The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant was not in attendance. Chairperson Norton stepped down from the table.
Vice Chairperson Henschel presided.
Staff reviewed that the Commission had previously reviewed a similar Plat of Surrey at their
April meeting. The new Plat of Survey shifted the lot line between Lots 1 and 2. Staff noted
that the Plat of Survey was deficient in having only 16 feet of lot frontage for Lot 2 where
City Code requires 50 feet. Staff reviewed that the shift of the lot line does not adversely
impact access to either lot and that the Plat of Survey is in all other respects compliant.
There were no public comments.
The Zoning Advisory Commission discussed the request and found it was appropriate.
Recommendation
By a vote of 4 to 0 with one abstention, the Zoning Advisory Commission recommends that
the City Council approve the request subject to allowing 16 feet of lot frontage for Lot 2.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of Lots 1 and 2 of Mihalakis Place No. 2
INTRODUCTION
The submitted Plat of Survey of Lots 1 and 2 of Mihalakis Place No. 2 re-subdivides two
existing parcels to shift the common lot line between them to facilitate the future sale of
Lot 2. The resulting Lot 2 does not have the required amount of street frontage as
required by the Unified Development Code.
The Zoning Advisory Commission previously reviewed and recommended approval of
this plat at the April 1, 2015 Commission meeting. The Plat of Survey has been
resubmitted to the Commission as the lot area for Lots 1 and 2 has been changed. City
Code requires that the Commission and City Council approve the same plat. The
changes in lot area necessitated that the Plat of Survey be resubmitted to the
Commission.
DISCUSSION
The submitted Plat of Survey of Lots 1 and 2 of Mihalakis Place No. 2 re-subdivides
approximately 2.7 acres of property located on Broadway Street in Dubuque, Iowa. The
submitted Plat of Survey shifts the common property line between the two parcels so
that the shared driveway is split between two parcels. Currently, the driveway is solely
on Lot 2 with an easement established for Lot 1. The submitted Plat of Survey places a
portion of the common lot line between the parcels down the centerline of the driveway
and grants each property owner an access easement.
The shifting of the lot line results in Lot 2 only having 16 feet of lot frontage, where 50
feet is required by Section 11-14(B) of the Unified Development Code.
Planning staff does not have any objection to the submitted Plat of Survey as the re-
subdivision of the property will not adversely impact either property and the placement
of the lot line down the centerline of the driveway helps ensure that each future property
owner is responsible for the maintenance of the common driveway.

Planning staff recommends the Zoning Advisory Commission review the Plat of Survey
of Lots 1 and 2 of Mihalakis Place No. 2 and recommend approval subject to the
waiving lot frontage requirement for Lot 2.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LOTS 1 & 2 OF MIHALAKIS PLACE NO.

Whereas, there has been filed with the City Clerk a Plat of Survey of Lots 1 & 2 of Mihalakis
Place No. 2 in the city of Dubuque, Iowa ; and
Whereas, said Plat of Survey provides 16 feet of frontage for Lot 2 on a public or approved
private street, where 50 feet of street frontage is required by Section 11-14 of Title 16 of the City of
Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is waived to allow 16 feet of frontage on a public street or an approved private
street for Lot 2.
Section 2. That the Plat of Survey of Lots 1 & 2 of Mihalakis Place No. 2 is hereby approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City
of Dubuque, Iowa upon said Plat of Survey.
