City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the 429 Rhomberg Building Stabilization Project, as completed by R&W Restoration,
in the final contract amount of $177,208.00, which is a 3.8% increase from the original
contract in the amount of $170,750.00. The cost increase is attributed to additional
work related to removal and replacement of fire damaged roof deck, additional brick
replacements above the estimated base contract quantity, and selective staining of
building fagade. The staining was requested by the City in order to maintain the
aesthetics of the historic building by blending the new brick with the original brick.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
429 Rhomberg Building Stabilization Project (Project).
BACKGROUND
In April of 2010 the City Council adopted Resolution 92-10 authorizing the City to enter
into a Programmatic Agreement (PA) among the U.S. Army Corp of Engineers
(USACE), the Iowa Department of Natural Resources (IDNR), the State Historic
Preservation Officer (SHPO), and the City of Dubuque regarding the construction of the
Bee Branch Creek Restoration Project. The PA outlines the manner in which the City
can proceed with the Bee Branch Creek Restoration Project in accordance with the
requirements set forth in 36 CFR Part 800, Section 106 (Section 106 Process) which
ensures that no unnecessary harm comes to historic properties. As outlined in the PA,
"the City shall ensure that all historic architectural properties . . . whose removal is not
necessary for the project will be protected from both direct and indirect adverse effects
produced by activities associated with (construction of the project)."
On November 18 of 2013 the City Council adopted Resolution 327-13 authorizing the
acquisition of 427-429 Rhomberg as necessary for the Bee Branch Creek Restoration
Project.
DISCUSSION
The acquisition of 429 Rhomberg was necessary to enable the City to stabilize and
protect the historic building to prevent and repair damage that might occur as a result of
the construction activity associated with the Upper Bee Branch Creek Restoration
Project. To that end, contract documents were prepared for the Project. The Project
involved the removal (deconstruction) of the steel sided building addition and to stabilize
or otherwise "mothball" the original 3-story masonry building to a weatherproof condition
that can be maintained until such time when it will be fully redeveloped following
construction of the Upper Bee Branch Creek Restoration Project. The stabilization was
done in conformance with the U. S. Department of the Interior's guidelines to ensure the
building retains its eligibility for historic rehabilitation tax credits.
The work included masonry repair (patching and/or limited replacement) and
tuckpointing, a new roof membrane and insulation system removal and replacement,
temporary infill of existing openings, and other selective building envelop repairs. The
work also included removal and salvage of the existing metal cornice at the top of the
parapet, and the steel fire escape for potential future restoration and reinstallation.
The 429 Rhomberg Demolition and Building Stabilization was completed by R&W
Restoration of East Dubuque, IL, in the final contract amount of $177,208.00, which is a
3.8% increase from the original contract in the amount of $170,750.00. The cost
increase can be attributed additional work related to removal and replacement of fire
damaged roof deck, additional brick replacements above the estimated base contract
quantity and selective staining of building facade. The staining was requested by the
City in order to maintain the aesthetics of the historic building by blending the new brick
with the original brick.
On June 18, 2015 Consulting Engineers IIW, P.C. recommended final payment to the
Contractor.
RECOMMENDATION
I recommend that the City Council accept the improvements and establish the final
contract amount at $177,208.00.

The City Council is requested to adopt the attached resolution to accept the

$177,208.00 to R&W Restoration for the 429 Rhomberg Demolition and Building
Stabilization.

ACCEPTING THE 429 RHOMBERG DEMOLITION AND BUILDING STABILIZATION
PROJECT AND AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the 429 Rhomberg Demolition and
Building Stabilization Project (the Project) has been completed has been completed by
the Contractor, R&W Restoration (Contractor), the City Engineer has examined the
work and recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $177,208.00; and
WHEREAS, the Contractor has previously been paid $168,34T60, leaving a balance
of $8,860.40; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $8,860.40 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
