Van Milligen, City Manager SUBJECT: Vacating Petition/Alley between Main Street and Salina Street (SELCO) DATE: June 29, 2015 A request has been received from CW Wolff LLC (SELCO) to vacate a 20 foot wide alley between Main Street and Salina Street which abuts the SELCO property at 15 S. Main Street. City Engineer Gus Psihoyos states that the City has no plans for the utilization of that portion of the alley and all local utility companies have been contracted and have no plans for the utilization of this alley area, therefore perpetual easement rights will not be reserved over the portion of vacated alley. The abutting properties on either side of the alley are both currently owned by SELCO and Crescent Electric. SELCO and Crescent Electric have come to an agreement on the method of vacating the adjacent alley. City Engineer Gus Psihoyos recommends approval of the request to vacate for a purchase price of $22,100, subject to the conditions of an Offer to Buy Real Estate and Acceptance between the City of Dubuque and CW Wolff LLC, plus $100 for platting, publication and filing fees. The Offer to Buy states: Buyer will secure a building permit and begin construction of an office/warehouse building and storage shed on the Real Estate within 24 months after the Closing. The storage shed must be fully enclosed on its west side. Buyer will pay Seller an additional $17,000.00 if a building permit has not been issued and construction commenced within 24 months after the Closing. I concur with the recommendation and respectfully request Mayor and City Council approval. Mic ael C. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Vacating Petition/Alley between Main St. and Salina St. (SELCO) DATE:June 18, 2015 INTRODUCTION This is in response to a request from CW Wolff LLC (SELCO)for the vacating of a 20 foot wide alley between Main St. and Salina St. in Block 13 of Dubuque Harbor Company's Addition which abuts the SELCO property at 15 S. Main Street. DISCUSSION The attached plat shows the alley area proposed to be vacated. The abutting properties on either side of the alley are both currently owned by either SELCO or Crescent Electric. SELCO and Crescent Electric have come to an agreement on the method for vacating the adjacent alley. The alley area to be vacated is described as Lot 7A of Block 13 in Dubuque Harbor Company's Addition, in the City of Dubuque, Iowa. Perpetual easement rights will not be reserved over the portion of vacated alley. SELCO plans to construct a new building and storage area on its existing site. The vacating of this alley will facilitate the development of this site. SELCO and the City of Dubuque plan to execute an Offer to Buy Real Estate and Acceptance agreement where the City sells the vacated alley at a reduced rate if SELCO constructs the new office building and storage garages within two years of the vacation of the alley. The City has no plans for the utilization of the alley to be vacated. All local utility companies have been contacted and have no plans for the utilization of this alley area. RECOMMENDATION I am recommending the vacating and disposal of Lot 7A of Block 13 in Dubuque Harbor Company's Addition, in the City of Dubuque, Iowa. ACTION TO BE TAKEN i The recommendation of the City Manager should be approved and that the vacating, and disposal of Lot 7A of Block 13 in Dubuque Harbor Company's Addition, in the City of Dubuque, Iowa be approved through adoption of the enclosed resolutions.
