There is hereby created the Arts and Cultural Affairs Advisory Commission.
2-8-2: PURPOSE:
The purpose of the commission is to build the community through arts and cultural
programs by developing visibility, funding, audiences, information, and partnerships.
The commission plans, promotes, and encourages programs to further public
awareness of, accessibility to, participation in, and support for the artistic and cultural
development of the city and makes recommendations to the city council regarding the
establishment of arts and cultural policies and programs, the expenditure of budgeted
funds on arts and cultural activities, and the implementation of programs.
2-8-3: INTERNAL ORGANIZATION AND RULES:

The commission may adopt rules and regulations to govern its organizational
procedures as may be necessary and which are not in conflict with this Code of
Ordinances or the Iowa Code.
2-8-4: PROCEDURES FOR OPERATION:
All administrative, personnel, accounting, budgetary, and procurement policies of the
city govern the commission in all its operations.
2-8-5: MEMBERSHIP:
A. The commission comprises seven (7) residents of the city, appointed by the city

council.

B. Special Qualifications:

1. Four (4) members must have significant knowledge and demonstrate interest
in one or more areas of the arts including music, dance, literature, visual arts,
theater, folk arts, media arts, design, or arts education.
2. Two (2) members must be from the business and professional community, one
(1) of whom lives or works in the cultural and entertainment district.
3. One (1) member must be at-large who lives or works outside the cultural and
entertainment district.

2-8-6: OATH:
Each person, upon appointment or reappointment to the commission, must execute an
oath of office at the first meeting of the commission following the appointment or
reappointment or at the city clerk's office any time prior to the first meeting of the
commission.
2-8-7: TERMS:
The term of office for commissioners is three (3) years or until such commissioner's
successor is appointed and qualified.

2-8-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
2-8-9: OFFICERS/ORGANIZATION:

The commissioners must choose annually a chairperson and vice-chairperson, each to
serve a term of one (1) year. The chairperson must appoint a secretary, who need not
be a member of the commission. The commissioners must fill a vacancy among its
officers for the remainder of the officer's unexpired term.
2-8-10: MEETINGS:
A. Regular Meetings: The commission must meet on the fourth (4th) Tuesday of each
month.

B. Special Meetings: Special meetings may be called by the chairperson or at the
written request of a majority of the commissioners.
C. Open Meetings: All meetings must be called and held in conformance with the Iowa
Open Meetings Law.

D. Attendance:
1. In the event a commissioner has been absent for three (3) or more
consecutive meetings of the commission, without being excused by the
chairperson, such absence will be grounds for the commission to recommend
to the city council that the position be declared vacant and a replacement
appointed.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes: A copy of the minutes of all regular and special meetings of the commission
must be filed with the city council within ten (10) working days after each meeting, or by
the next regularly scheduled city council meeting, whichever is later.

F. Quorum: Four (4) commissioners constitute a quorum for the transaction of business.
The affirmative vote of a majority of the commissioners present and voting is necessary
for the adoption of any motion or resolution.

2-8-11: COMPENSATION:
Commissioners serve without compensation, provided that they may receive
reimbursement for necessary travel and other expenses while on official commission
business within the limits established in the city administrative policies and budget.
2-8-12: REMOVAL:
Except as provided in 2-8-10(D)(1), the city council may remove any commissioner for
good cause.
2-8-13: POWERS:

The commission has the following powers, duties, and responsibilities:
A. To promote, educate, and create awareness for arts and cultural activities;

B. To develop and increase the market for arts and cultural activities;
C. To facilitate and convene partnerships for arts and cultural activities;

D. To develop funding options and allocate budgeted funding for arts and cultural
activities;

E. To act in an advisory capacity to the city council in all matters pertaining to the
arts and cultural environment;

F. To make recommendations to the city council on the allocation of budgeted
city funding for arts programs and services;
G. To recommend applications and solicitations for grants, gifts, and donations
from individuals, groups, organizations, and agencies, both private and public, for
any purpose consistent with the purposes of the commission;

H. To make recommendations regarding city sponsorship of public programs to
further the development of public awareness of and accessibility to arts and
culture programs and activities;
I. To work with area organizations on broad community issues in which a cultural
perspective is relevant and desirable; and
J. To engage in comprehensive planning for the cultural development of the city. f

2-8-14: COOPERATION WITH OTHER AGENCIES:
The commission cooperates with other arts and culture groups interested in the
promotion and implementation of arts and cultural activities which are in the best
interest of the city.
2-8-15: SOLICITATION AND ACCEPTANCE OF DONATIONS:
The commission may solicit and otherwise accept donations and gifts of money,
personal and real property, and personal services on behalf of the city. All such
donations and gifts received become the property of the city for the general use or
support of arts and cultural programs as determined by the city council unless such
items have been designated by the donor for specific purposes.

than stand alone orgs. I'd also like to work on building activite participation from young people and
those of limited means. Both are still untapped in our community. Just yesterday, I talked with David
Schmitz, our new director of the DMA. He also is focused on similar goals. I have met everyone on the

COMMISSION AND ADOPTING TITLE 2 BOARDS AND COMMISSIONS, ARTICLE
11 CABLE TELEVISION COMMISSION ESTABLISHING THE CABLE TELEVISION
COMMISSION
Whereas, City of Dubuque Code of Ordinances Title 11, Article 3B provides for
the Community Tele-Programming Commission; and
Whereas, Title 11, Article 3C provides for the Cable Regulatory Commission; and

Whereas, the city council finds that it is in the best interest of the City of Dubuque
to merge the two previously established commissions to form one commission to be
known as the Cable Television Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. City of Dubuque Code of Ordinances Articles 11-313 and 11-3C of
are repealed.
Section 2. The following new Title 2 Article 11 is herebyb adopted:ted:
ARTICLE 11
CABLE TELEVISION COMMISSION.
2-11-1. Commission Created. There is hereby created a Cable Television Commission.
2-11-2. Purpose. The purposes of the Commission are as follows:
1. To develop, in respect to community programming and cable regulation,
policies that will govern:
a. The use and protection of equipment and facilities;

b. All training programs;
C. The priorities and scheduling for use of channel time;

d. The daily regulation and administration of the cable franchise;
i
e. The resolution of subscriber complaints which could not be
resolved satisfactorily by the cable manager; and,
f. Other matters pertaining to community programming or cable 1
services in Dubuque which may arise.
2. To develop policies and procedures regarding the public community
programming channels that will promote its nondiscriminatory, first come, first J
served and equitable use in conformity with all applicable regulations and
requirements and limit such use to residents of Dubuque and their own
productions.
3. To encourage interest in and development of decidedly local community
programming.
4. To encourage cooperation and cordial relations between community
programmers, cable subscribers, and the local cable manager and the local
cable manager's staff.
5. To identify and support organization of subcommunities to be responsible
for the channels reserved for public, education, and government programming.
6. To advise the following:
a. The city manager or the city manager's designee (collectively "the
city manager") on matters relating to community programming and the
regulation of the cable system;
b. The city council on expenditure of any funds designated by a
franchise for PEG equipment and facilities; and,
C. The city council on any matter relating to the cable franchise or
system. k
7. To promulgate and administer through the city manager all policies, rules, ,
and procedures relating to community programming.
8. To keep abreast of developments in cable technologies, services, and k
programming and to become competent in cable regulation, finances, and y
standards of operation.
9. To act through the city manager as the local regulatory agent of the cable
franchise and to monitor the operation of the cable system.

10. To consult with the local cable manager on the best updating of the cable
system, services, and programming and to advise the city council on expending
the updating funds. j
11. To evaluate its own proceedings and actions and all community
programming and cable related activities. ;

12. To provide any cable user in Dubuque the opportunity to voice a complaint
regarding the user's cable service.
2-11-3. Internal Organization and Rules. The Commission :may adopt rules and
regulations to govern its organizational procedures as may be necessary and which are
not in conflict with city or state code.

2-11-4. Procedures for Operation. All administrative, personnel, accounting, budgetary,
and procurement policies of the city govern the Commission in all its operations.
2-11-5.1 5. Membership.

1. The Commission consists of seven (7) residents of the city, appointed by the city
council. The mayor must publish notice of the names of persons selected for
appointment no less than thirty (30) days prior to a vote by the city council
2. Residents must be eighteen (18) years of age or older.
3. Special Qualifications.
a. In its appointments, the city council will endeavor to achieve a broad
representation of the subcommunities and public interests which can take
advantage of dedicated channels to benefit the residents of Dubuque and to
develop a Commission versed and competent in telecommunication
administration, finances, and regulation. The city council will attempt to give
preference to applicants who are actively interested in promoting community
cable programming who possess, or are willing to acquire, videoroduction

background, and who will relate to the spectrum of informational and cultural
needs of cable viewers of Dubuque and applicants who possess professional or
experiential backgrounds in law, finances, administration, public relations, or
telecommunication technologies.
b. Members of the Commission who represent subcommunities utilizing
dedicated channels are not be deemed to have a conflict of interest in the use of
the equipment and facilities provided for that purpose solely because of their
membership on the Commission.
2-11-6. Oath. Each person, upon appointment or reappointment to the Commission,
must execute an oath of office at the first meeting of the Commission following the

appointment or reappointment or at the city clerk's office any time prior to or within ten '!
(10) days following the first meeting of the Commission.
2-11-7. Term. The term of office for commissioners is three (3) years. j
2-11-8. Vacancies. Vacancies caused by death, resignation, or otherwise must be
promptly filled by the city council for the unexpired term of office.

2-11-9. Officers/Organization. The Commission must choose annually, at the first
meeting of each calendar, year, from its own members, a chairperson and vice
chairperson, each to serve a term of one (1) year. The Commission must fill vacancies
among its officers for the remainder of the unexpired term. l
2-11-10. Meetings.
1. Regular Meetings. The Commission must meet not less than once each quarter.
2. Special Meetings. Special meetings may be called by the chairperson or at the
written request of a majority of the commissioners.
3. Open Meetings. All meetings must be called and held in conformance with the
Iowa Open Meetings Law.
4. Attendance.
a. In the event a commissioner has been absent for three (3) or more �
consecutive meetings of the Commission, without being excused by the
chairperson, such absence will be grounds for the Commission to recommend to
the city council that the position be declared vacant and a replacement
appointed.

b. Attendance must be entered in the meeting minutes.
5. Minutes. A copy of the minutes of all regular and special meetings of the
Commission must be filed with the city council within ten (10) working days after the
next Commission meeting.
6. Quorum. Four (4) members of the Commission constitute a quorum for the
transaction of business. The affirmative vote of a majority of the commissioners present
and voting is necessary for the adoption of any motion or resolution.

2-11-11. Compensation. Commissioners serve without compensation, provided that
they may receive reimbursement for necessary travel and other expenses while on
official Commission business within the limits established in the city administrative
policies and budget.

2-11-12. Removal. The city council may remove any commissioner as provided in the
Iowa Code.
2-11-13. Powers. The Commission has the following powers, duties, and
responsibilities:
1. To assure that cable channels, equipment, and resources dedicated and
reserved for community programming are used effectively, efficiently, and
economically to afford subcommunities and individuals of Dubuque the
opportunity to express opinions and provide information to cable users, and that
such programming is characterized by appropriateness, quality, and continuity;
and,
2. To assure full compliance with any franchises authorizing cable or video
service in the City, that the franchises be interpreted and applied to the benefit of
the City and its residents, that quality and updated services be delivered
throughout the City, and that the public interest be protected in all matters related
to the cable services delivery systems.
Section 3. This Ordinance shall take effect upon publication.

CIVIC CENTER ADVISORY COMMISSION

2-4-1 : COMMISSION CREATED: j
There is hereby created a civic center advisory commission to have such powers and
responsibilities as hereinafter provided. (2007 Code § 13-11)
2-4-2: PURPOSES, OBJECTIVES GENERALLY:
A. The commission is charged with development of the optimum utilization of the civic
center facility by the widest possible range of users and uses to respond to
community needs and demands at the least possible cost to the city.
B. It is intended that the commission shall have that authority and responsibility
essential to assure that its general purpose is fulfilled subject to this chapter and
subject to the approval of the city council in matters of policy. (2007 Code § 13-12)
2-4-3: SPECIFIC PURPOSES:
The specific purposes of the civic center advisory commission shall be to:

A. Provide the city council as necessary with recommendations that further the general
and specific purposes of the commission.
B. Develop e op effective leadership for efficient planning, control and administration of
policies and programs to realize optimum use of the civic center.

C. Foster the development of financial and other resources to support the short and
long term needs of the civic center facility and its programs.

D. Develop programs to provide a variety of year round intellectual, cultural, enjoyable r
and attractive leisure time activities which contribute to the physical and mental well
being of residents and visitors. �
E. Develop programs which contribute to the economic base of the community by
encouraging business use of the civic center facility. (2007 Code § 13-13)
2-4-4: DUTIES AND RESPONSIBILITIES:

The duties and responsibilities of the commission are as follows:

A. Development of an administrative plan and operating policies to assure the maximum
effectiveness in the use of all facilities and resources.
B. Development of schedules of fees and charges for special building services,
equipment, special building features, rental rates, admissions, and concessions.

C. Development of informational and promotional programs to secure the full support
and participation of the community.
D. Development of accurate, timely and understandable financial data and
measurements of effectiveness necessary to assure sound policy formulation for
operation and management.
E. Development of the annual operating budget and an ongoing capital improvements
budget.

F. Development of a maintenance program to provide a safe, secure, sanitary, clean
and attractive facility.
G. Serve as a personnel advisory committee to the city manager in the selection of civic
center personnel.
H. Participate with the Dubuque area chamber of commerce, the hotel and restaurant
industry and other interest groups to promote and develop the convention and
tourism business for the Dubuque area.
I. Execution of contracts and agreements for the use, operation and maintenance of the
civic center facility; contracts and agreements for the use of the facility may be
signed by the city manager, except that all contracts for usage of the facility involving
a term of longer than five (5) days shall be signed by the mayor with the approval of
the city council. (2007 Code § 13-14)
2-4-5: PROGRAMS, PROJECTS AND SERVICES:
All programs, projects and services to be developed by the commission must conform to
the policies of the city and to applicable local, state and federal laws, rules and
regulations. (2007 Code § 13-15)
2-4-6: MEMBERSHIP; APPOINTMENT:
A. Membership; Terms: The commission shall be comprised of a membership of five (5)
persons, who shall be appointed by the city council for terms of three (3) years. M
B. Serve Until Successor Appointed: Upon completion of the term of office, a member of
the commission shall continue to serve in the member's full capacity until a
successor has been duly appointed. (2007 Code § 13-17) '

2-4-7: VACANCIES IN MEMBERSHIP:
A vacancy caused by death, resignation or otherwise on the commission shall be
promptly filled by the city council for the unexpired term of office. (2007 Code § 13-18)
2-4-8: ATTENDANCE AT MEETINGS:
A. Frequency of Attendance: Members of the commission shall attend at least two-thirds
(2/3) of all regularly scheduled and held meetings within any twelve (12) month
period. If any member does not attend such prescribed number of meetings, it shall
constitute grounds for the commission to recommend to the city council that said
member be replaced.
B. Record of Attendance: The attendance of all commission members shall be entered
upon the minutes of all meetings by the secretary. (2007 Code § 13-19)
2-4-9: COMPENSATION:
All members of the commission shall serve without compensation except for
reimbursement of necessary expenses. (2007 Code § 13-20)
2-4-10: ORGANIZATION; ELECTION OF OFFICERS:
A. Officers Designated: The officers of the commission shall be a chairperson, a vice
chairperson, and a secretary. All officers shall be members of the commission.
B. Election b Commission: At the initial meeting of the commission and at the first

meeting of each calendar year thereafter, the commission shall elect the above
identified officers to serve one year terms of office. All officers shall be eligible to
serve successive terms of office. (2007 Code § 13-21)
2-4-11: DUTIES OF OFFICERS:
A. Chairperson: The chairperson shall preside at all meetings of the commission and
shall perform all duties incident to the office of chairperson.

B. Vice Chairperson: The vice chairperson shall perform the duties of the chairperson in
the absence or incapacity of the chairperson. In the event of such absence or
incapacity, the vice chairperson shall perform such duties as are imposed upon the
chairperson until such time as the commission designates a new chairperson.

C. Temporary Chairperson: In the event of the absence of the chairperson or vice
chairperson at any meeting of the commission, the then present members of the
commission shall select a temporary chairperson for that meeting.
D. Secretary: The secretary shall record votes, keep a record of all proceedings of the
commission and perform such other duties incident to the office of secretary.

E. Absence of Secretary: In the event of the absence of the secretary at any meeting of
the commission, the chairperson shall appoint one of the then present commission
members to serve as secretary pro tem for that meeting. (2007 Code § 13-22)

INTRODUCTION
The purpose of this memorandum is to request the Council's consideration for transfer
of designation of area representation for a current Community Development Advisory
Commission member.
BACKGROUND
The current Community Development Advisory Commission (CDAC) consists of seven
(7) members; four (4) at-large members and four (2) members from low-moderate
income areas as determined by the US Dept of Commerce, Bureau of the Census, and
one (1) Housing Commission member. The bylaws require four (4) Commission
members to be from low/moderate income block groups in Census tracts 1, 3, 4, 5, 6,
7.011 7.02, 9, 11.02, 12.01, 101.01 and 101.03; four (4) at large members, and one
member from the Housing Commission. There are currently two vacancies for
representatives for low/moderate income areas.
DISCUSSION
Vice Chairperson Robert Blok, II currently is a CDAC member representing the
community at large. When Commissioner Block was appointed to the Commission, the
Census Tract he resided in (Tract 9 Blockgroup 1) was not in a HUD designated low-
moderate income area. Since his appointment, HUD released updated low- and
moderate-income data that includes Census Tract 9 Blockgroup 1 as a low-and
moderate-income area. The transfer would leave two openings on the Commission,
one (1) at large and one (1) low- moderate-representation. There are currently
applications for the commission that have been received by City Council. The
applicants are not residents of low/mod areas, but would be eligible for at-large
representation. This change will allow Council to consider appointing one of the current
applicants and allow the Commission to fill one of the two vacancies.

COMMUNITY DEVELOPMENT ADVISORY COMMISSION
2-5C-1: COMMISSION CREATED; COMPOSITION:
A. Creation: There is hereby created a community development advisory commission
whose primary purpose shall be to provide for citizen participation in the
development and evaluation of the city of Dubuque's community development block
grant (CDBG) program.
B. Membership: The commission shall comprise nine (9) members; four (4) members
shall be residents of census tracts and block groups where at least fifty one percent
(51%) of the residents are low/moderate income persons as determined by the
United States department of commerce, bureau of the census; four (4) members
shall be residents of the community at large; and one member shall be that member
of the housing commission designated by the housing commission. (2007 Code
§ 15-46)

2-5C-2: TERM; FILLING OF VACANCIES; COMPENSATION:
A. Term: The term of office for a commission member shall be three (3) years.
B. Removal Of Member: A commission member may be removed at any time with or
without cause by a vote of two-thirds (2/3) of all members of the city council.

.C. Filling Vacancies: A vacancy occurring on the commission caused by resignation or
otherwise shall be filled by appointment of the city council for the remainder of the
unexpired term.

D. Compensation: Members of the commission shall serve without compensation
except for actual expenses, which shall be subject to approval by the city council
(2007 Code § 15-48)
2-5C-3: ORGANIZATION:
The commission shall choose annually, at its first regular meeting of the fiscal year, one
of its members to act as chairperson, and another of its members to act as vice
chairperson, to perform all of the duties of the chairperson during the chairperson's
absence or disability. The commission shall adopt such rules and regulations governing
its organization and procedures as it may be deemed necessary, consistent with the
following:
A. Meetings: The commission shall meet as necessary to fulfill the purposes for which
the commission was created.
B. Attendance Of Members: Members of the commission shall attend at least two-thirds
(2/3) of all regularly scheduled meetings within any consecutive twelve (12) month
period. If any member fails to attend such prescribed number of meetings, such
failure shall constitute grounds for the commission to recommend to the city council
that said member be replaced. Attendance of all members shall be entered in the
minutes.
C. Minutes Filed With Clerk: The commission shall file with the city clerk a copy of the hh'
minutes of each regular and special meeting of the commission within ten (10)
working days after such meeting. (2007 Code § 15-51)
2-5C-4: GENERAL DUTIES AND RESPONSIBILITIES:
The commission shall have the following duties and responsibilities:

A. To conduct public hearings in accordance with the minimum standards established in f
the CDBG program's citizen participation plan to ensure meaningful citizen input in u
the planning, implementation and assessment of the city's CDBG program; j
B. To provide for and encourage the participation of low and moderate income persons
who reside in designated areas of slum and blight and residents of low and
moderate income neighborhoods, as defined by the city council, in the planning,
implementation and assessment of the CDBG program;
C. To identify community development needs, particularly the needs of persons of low
and moderate income;
D. To serve in an advisory role upon the request of the city council in policy decisions
regarding funding priorities and program development and implementation;

E. To monitor and evaluate program activities to advise whether identified community
development objectives have been met;
F. To undertake public information efforts to educate the citizenry of the availability of
CDBG funded programs and to provide for a greater understanding of the city's I
community development efforts;
G. To assist in the preparation of the statement of community development objectives
and projected use of funds, amendments thereto and required reports including, but
not limited to, the annual grantee performance report (GPR) and the annual
comprehensive housing assistance strategy (CHAS);
H. To serve in an advisory role to the city manager in the review of complaints and
grievances received in accordance with the procedures established in section 2-5C-
5 of this article; and
I. To support, upon request, the efforts of the city council and other city
commissions in the assessment of the general development needs of the
community. (2007 Code § 15-49)
2-5C-5: GRIEVANCE PROCEDURE; REVIEW STANDARDS; APPEAL PROCESS:

The grievance procedure for the community development block grant program shall be
as follows:
A. Right To File: Any aggrieved person may file a grievance with the city manager.
B. Contents: Grievances shall contain a concise statement of the grievance and an
explanation of the action desired.
C. Forwarding To Commission: The city manager shall forward the grievance to the
commission within seven (7) working days of its receipt.
D. Setting Date For Hearing; Notice To Complainant: The commission shall, within
fifteen (15) working days of the receipt of the grievance, set a time for a hearing. The
complainant shall be notified in writing of the time.and place of the hearing. If a
grievance is resolved prior to the date of the hearing, the aggrieved party shall
request in writing that the grievance be withdrawn.
E. Hearing Procedure: The commission shall conduct a hearing to review the grievance.
The grievant may appear in person, by agent, or by attorney. All persons wishing to
appear before the commission shall have an opportunity to be heard regarding the
grievance. Minutes shall be kept of the proceedings of the hearing.

F. Recommendations Of Commission: The commission shall forward its
recommendation, in writing, to the city manager within ten (10) working days
following the hearing.

G. Action By City Manager: The city manager shall receive and review the
recommendation of the commission and shall respond to the grievant within ten (10)
working days of the receipt of the recommendation. The commission shall be M°
advised of the action of the city manager.
H. Compliance With Federal Regulations: The recommendations of the commission
shall comply with the regulations established by the U.S. department of housing and
urban development for the community development block grant program under title I V
of the housing and community development act of 1974, as amended, and this code. I
I. Appeal To Council By Grievant: If the grievant is unsatisfied with the response of the
city manager, an appeal may be made filed with the city clerk. The appeal shall be
forwarded by the city clerk to the city council. The city council may, at its discretion,
hold a hearing to consider the concerns of the grievant.
J. Council Action; Appeal To HUD: Upon review of the appeal, the city council shall: 1)
accept the response of the city manager; 2) modify the response of the city
manager; or 3) return the grievance to the city manager for further review. If the
outcome of such appeal is unsatisfactory, the complainant may file a written appeal
with the U.S. department of housing and urban development (HUD). (2007 Code
§ 15-50)

2-SC-6: PROCEDURES FOR OPERATIONS:
The commission shall operate in accordance with the standards and procedures set
forth in the city's community development block grant (CDBG) program's citizen
participation plan. All administrative, personnel, accounting, budgetary and procurement

HISTORIC PRESERVATION COMMISSION
16-10-3: HISTORIC PRESERVATION COMMISSION ESTABLISHED:
A. The historic preservation commission is hereby established and shall consist of nine (9)
members who shall be residents of the city.
B. Members of the commission shall be appointed by the city council as follows: one resident
from each designated historic preservation district, including the historic districts hereinafter
established; and four(4) at large members. Each member shall possess qualifications evidencing
expertise or interest in architecture, history, archeology, law, construction or building
rehabilitation, city planning or conservation in general. One commission member shall be a
licensed architect. In the event that a vacancy occurs in a seat which requires that the appointee
be a resident of the district and for which there is no application from a qualified resident,the
city council shall appoint a tenth member. This appointment shall be temporary. Upon
appointment of a qualified resident to the vacancy, the temporary appointment shall terminate.

C. Members shall serve three (3) year terms.
D. Vacancies occurring in the commission, other than through expiration of term of office, shall
be only for the unexpired portion of the term of the member replaced. Each member shall serve
until the appointment of a successor.

E. Members may serve for more than one term.

F. Vacancies shall be filled by the city council in accordance with the requirements set forth
above.

16-10-4: COMMISSION ORGANIZATION:
A. The commission shall elect from its membership a chairperson and vice chairperson, whose
terms of office shall be fixed by bylaws adopted by the commission. The chairperson shall
preside over meetings of the commission and shall have the right to vote. The vice chairperson
shall, in cases of absence or disability of the chairperson, perform the duties of the chairperson.
B. The city manager shall designate a person to serve as secretary to the commission. The
secretary shall keep a record of all resolutions, proceedings and actions of the commission.
C. The commission shall adopt rules or bylaws for the transaction of its business. The bylaws
shall provide for, but not be limited to, the time and place of holding regular meetings,the
procedure for the calling of special meetings by the chairperson or by at least three (3) members
of the commission and quorum requirements.

D. All meetings of the commission shall be subject to Iowa Code chapter 21,the Iowa open
meetings act.
E. The commission shall keep a record of its resolutions,proceedings and actions. The records
shall be subject to Iowa Code chapter 22, the Iowa public records act.
F. A quorum of the commission shall be required in order to transact business.
G. The affirmative vote of a majority of commission members present at a meeting shall be
required for the approval of plans or the adoption of any resolution, motion or other action of the
commission.
H. The vote of each member of the commission shall be recorded.
I. A member of the commission shall attend at least two-thirds (2/3) of all scheduled meetings
within any consecutive twelve (12)month period. If any member does not attend such prescribed
number of meetings it shall constitute grounds for the commission to recommend to the city
council thataid member ember be replaced.laced.
Attendance of all members shall be entered on the
minutes.

J. The commission shall file with the city council a copy of the minutes of each regular and
special meeting of the commission within ten(10) working days after each meeting. (Ord. 52-09,

16-10-5: POWERS AND DUTIES GENERALLY:

A. The general duties and powers of the commission shall be as follows:
1. To promote and conduct educational and interpretive programs on historic properties within its
jurisdiction. l
2. To develop and adopt specific standards for review and design guidelines in addition to those
set forth in section 16-10-10 of this chapter, for the alteration of landmarks landmark andmark sites, {
individually designated historic properties and property and structures within historic districts.
3. To adopt its own bylaws.
4. To identify, evaluate, register, manage and protect significant prehistoric and historic
archeological sites.
5. To conduct an ongoing survey to identify historically, archaeologically and architecturally
significant properties, structures and areas that exemplify the cultural, social, economic,political,
archeological or architectural history of the nation, state or city.

10. To research and recommend to the city council the adoption of ordinances designating areas
as having historic, architectural, archeological or cultural value as "conservation planning areas".
11. To maintain a register of all properties and structures which have been designated as
landmarks, landmark sites or historic districts, including all information required for each
designation.
12. To assist and encourage the nomination of landmarks, landmark sites and historic districts to
the national register of historic places, and review and comment at a public hearing on any
national register nomination submitted to the commission upon the request of the mayor, city
council or the state historic preservation office. H!
13. To confer recognition upon the owners of landmarks, individually designated historic
properties or of property or structures within historic districts.
14. To review in progress or completed work to determine compliance with specific certificates
of appropriateness or certificates of economic nonviability.
15. To serve as an advisory design review body to the city council for review of public works
projects which have historic preservation implications in historic districts, individually
designated historic properties, or for alteration of landmarks, landmark sites or structures, that
would result in a material change in appearance or be visible from the public way.
16. To serve as an advisory review body to the city council for the review of public planning,
design, construction, and maintenance needs in conservation planning areas upon request from
the city council.
B. The commission shall be governed by the administrative,personnel, accounting, budgetary

interest to our community and its future.
The City Clerk's Office, City Hall, 50 West 13th Street, Dubuque, IA accepts applications for any Board and/or
Commission at any time, and the application stays active for one year from the date of receipt in the Clerk's Office.
At the appropriate regularly scheduled meeting, applications will be submitted to the City Council for their review and
applicants are encouraged to address the Council stating their reasons for wanting to serve on this particular Board or

Chapter 2
HUMAN RIGHTS COMMISSION

8-2-1 : CREATED:
There is hereby created a human rights commission. (Ord. 18-09, 4-6-2009)
8-2-2: COMPOSITION:
The human rights commission created by this chapter shall consist of nine (9) members. (Ord.
18-09, 4-6-2009)

8-2-3: APPOINTMENT; TERMS; FILLING OF VACANCIES:
The human rights commission members shall be appointed by the city council for terms of
three (3) years each and shall serve thereafter until a successor has been appointed.
Vacancies shall be filled for the remainder of the unexpired term. Appointments shall take into
consideration the various racial, religious, cultural and social groups of the city. (Ord. 18-09, 4-
6-2009) �
8-2-4: OFFICERS:
The human rights commission created by this chapter shall elect from its own membership, at
its regular March meeting, its chairperson and vice chairperson,each to serve a term of one
year. The chairperson shall appoint a secretary, who need not be a member of the
commission. The commission shall fill vacancies among its officers for the remainder of the
unexpired term. (Ord. 18-09, 4-6-2009)

8-2-5: COMPENSATION:
The members of the human rights commission created by this chapter shall serve without
compensation; provided, that they may receive reimbursement for necessary travel and other
expenses while on official commission business and such shall be within the limits established
in the city budget. (Ord. 18-09, 4-6-2009)
8-2-6: REMOVAL OF MEMBERS FOR UNEXCUSED ABSENCES:
In the event a member of the human rights commission created by this chapter has been
absent for three (3) or more consecutive meetings without being excused by the chairperson,
the commission by majority vote may certify such fact to the city council and petition the city i
council to declare a vacancy by reason of such unexcused absence and appoint a successor
to fill such vacancy. (Ord. 18-09, 4-6-2009)
8-2-7: RULES:
The human rights commission created by this chapter may adopt, amend, or rescind such
rules as may be necessary for the conduct of its business. (Ord. 18-09, 4-6-2009)

8-2-8: MEETINGS:

A. Regular Meetings: The human rights commission shall meet not less than monthly on a
regular basis.
S. Special Meetings; Notice: The chairperson, the vice chairperson, or any three (3) members
of the human rights commission may call a special meeting by giving at least twenty four
(24) hours' notice to every other member of the commission. The call for a special meeting
shall include an agenda and only matters included in that agenda may be acted on at the
meeting.
C. Conformance With Open Meetings Law: All meetings of the human rights commission shall
be held in conformance with the Iowa open meetings law'.
D. Attendance: Members of the human rights commission shall attend at least two-thirds (2/3) of
all regularly scheduled meetings within any twelve (12) month period. If any member does
not attend such prescribed number of meetings, it shall constitute grounds for the
commission to recommend to the city council that said member be replaced. Attendance of
all members shall be entered on the minutes. (Ord. 18-09, 4-6-2009)
8-2-9: QUORUM:
A quorum of the human rights commission shall be five (5) members. A majority of the
members present and voting shall be necessary for the passage of any motion. The
chairperson shall vote as a member of the commission. (Ord. 18-09, 4-6-2009)

8-2-10: RECORDS TO BE PUBLIC; EXCEPTIONS:
All records of the human rights commission shall be public except charges, complaints, reports
of investigations, statements, and other documents or records obtained in investigation of any r
charges shall be closed records. (Ord. 18-09, 4-6-2009) j
8-2-11 : CONFIDENTIALITY OF COMPLAINTS: h
No member of the human rights commission or its staff shall disclose the filing of a charge, the q
information gathered during the investigation, or the endeavors to eliminate such
discriminatory or unfair practice by conference, conciliation, or persuasion unless such
disclosure is made in connection with the conduct of such investigation or after the commission
has held a public hearing upon a complaint filed in connection with such charge. This section
does not prevent any complainant, witness, or other person from publicizing the filing of a
charge or complaint or the matter therein complained of. (Ord. 18-09, 4-6-2009)

8-2-12: POWERS AND DUTIES:
The human rights commission created by this chapter shall have the following powers and

A. To receive, investigate, and finally determine the merits of complaints alleging unfair or
discriminatory practices.

B. To investigate and study the existence, character, causes, and extent of discrimination in
public accommodations, employment, apprenticeship programs, on the job training
programs, vocational schools, other educational institutions, and housing in the city and to
attempt the elimination of such discrimination by education and conciliation.
C. To hold hearings upon any complaint made against a person, an employer, an employment
agency,.a labor organization, or the employees or members thereof, to subpoena
witnesses and compel their attendance at such hearings, to administer oaths and take the
testimony of any person under oath and to compel such person, employer, employment
agency, labor organization, or employees or members thereof, to produce for examination
any books and papers relating to any matter involved in such complaint. The commission
shall issue subpoenas for witnesses in the same manner and for the same purpose on
behalf of the respondent upon the respondent's request. Such hearings may be held by the
commission, by any commissioner, or by any hearing examiner appointed by the u
commission. If a witness either fails or refuses to obey a subpoena issued by the
commission, the commission may petition the district court having jurisdiction for issuance j
of a subpoena and the court shall, in a proper case, issue the subpoena. Refusal to obey
such subpoena shall be subject to punishment for contempt.
D. To issue such publication and reports of investigations and research as in the judgment of
the commission shall promote civil and respectful behavior which shall tend to eliminate
discrimination.
E. To prepare and transmit to the mayor and cit council from time to time but not less often

than once each year, reports describing its proceedings, investigations, hearings
conducted, and the outcome thereof, decisions rendered, and the other work performed by
the commission.
F. To make recommendations to the city council concerning discrimination.
G. To cooperate,ate within the limits of any appropriations made for its operation, with other
agencies or organizations, both public and private, whose purposes are consistent with j
those of this chapter, in the planning and conducting of programs designed to eliminate
discrimination or cultural and intergroup tensions.

H. To adopt, publish, amend and rescind regulations consistent with and necessary for the
enforcement of this chapter.
I. To delegate any of its functions, duties and powers to its staff including functions, duties and

powers with respect to investigating, conciliating, determining, certifying, reporting, or
otherwise acting as to any work, business, or matter under this title.

J. To receive, administer, dispense, and account for any restricted funds that may be
voluntarily contributed to the commission and any grants that may be awarded the
commission for furthering the purposes of this title. No disbursements will be made of any
restricted funds without authority from the city council. (Ord. 18-09, 4-6-2009)

8-2-13: CITY POLICIES APPLICABLE TO COMMISSION OPERATIONS:
All administrative, personnel, accounting, budgetary and procurement policies of the city shall
govern the human rights commission in all its operations. (Ord. 18-09, 4-6-2009)
8-2-14: SUBPOENAS:
The human rights commission may issue subpoenas and order discovery in aid of
investigations under this title. Such subpoenas and discovery may be ordered to the same
extent and subject to the same limitations as would apply for county attorney subpoenas. (Ord.

Chapter 3
INVESTMENT OVERSIGHT ADVISORY COMMISSION

2-3-1: COMMISSION CREATED:
There is hereby created the Investment Oversight Advisory Commission.
2-3-2: PURPOSE:
If
The purpose of the commission is to review the actions and decisions of the city's
investments and all money managers for compliance with the city's investment policy
and to report any noncompliance to the city council; to recommend, as needed, changes
in the investment policy to the city council; and to review the investment performance
of the city's investments and money managers and to report to the city council
concerning such investment performance at least quarterly.
2-3-3: INTERNAL ORGANIZATION AND RULES: jl
The commission may adopt rules and regulations to govern its organizational
procedures as may be necessary and which are not in conflict with this Code of
Ordinances or the Iowa Code.
2-3-4: PROCEDURES FOR OPERATION:

All administrative, personnel, accounting, budgetary, and procurement policies of the
city govern the commission in all its operations.
2-3-5: MEMBERSHIP:
The commission comprises five (5) residents of the city, appointed by the city council,
who have knowledge about investments and finance but with no affiliation with a firm or
corporation which does now or during the term of a commissioner provides investment
or financial advice or services to the city.
2-3-6: OATH:
Each person, upon appointment or reappointment to the commission, must execute an
oath of office at the first meeting of the commission following the appointment or
reappointment or at the city clerk's office any time prior to the first meeting of the
commission.
2-3-7: TERMS:
The term of office for commissioners is three (3) years or until such commissioner's
successor is appointed and qualified.

2-3-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
2-3-9: OFFICERS/ORGANIZATION:
The commissioners must choose annually a chairperson and vice-chairperson, each to
serve a term of one (1) year. The chairperson must appoint a secretary, who need not
be a member of the commission. The commissioners must fill a vacancy among its
officers for the remainder of the officer's unexpired term.
2-3-10: MEETINGS:
A. Regular Meetings.The commission must meet quarterly.
B. Special Meetings. Specialecial meetings may
be called by the chairperson or at the
written req Y request of a majority of the commissioners.
C. Open Meetings. All meetings must be called and held in conformance with the a
Iowa Open Meetings Law.
D. Attendance.
1. In the event a commissioner has been absent for three (3) or more
consecutive meetings of the commission, without being excused by the
chairperson, such absence will be grounds for the commission to recommend to
the city council that the position be declared vacant and a replacement
appointed.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes. A copy of the minutes of all regular and special meetings of the commission
must be filed with the city council within ten (10) working days after each meeting, or
by the next regularly scheduled city council meeting, whichever is later.

F. Quorum. Three (3) commissioners constitute a quorum for the transaction of business.
The affirmative vote of a majority of the commissioners present and voting is necessary
for the adoption of any motion or resolution.
2-3-11: COMPENSATION:
Commissioners serve without compensation, provided that they may receive
reimbursement for necessary travel and other expenses while on official commission
business within the limits established in the city administrative policies and budget.

2-3-12: REMOVAL:
Except as provided in 2-3-10(D)(1), the city council may remove any commissioner for
good cause.

2-3-13: POWERS:
The commission has the following powers, duties, and responsibilities:
A. To review the actions and decisions of the finance director and the city's 1
money managers for compliance with the city's investment policy and report any
noncompliance to the city council;
B. To recommend, as needed, changes in the city's investment policy to the city
manager and the city council; and
C. To review the investment performance of the city and the city's money
managers and report to the city council concerning same at least quarterly.
2-3-14: REPORTS PROVIDED:

The finance director must provide the commission with monthly, quarterly, and annual
reports prepared by the finance director and the city's financial advisors.

LIBRARY BOARD OF TRUSTEES

2-7-1 : COMPOSITION:
i
The Carnegie-Stout free public library of the city shall be under the control and direction of the
board of library trustees. Such board shall consist of seven (7) members who shall be j
appointed by the mayor with the approval of the city council. (2007 Code § 30-1)

2-7-2: ELIGIBILITY FOR MEMBERSHIP:
i
Citizens and residents of the city, male or female, over the age of eighteen (18) years, are
alone eligible for membership on the board mentioned in section 2-7-1 of this chapter. (2007
Code § 30-2)

2-7-3: COMPENSATION:
Members of the board shall receive no compensation for their services. (2007 Code § 30-3)
2-7-4: TERMS OF MEMBERS; FILLING OF VACANCIES:
For the three (3) vacancies that occur on July 1, 2009, the appointments to fill two (2) of the
vacancies shall be for terms ending July 1, 2010, and the appointment to fill the other vacancy
shall be for a term ending July 1, 2013. For the four (4) vacancies that occur on July 1, 2011,
the appointments to fill two (2) of the vacancies shall be for terms ending July 1, 2012, and the
appointments to fill the two (2) other vacancies shall be for terms ending July 1, 2015.
Thereafter, each member of the board shall hold office for four (4) years and until such
member's successor is appointed and qualified. The term of office of each member shall
commence July 1 in the year in which the member is appointed. Vacancies occurring on the
board through death, resignation or permanent removal from the city shall be filled by the
mayor with the approval of the city council, but such appointments shall be made to fill out the
unexpired term for which the appointment is made. (Ord. 34-09, 7-6-2009)
2-7-5: P09IO//ERS AND DUTIES GENERALLY:
{
A. Powers: The board of library trustees shall have and exercise the following powers:
1
1. To meet and organize by the election of one of their number as president of the board, and
by the election of a secretary and such other officers as the board may deem necessary; a

2. To have charge, control and supervision of the public library, its appurtenances and fixtures,
and rooms containing the same, directing and controlling all the affairs of such library;

3. To employ a librarian, such assistants and employees as may be necessary for the proper
management of said library, and fix their compensation; but, prior to such employment, the

compensation of such librarian, assistants and employees shall be fixed for the term of
employment by a majority of the members of said board voting in favor thereof;
4. To remove such librarian, assistants or employees by a vote of two-thirds (2/3) of such board
for good cause; �N

5. To select and make purchases of books, pamphlets, magazines, periodicals, papers, maps, I
journals, furniture, fixtures, stationery and supplies for such library;

6. To authorize the use of such library by nonresidents of the city and to fix charges therefor;
7. To make and adopt, amend, modify or repeal bylaws, rules and regulations, not inconsistent
with law, for the care, use, government and management of such library and the business of
said board, fixing and enforcing penalties for the violation thereof;
8. To have exclusive control of the expenditures of all taxes levied for library purposes as
provided by law, and of the expenditure of all monies available by gift or otherwise, for the
erection of library buildings and of all other monies belonging to the library fund;
9. To contract with the trustees of the township or the board of supervisors of the county or of
adjacent townships or counties, or with the trustees or governing bodies of neighboring towns
or cities not having library facilities for the public, to loan the books of said library, either singly
or in groups, upon such terms as may be agreed upon in such contract.
B. Record Of Proceedings: The board shall keep a record of its proceedings. (2007 Code § 30-

2-7-6: CHARGE OF BUILDING, DONATIONS:

The board shall have charge and control of the Carnegie-Stout free public library building and
all gifts and donations to the city for library purposes, and see that the same are properly
preserved for public use. (2007 Code § 30-6)
2-7-7: ANNUAL REPORTS:

The board shall each year make a report to the city council for the year ending December 31,
giving a statement of the condition of the library, the number of books added thereto, the
number circulated, the number not returned or lost, the amount of fines collected, and the
amount of money expended in the maintenance thereof during such year, together with such

LONG RANGE PLANNING ADVISORY COMMISSION {

15-2-1 : COMMISSION CREATED; COMPOSITION:
There is hereby created a city long range planning advisory commission, which shall
i
consist of seven (7) members including a member of the city council designated by the
council and six (6) residents of the city appointed by the city council who shall be
qualified by their knowledge, experience and ability to contribute to the city's long range
planning and development efforts. (Ord. 9-06, 2-6-2006)

15-2-2: TERM OF OFFICE:
The term of office for a member, other than the member designated by the city council,
shall be three (3) years or until a successor is duly appointed. (2007 Code § 36-6) j
15-2-3: POWERS:
The commission shall have the following powers, duties and responsibilities:
A. To provide a leadership role in the planning, coordinating and sponsoring of a
periodic community planning process;
B. To coordinate and supervise the preparation and maintenance of the comprehensive
plan; j
C. To provide input to the city manager in the preparation of the city manager's
recommended multiyear capital improvement program (CIP);

D. To make comprehensive studies of the present condition and the future growth of the
city to provide input into the community planning process and to guide and
accomplish a coordinated, consistent and harmonious development of the city in
accordance with the present and future needs thereof to the end that the health,
safety, morals, order, convenience, prosperity and general welfare may be
promoted;
E. To make or cause to be made such surveys, studies, maps, plans, or charts of the
city with due regard to its relation to neighboring territory as may be determined as
necessary to carry out the purposes of the commission;

F. To recommend amendments to all or a part of the comprehensive plan in response to
the community planning process, upon its own initiative or upon recommendation j
presented by the zoning advisory commission, but only after a public hearing;

G. To review proposed urban renewal plans and urban renewal plan amendments and
urban revitalization plans and urban revitalization plan amendments for consistency
with the comprehensive plan for the city; q

H. To undertake public information efforts to enhance public understanding of the
community planning process generally and the comprehensive plan specifically; and
I. To undertake from time to time other specific long range planning projects which may
be referred to it by the city council. (2007 Code § 36-7)

15-2-4: ORGANIZATION; MEETINGS:
A. Officers; Rules And Regulations: The commission shall choose annually, at its first
regular meeting of the fiscal year, one of its members to act as chairperson, and
another of its members to act as vice chairperson, to perform all of the duties of the
chairperson during the chairperson's absence or disability. The commission shall
adopt such rules and regulations governing its organization and procedures as it
may be deemed necessary.
B. Meetings: The commission shall meet as necessary to fulfill the purposes for which
the commission was created.
C. Attendance: Attendance of all members shall be entered on the minutes. If any
member fails to attend at least two-thirds (2/3) of all regularly scheduled meetings
within any twelve (12) month period, such failure shall constitute grounds for the
commission to recommend to the city council that said member be replaced.
D. Minutes Filed With City Clerk: The commission shall file with the city clerk a copy of
the minutes of each regular and special meeting of the commission within ten (10)
working days after each such meeting. (2007 Code § 36-8)
15-2-5: PROCEDURES FOR OPERATIONS:
All administrative, personnel, accounting, budgetary and procurement policies of the city
shall govern the commission in all its operations. (2007 Code § 36-9)

Park and Recreation Advisory Commission
10-5A-2:

A. Commission Created: There is hereby created a park and recreation advisory
commission to have such powers and responsibilities as hereinafter provided.
B. Purpose: The purpose of the commission is to:

1. Contribute to the general beautification of the city and assist in providing
facilities for active and passive recreation through landscaping and maintaining park
land and facilities; and

2. Provide year round opportunities for organized recreation activities for residents

of all ages and social groups.
C. Powers: The responsibilities of the commission are to advise the city council on:
1. Use of Grounds and Facilities: The establishment of rules and regulations
governing the use of all grounds and facilities that have been or may be set aside as
public parks, playgrounds and other such park and recreation facilities. Such rules
and regulations shall include, but are not limited to:
a. Opening and closing hours for the use of all park and recreation facilities by
the general public.
b. Establishment of fees, including the issuance of permits for public use of all
park and recreation facilities.
2. Recreational Programs: The establishment of rules and regulations for all
recreational programs provided by the city, including the establishment of fees for
participation by the public in such activities.
D. Cooperation with Other Agencies: In the conduct and operation of recreation
grounds and recreation programs, the commission shall cooperate with the Dubuque
Community School District, Holy Family school system and all other groups interested in
the promotion and implementation of recreational activities which are in the best interest
of the city.
E. Solicitation and Acceptance of Donations: The commission may solicit donations
and gifts of money, personal and real property and personal services. All such
donations and gifts shall become the property of the city for the general support of park,
and recreation programs of the city unless such items have been designated by the
donors for specific purposes.

F. Membership, Appointment:

1. Membership; Quorum: The commission shall comprise seven (7) persons who
shall be appointed by the city council for terms of three (3) years. Four (4) members
of the commission shall constitute a quorum for the transaction of business.

2. Terms: The expiration date for all terms of office shall be June 30 of the
appropriate year.
G. Attendance:
1. Attendance Entered Upon Minutes: The attendance of all commission members
shall be entered upon the minutes of all meetings by the secretary.
2. Failure To Attend; Declaration Of Vacancy: If a member does not attend at least
two-thirds (2/3) of all regularly scheduled meetings within a twelve (12) month period,
it shall be grounds for the commission to recommend to the city council that the
position be declared vacant and a replacement appointed.
H. Compensation: Members of the commission shall serve without compensation
except for reimbursement of necessary expenses.

1. Officers: The officers of the commission shall be a chairperson, a vice
chairperson and a secretary. All officers shall be members of the commission.
2. Election; Term: At the first meeting in July of each year, the commission shall
elect officers to serve one year terms of office. All officers shall be eligible to serve

1. Regular Meetings: The commission shall meet not less than bimonthly, after

15-3-1 : COMMISSION CREATED; COMPOSITION; APPOINTMENT:

There is hereby created a city zoning advisory commission, which shall consist of seven
(7) residents of the city, appointed by the city council, who shall be qualified by
knowledge, experience and ability to act in matters pertaining to short range planning
and zoning, none of whom shall hold an elective position in the city. (2007 Code § 36-
10)
15-3-2: APPOINTMENT TO AIRPORT ZONING COMMISSION:
Two (2) members of the commission shall be appointed by the city council to serve on
the airport zoning commission. A member shall serve out the term on the airport zoning
commission even if the member's term on the zoning commission has expired. (2007
Code § 36-10.1)
15-3-3: TERM OF OFFICE:
The term of office for members of the zoning advisory commission shall be three (3)
years or until a successor is duly appointed. (2007 Code § 36-12) j

15-3-4: POWERS: h
The zoning advisory commission shall concern itself with short range physical planning j
and shall have and possess the following powers, duties and responsibilities:
A. To prepare and recommend a zoning ordinance by exercising the powers conferred
by Iowa Code chapter 414, "municipal zoning". Such zoning ordinance shall include
the boundaries of the various zoning districts; the height, number of stories and size
of buildings and other structures in each district; the percentage of ground that may
be occupied; setback requirements; the size of yards, courts and other open space;
the density of population; the location and use of buildings, structures, and land for
trade, industry, commercial, residential or other purposes; and such regulations and
restrictions necessary to enforce such zoning provisions. To this end, the zoning a
advisory commission shall prepare a preliminary zoning ordinance and hold public
hearings thereon and after such hearings have been held, shall submit a final zoning
ordinance and its recommendations to the city council;

B. To recommend to the city council, from time to time, as conditions require,
a
amendments, supplements, changes or modifications to the zoning ordinance but l
only after a public hearing;
C. To make such surveys, studies, maps, plans or plats of the whole or any portion of
the city and of any land outside thereof, which in the opinion of the zoning advisory
commission are consistent with the comprehensive plan and are necessary to carry
out the purposes of the commission; 1

D. To make recommendations to the city council upon plans, plats or replats of
subdivisions or resubdivisions within the city which show streets, alleys or other
portions of the same intended to be dedicated for public use;
E. To make recommendations to the long range planning advisory commission on the
preparation and maintenance of the comprehensive plan;
F. To fulfill those duties and responsibilities assigned to a city planning commission in
Iowa Code chapter 354, "plats"; and
G. To undertake from time to time other specific short range planning projects which
may be referred to it by the city council. (2007 Code § 36-13)
15-3-5: ORGANIZATION; MEETINGS:

A. Officers; Rules And Regulations: The zoning advisory commission shall choose
annually, at its first regular meeting of the fiscal year, one of its members to act as
chairperson, and another of its members to act as vice chairperson, to perform all of i
the duties of the chairperson during the chairperson's absence or disability. The
commission shall adopt such rules and regulations governing its operation and !'
procedure as may be deemed necessary.

B. Meetings: The zoning advisory commission shall hold a regular meeting at least
monthly.

C. Attendance: Attendance of all members shall be entered on the minutes. If any
member fails to attend at least two-thirds (2/3) of all regularly scheduled meetings
within any twelve (12) month period, such failure shall constitute grounds for the
commission to recommend to the city council that said member be replaced.
D. Minutes Filed With City Clerk: The zoning advisory commission shall file with the city r
clerk a copy of the minutes of each regular and special meeting of the commission

time as a member of the management team. In my job, I work with city officials, key leaders, charitable
organizations, community action, chambers of commerce and residents of the communities we serve. I
handle communications, community relations and in some communities, economic development. I have
served on the zoning advisory commission for several months to fill an unexpired term. I am actively j
involved in numerous Dubuque organizations and projects to support my community including Kiwanis
and the Operation New View Community Action board of directors. I recently attended one session of
the city's Intercultural Communications course and the IA State Extension training for zoning board
members.
What contributions can you make or state reason for applying?: I have served on the zoning advisory
commission for the past few months and have learned a lot. I hope to continue to serve. I have lived in
the city of Dubuque for my entire life, with the exception of a few years in Peosta. I am very proud of
my community and strongly believe in the need for citizens to be involved. I have extensive experience
in working with people of all walks of life and enjoy the opportunity to make a difference for others. I
would be pleased to have the opportunity to continue on the ZAC to help support the city's goals and
obj ectives.

69.16A Gender balance.
1. All appointive boards, commissions, committees, and councils of the state
established by the Code, if not otherwise provided by law, shall be gender balanced.
No person shall be appointed or reappointed to any board, commission, committee, or
council established by the Code if that appointment or reappointment would cause the
number of members of the board, commission, committee, or council of one gender to
be greater than one—half the membership of the board, commission, committee, or
council plus one if the board, commission, committee, or council is composed of an odd
number of members. If the board, commission, committee, or council is composed of
an even number of members, not more than one—half of the membership shall be of one
gender. If there are multiple appointing authorities for a board, commission, committee,
or council, they shall consult each other to avoid a violation of this section.
2. All appointive boards, commissions, committees, and councils of a political
subdivision of the state that are established by the Code, if not otherwise provided by
law, shall be gender balanced as provided by subsection 1 unless the political
subdivision has made a good faith effort to appoint a qualified person to fill a vacancy
on a board, commission, committee, or council in compliance with subsection 1 for a
period of three months but has been unable to make a compliant appointment. In
complying with the requirements of this subsection, political subdivisions shall utilize a
fair and unbiased method of selecting the best qualified applicants. This subsection
shall not prohibit an individual whose term expires prior to January 1, 2012, from being
reappointed even though the reappointment continues an inequity in gender balance.
