Ware, Leisure Services Manager SUBJECT: Iowa National Guard Training Agreement at Roosevelt Park DATE: May 8, 2015 INTRODUCTION The purpose of this memorandum is to request City Council approval of a Usage Agreement with the Iowa National Guard allowing the Guard to do training at Roosevelt Park. DISCUSSION The Iowa National Guard started using this site for training in 2001. The site has worked out very well for them and supports the efforts of our military. Neither the Tri- State Modelers nor the Storybook Hill Children's Zoo is impacted by this Agreement. The termination clause allows us to end the agreement should we need to. Barry Lindahl, City Attorney and Frank O'Connor of O'Connor and English Insurance Agency have reviewed the Agreement and the necessary adjustments were made. RECOMMENDATION I recommend approval of the attached Usage Agreement with the Iowa National Guard. Agreement for the use of real property, referred to as the "real estate", located at; Roosevelt Park, Dubuque, IA 52001 2, PARTIES TO TIIIS AGREEMENT: In this Agreement, the Iowa National Guard shall be referred to as the "GUARD" and _City of Dubuque_, the owner of the land, shall be referred to as the "LANDLORD". 3, The GUARD and the LANDLORD also agree to the following: a. The GUARD'S use of the real estate described in this Agreement includes: training by GUARD personnel and units of the Iowa National Guard; and entry and exit from the real estate; b, The GTJARD's.use of the real estate shall be exclusive; that is, during those time periods when the GTJARD is using the real estate, the LANDLORD shall not allow any other person or entity upon the real estate without prior coordination with the training area commander. Site is located on the southeast side of the city. Site is mostly wooded with gently rolling hills, with one main streambed. . Activities: This site would be used to conduct small scale Infantry maneuvers. No heavy wheeled traffic is allowed in the park and tight -wheeled trate must stay on established park trails.
