A request has been received from Crescent Realty Corporation (Crescent Electric) to
vacate a 20 foot wide alley between Main Street and Salina Street which abuts the
Crescent Electric property at the intersection of S. Main Street and Charter Street. City
Engineer Gus Psihoyos states that the City has no plans for the utilization of that portion
of the alley and all local utility companies have been contracted and have no plans for
the utilization of this alley area, therefore perpetual easement rights will not be reserved
over the portion of vacated alley.
The abutting properties on either side of the alley are both currently owned by SELCO
and Crescent Electric. SELCO and Crescent Electric have come to an agreement on
the method of vacating the adjacent alley.
City Engineer Gus Psihoyos recommends approval of the request to vacate for a
purchase price of $5,200, plus $100 for platting, publication and filing fees.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This is in response to a request from Crescent Realty Corporation (Crescent Electric)
for the vacating of a 20 foot wide alley between Main St. and Salina St. in Block 13 of
Dubuque Harbor Company's Addition which abuts the Crescent Electric property at the
intersection of S. Main St. and Charter St.
DISCUSSION
The attached plat shows the alley areas proposed to be vacated. The abutting
properties on either side of the alley are both currently owned by either SELCO or
Crescent Electric. SELCO and Crescent Electric have come to an agreement on the
method for vacating the adjacent alley. The alley area to be vacated is described as Lot
6A of Block 13 in Dubuque Harbor Company's Addition, in the City of Dubuque, Iowa.
Perpetual easement rights will not be reserved over the portion of vacated alley.
Crescent Electric plans to expand its current storage area over the alley.
The City has no plans for the utilization of the alley to be vacated. All local utility
companies have been contacted and have no plans for the utilization of this alley area.
The City is selling the remaining alley property to SELCO for $2.60 per square foot with
certain conditions. Since Crescent Electric is purchasing only a small remnant parcel of
10 foot by 200 foot it seems appropriate that Crescent Electric should pay the same
price as SELCO, $2.60 per square foot. Therefore the purchase price will be
approximately $5,200.00 plus $100.00 to cover the cost of platting, publication and filing
fees.
RECOMMENDATION
I am recommending the vacating and disposal of Lot 6A of Block 13 in Dubuque Harbor
Company's Addition, in the City of Dubuque, Iowa.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and that the vacating,
and disposal of Lot 6A of Block 13 in Dubuque Harbor Company's Addition, in the City
of Dubuque, Iowa be approved through adoption of the enclosed resolutions.

Whereas, Crescent Realty Corporation has requested the vacating of a portion
of an alley between Main St. and Salina St. in Block 13 of Dubuque Harbor
Company's Addition in the City of Dubuque, Dubuque County, Iowa; and
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, a plat dated the June 5, 2015 prepared by WHKS & Co.,
describing the proposed vacated 20 foot wide alley between Main Street and
Salina Street in Block 13 of Dubuque Harbor Company's Addition, in the City of
Dubuque, Iowa; and
Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa on this 19th day of June, 2015, the City
Council of the City of Dubuque, Iowa met on the 6th day of July, 2015, at 6:30
p.m. in the Historic Federal Building Council Chambers (second floor), 350 West
6th Street, Dubuque, Dubuque County, Iowa to consider the request to vacate;
and
Whereas, the City Council of the City of Dubuque, Iowa overruled any'and all
objections, oral or written to the request to vacate; and
Whereas, the City Council of the City of Dubuque, Iowa, has determined that
the proposed vacated portion of the 20 foot wide alley between Main Street and
Salina Street in Block 13 of Dubuque Harbor Company's Addition to be known as
Lot 6A of Block 13 in Dubuque Harbor Company's Addition, in the City of
Dubuque, Iowa, should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the real estate described as Lot 6A of Block 13 in Dubuque
Harbor Company's Addition, in the City of Dubuque, Iowa, Dubuque County,
Iowa, be and the same is hereby vacated.
