1 The Real Estate contains a walnut plantation located along Elmwood Drive and parallel to Highways 61 and 151 south of Dubuque, Iowa in the area opposite of Tamarack Business Park. Several walnut trees lie within or along the edge of City right- of-way and will be removed for the construction of the City utility extensions. The City will compensate the Property Owner the appraised amount of sixteen thousand eight hundred fourteen dollars ($16,814.00) for the removed walnut trees. 5.2 City will mark the walnut trees designated for removal, and Property Owner will remove designated trees on or before April 20, 2015. Property Owner may keep wood from removed walnut trees. If Property Owner fails to remove by April 20, 2015, City will remove designated walnut trees. SECTION 6. NORWAY SPRUCE TREES. The Real Estate contains twenty-three (23) Norway spruce trees that will be removed for the construction of the City utility extensions. The City will compensate the Property Owner the appraised amount of nine thousand four hundred ninety-eight dollars and seventy-five cents ($9,498.75). SECTION 7. FENCE. City will replace the fencing that is disturbed during the course of construction. Existing openings in the fence will be reinstated in the replaced fencing so that the location of the opening remains the same. The City of Dubuque specifications (SUDAS) will be met when replacing the disturbed fencing. SECTION 8. GROWTH AND BRUSH. City will remove all growth and brush completely from easement areas. SECTION 9. CROP DAMAGE. For any crops other than the walnut and Norway spruce trees referenced in Sections 5 and 6 above, the City will reimburse Property Owner for any crops damaged during construction based on the following formula: (Disturbed area x Bushels per acre) x Dollars per bushel = Reimbursement to Property 3 Owner. Harvest yield and dollars per bushel must be provided by the Property Owner at the end of the affected growing season. SECTION 10. WATER SERVICE. City will extend water service along Elmwood Drive to service Property Owner and Real Estate as set forth in the attached Exhibit D. The property owner will be subject to a connection fee when any connection is made to the water main. The connection fee, for the existing residence on lot 2 in Furuseth's 81" subdivision, will be calculated using 70 linear feet (frontage) multiplied by the City's per linear foot rate applicable at the time of connection. SECTION 11. MAINTENANCE AND USE. 11.1 Owner reserves that right to make any and all uses of the Real Estate in the easement locations that do not interfere with the sanitary sewer and the City's rights granted herein. However, Owner will not plant trees, construct, or place any buildings or structures in the easement areas. City will install sanitary sewer facilities at least twenty-four inches (24") below the ground surface. 11.2 Any and all disturbance or damages on the Real Estate caused by the installation, repair, maintenance, or replacement of the sanitary sewer shall be restored by City at City's expense (provided, however, that City is not required to restore tree plantings), with sufficient ground cover and precautions to avoid erosion. SECTION 12. CONTROLLING AGREEMENT AND WRITTEN MODIFICATION. The parties agree that all understandings and agreements, if any, previously made between the parties hereto are merged in this Agreement, which alone fully and completely expresses their understanding with respect to the subject of this Agreement. This Agreement may not be changed or terminated orally, but only by an instrument in writing executed by the parties hereto. SECTION 13. BINDING AGREEMENT. This Agreement shall be binding upon and inure to the benefit of the parties hereto, their heirs, successors, and assignees and shall be recorded with the Real Estate and will apply to any subsequent plats and/or subdivisions of the Real Estate. SECTION 14. EFFECT OF INVALID PROVISION. If any provision of the Agreement is held invalid, such invalidity shall not affect any of the other provisions contained herein. SECTION 15. DEFAULT. 15.1 Failure by Property Owner to substantially observe or perform any material covenant, condition, obligation, or agreement on its part to be observed or performed under this Agreement constitutes an event of default ("Event"). 15.2 Whenever an Event occurs and is continuing, City may take any one or more of the following actions after giving written notice by City to Property Owner of the Event, 4 but only if the Event has not been cured within sixty (60) days following such notice, or if the Event cannot be cured within sixty (60) days and Property Owner does not provide assurances to City that the Event will be cured as soon as reasonably possible thereafter: A. City may suspend any part of or all of its performance under this Agreement until it receives assurances from Property Owner, deemed adequate by City, that Property Owner will cure its default and continue its performance under this Agreement; B. City may cancel and rescind this Agreement; C. Property Owner will reimburse City for all amounts expended by City in connection with the Agreement, and City may take any action, including any legal action it deems necessary, to recover such amounts from Property Owner; or D. City may take action, including legal, equitable, or administrative action, which may appear necessary or desirable to collect any payments due under this Agreement or to enforce performance and observance of any obligation, agreement, or covenant under this Agreement. SECTION 16. NOTICES.
