INTRODUCTION
This memorandum presents for City Council approval an agreement between the City
and a property owner, Doris A. Graf, for the inclusion of agricultural property in a
proposed expansion of the Dubuque Industrial Center Economic Development District.
BACKGROUND
In 2014, Greater Dubuque Development Corporation contracted with IIW to do site
evaluations of 20+ sites outside of the corporate city limits of Dubuque, Iowa, for the
purpose of identifying locations that would allow the City to promote economic
development activities. Sites were rated based on proximity to existing infrastructure,
amount of usable acreage, cost, and other factors. Results of this survey were
presented to the City, and Greater Dubuque Development Corporation contacted
several property owners to gauge their willingness to sell.
The need to amend the Dubuque Industrial Center Economic Development District
stems from the desire to utilize tax increment financing to facilitate both public and
private development efforts which can benefit from the use of tax increment financing in
the District. Pursuant to Iowa House File 2460 (2012), the plan will describe the specific
use of tax increment funds, reflecting the utilization of tax rebates, the creation of public
infrastructure, or other planned expenditures.
DISCUSSION
Urban renewal law requires that the City receive approval from the owners of impacted
agricultural land owners prior to inclusion in the Urban Renewal Area. According to
Iowa Code § 403.17(3), "agricultural land" is defined, in part, as real property owned by
a person in tracts of ten acres or more.....and has been used for the production of
agricultural commodities during three out of the past five years. As shown on the
attached map, there is one property owner that meet this definition: Doris A. Graf,
whose property is denoted as the proposed Subarea F.
After meeting with the property owner, she has consented to the inclusion of her
property within the proposed urban renewal boundary. Her signature is on the attached
agreement. The agreement states that the property owners authorize the City Council
to pass any resolution or ordinance necessary to designate the property as an urban
renewal area under Iowa Code Chapter 403.
RECOMMENDATION/ ACTION STEP
I recommend that the City Council approves the attached agreement with Doris A. Graf
for the inclusion of her agricultural property in the amended urban renewal area by
adopting the attached resolution.

RESOLUTION NO. 122-15
APPROVING AN AGREEMENT TO INCLUDE CERTAIN AGRICULTURAL LAND IN
AN AMENDED URBAN RENEWAL PLAN FOR DUBUQUE INDUSTRIAL CENTER
ECONOMIC DEVELOPMENT DISTRICT
Whereas, the City Council intends to consider an amended Urban Renewal Plan (the
Plan) under Iowa Code Chapter 403 and proceed with activities authorized under that
Chapter in the Dubuque Industrial Center Economic Development District (the District);
and
Whereas, Doris A. Graf owns agricultural land (the Property) as that term is defined
in Iowa Code Section 403.17(3) which requires that owners of such land must consent
to being included in the District; and
Whereas, Doris A. Graf desires to include the Property in the District; and
Whereas, Doris A. Graf has consented to the inclusion of her property in the District
through the execution of the attached Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Agreement between the City of Dubuque and Doris A. Graf is
hereby approved.

IN AN URBAN RENEWAL AREA
This Agreement dated for reference purposes the day of TO , 2015,
is made and entered into by and between the City of Dubuque, low (City), and the
undersigned property owner (Property Owner) for the proposed expansion of the urban
renewal area for the Dubuque Industrial Center Economic Development District
WITNESSETH:
WHEREAS, the City has adopted an Urban Renewal Plan under Iowa Code
Chapter 403 and proceeded with activities authorized under that Chapter in the area
described as the Dubuque Industrial Center Economic Development District, including
but not limited to the division of revenue under Iowa Code Section 403.19; and
WHEREAS, the undersigned Property Owner owns agricultural land as that term
is defined in Iowa Code Section 403.17(3); and
WHEREAS, the Property Owner desires that the Property be included in the
Dubuque Industrial Center Economic Development District; and
WHEREAS, a description of the Property to be included within the Dubuque
Industrial Center Economic Development District is attached hereto as Attachment A
and made a part hereof; and
NOW, THEREFORE, be it agreed between the parties hereto as follows:
1. The undersigned Property Owner agrees that the City may include the Property
owned by the undersigned Property Owner identified in the attached Exhibit A in the
Dubuque Industrial Center Economic Development District, including any portions which
may be defined as agricultural land under the provisions of Iowa Code 403.17(3).
2. The undersigned Property Owner further authorizes the City Council of the City
to pass any resolution or ordinance necessary to designate said property as an urban
renewal area under Iowa Code Chapter 403.
