During the recent construction of the public sanitary sewer through Lot 38 in Timber-
Hyrst Estates No 4, it was discovered that the sewer alignment as originally designed
and approved conflicted with an existing drainage way.
City Engineer Gus Psihoyos recommends City Council approval of the Plat of Easement
for Sanitary Sewer and Storm Drainage over Lot 38 of Timber-Hyrst Estates No. 4 that
accommodates the revised alignment for the public sanitary sewer.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This memo provides information regarding the platting and acceptance of revised sanitary
sewer and storm drainage easements over Lot 38 in Timber-Hyrst Estates No. 4.
BACKGROUND
During the recent construction of the public sanitary sewer thru said Lot 38, it was discovered
that the sewer alignment as originally designed and approved conflicted with an existing
drainage way.
DISCUSSION
The developer's (North Cascade Road Developers, LLC) consultant (Buesing and Associates)
has submitted plans relocating the sanitary sewer alignment to address the conflict with the
drainage way and the Engineering Dept. has approved the relocation plans. The developer is
seeking approval of the attached plat of easement prepared by Buesing and Associates to
accommodate the sewer relocation.
RECOMMENDATION
recommend that the City Council approve the Plat of Easement for Sanitary Sewer and Storm
Drainage over Lot 38 of Timber-Hyrst Estates No. 4 in the City of Dubuque, Iowa, which
accommodates the revised alignment for the public sanitary sewer by the adoption of the
attached resolution.
ACTION TO BE TAKEN
I respectfully request approval of the Plat of Easement for Sanitary Sewer and Storm Drainage
over Lot 38 of Timber-Hyrst Estates No. 4 in the City of Dubuque, Iowa, and acceptance of the
dedication of said easements, through the adoption of the enclosed resolution.

RESOLUTION NO. 201-15
APPROVING THE PLAT OF EASEMENT FOR SANITARY SEWER AND
STORM DRAINAGE ON LOT 38 OF TIMBER-HYRST ESTATES NO. 4 IN THE
CITY OF DUBUQUE, IOWA
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, a Plat of Easement dated May 22, 2015 prepared by Buesing
and Associates Inc. revising the location of certain sanitary sewer and storm
drainage easement across Lot 38 of Timber-Hyrst Estates No. 4 in the City of
Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto;
and
Whereas, upon said plat appears easements for sanitary sewer and storm
drainage, which North Cascade Road Developers, LLC, by said plat have
dedicated to the public forever; and
Whereas, the dedication of said easements is necessary for the
accommodation of the relocated sanitary sewer alignment across said Lot 38.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That theplat of easement dated May 22, 2015 prepared by
Buesing and Associates Inc., relative to the real estate hereinabove described be
and the same is hereby approved, and the Mayor and City Clerk be and they are
hereby authorized and directed to execute said plat and on behalf of the City of
Dubuque, Iowa.
Section 2. That the dedication of said sanitary sewer and storm drainage
easements on Lot 38 of Timber-Hyrst Estates No. 4 in the City of Dubuque as
they appear on said plat of easement, be and the same are hereby accepted.
Section 3. That the City Clerk be and is hereby authorized and directed to
file said plat and certified copy of this resolution in the office of the Recorder, in
and for Dubuque County, Iowa.
