BACKGROUND Attached is an extensive timeline of events summarizing on-street parking concerns near UD campus. The following details critical correspondents and decisions made regarding on-street parking near UD campus. In 1985, the City Council adopts an ordinance that establishes a process for residents to petition for and create Residential Parking Permit Districts (RPPD). On October 28, 1985, residents surrounding UD campus petition the City Council to establish the first RPPD on the following streets: Grace Street from Ida to McCormick, McCormick Street from Grace to Bennett, Bennett Street from McCormick to Algona, Algona from Bennett to Grace. This petition for the first RPPD was approved by City Council with effective times of 7:30 AM to 11 PM daily except Sundays and holidays and a designation of RPPD "A" was established. Including District A near the UD campus, there is a total of eight (8) RPPD's within the City of Dubuque. District B is located near St. Raphael Cathedral at 231 Bluff Street; District C and District E are located in the area of Clarke University and Senior High School; Districts D, F, and H are adjacent to Hempstead High School; and District G is located near Loras College. Each district has unique effective times and days in which a parking permit is required for vehicles that park curbside. During the year of 1999, UD voluntarily posts the first No Student Parking signs on public right-of-way along streets nearest to their campus. All enforcement costs are the responsibility of the University of Dubuque. No other school or college has followed their lead. On July 29, 2002 a letter sent from UD Vice President Alan Burr to City Engineer Michael Koch requesting a solution for vehicles parked on the streets within portions of the established RPPD "A." "The 'No Student Parking' areas we have posted and enforced over the last 3 years have worked well. Please help us resolve these remaining issues and make parking for our neighbors an easier task without the frustration of having to call the Police and wait for their response." The solution proposed by UD was to remove portions of RPPD "A" and post additional No Student Parking signs, which would be enforced by UD Security and citation to apparent UD vehicles would be a University parking ticket, rather than a City parking citation. The portions of streets requested to be removed from RPPD "A" are: Grace Street between McCormick and Algona, Bennett Street between McCormick and Algona, Algona Street in front of Peters Commons, and McCormick Street between Grace and Bennett. Police Chief Wadding finds the proposal from UD to be acceptable. On June 26, 2007 a letter sent from UD (David Olivares) to myself requesting an amendment to RPPD "A" by removing Bennett Street from Algona to McCormick, and McCormick Street from Bennett to Grace and allow UD to alter RPPD "A" signs to No Student Parking signs. Included with this letter was a petition signed by residents from UD which states: "If students (faculty or staff depending on the area) park in this area after the proposed changes, they would be issued a $40 UD parking citation, rather than a $15 city residential parking violation citation...The No University of Dubuque Parking or No Student Parking signs would be enforced by the University Security Department." This requested amendment to RPPD "A" was approved by City Council and UD installed No Student Parking signs. An anonymous letter from a resident on August 4, 2009 informed Engineering that UD was planning to require each UD employee to purchase a parking permit in order to park in UD parking lots. The permit amount mentioned in this letter was $125 per year. A meeting on March 27, 2014 between City staff and UD Vice President Jim Steiner occurred to discuss on-street parking around UD campus. The City and UD agree to modify all on-street No Student Parking signs to No UD Student or Employee Parking. This modification was completed by UD staff. On October 31 , 2014 City staff met to discuss a future directive for No UD Parking Zone requests from area residents. A directive that required all requests from residents be made in writing to City Engineering was agreed upon. After receiving such written request, City Engineering would then send a cover letter and a copy of the written request to the President of UD and request a written approval or denial. City Engineering would also send an RPPD informational packet to the requestor that would explain the purpose of a RPPD, how to petition for the establishment/amendment of a RPPD, and a blank petition to gather resident signatures. A letter was sent to UD President Dr. Jeffrey Bullock that explained this new procedure. A petition from Adam Schwendinger, 1845 Bennett Street, on December 8, 2014 requesting an expansion to the No UD Parking Zone on the north side of Bennett Street from Griggs Place to N. Grandview was received by City Engineering. This requested expansion was sent to UD President Dr. Jeffrey Bullock for UD's approval or denial. On June 17, 2015 an email from UD Vice President Jim Steiner stating denial of the No UD Parking Zone district on the north side of Bennett Street from Griggs Place to N. Grandview. The next day, a follow-up phone call to Adam Schwendinger from 2 Engineering Technician Troy Kress that further explained this process and notified Mr. Schwendinger of UD's denial to expand the No UD Parking Zone. Troy had informed Mr. Schwendinger of the City's RPPD policy and asked if he would like to initiate the petitioning process involved in the establishment/amendment of a RPPD. Mr. Schwendinger expressed no interest in pursuing the designation of a RPPD. On July 17, 2015 a phone conversation between Carol Ruden (1808 Grace Street) and Troy Kress occurred. This conversation was regarding similar concerns of UD students and employees parking on Grace Street, east of Ida, which makes her 4-unit rental property difficult to market and maintain dependable tenants. Troy explained the process that requires Ms. Ruden to submit in writing a request to expand the No UD Parking Zone, and a RPPD informational packet will be sent to her. DISCUSSION Reluctance from Mr. Schwendinger to pursue the designation of a City RPPD based on a statement he made, "The residents of Bennett Street do not want to pay for residential city parking permits," has proven difficult to resolve this situation. UD has denied the request to expand their No UD Parking Zone on the north side of Bennett Street from Griggs Place to N. Grandview. UD is responsible for installing, maintaining, and enforcing their No UD Parking Zones and they have control when to expand or reduce these parking districts. With Bennett Street being posted No Parking Anytime (City enforced) on the south side, from Algona to N. Grandview, vehicle clearance and safety is not impacted greatly enough to expand the City enforced No Parking Anytime zone. CONCLUSION The City of Dubuque and University of Dubuque have worked together in reducing the number of concerns from area residents. The willingness of UD Security to install, maintain, and enforce a No UD Parking Zone district has lowered the amount of time spent by the Dubuque Police Department and Parking Division in dealing with on-street parking issues around UD campus. This time gain has enabled Police and Parking to focus their efforts toward other issues. UD has the ability to approve or deny requests to expand their No UD Parking Zone district. Approvals or denials are based on the capabilities of UD Security enforcing an increased No UD Parking Zone district, while providing safety and security to students, faculty, and staff on UD campus grounds. We look forward to our continued partnership with the University of Dubuque to maintain a safe and effective parking enforcement district. REQUESTED ACTION There is no requested action. July 29, 2002: Letter from UD Vice President of Finance and Auxiliary Services Alan Burr to Michael Koch (City Engineer) requesting the following solution for vehicles parked on Grace Street between McCormick and Algona, Bennett Street between McCormick and Algona,Algona Street in front of Peters Commons,and McCormick Street between Grace and Bennett: Allow UD Security staff to ticket student vehicles parked in these areas issuing a University parking ticket to any vehicles that appear to be UD students. September 6, 2002: Email from Bill Schlickman (City Traffic Engineering Assistant) to Mike Koch: UD proposes the option of UD Security issuing City parking citations. December 12, 2002: Email between Paula Gieseman (City Police Department) and Bill Schlickman: Bill Blum and Chief Kim Wadding(City Police Chief) have given their blessings for UD to issue City citations. Bill contact UD, David Olivares, and advised all unauthorized signs be removed. Signs were removed by 7 AM August 19, 2009. April 20, 2010: Letter from Gus to UD Cheryl Moonen: UD Moonen requests traffic signal installation on University at Algona. 4-hour, 8-hour, pedestrian volume,and crash history do not support the installation of a traffic signal on University at Algona. City denies this request. December 9, 2010: Letter from UD Vice President of Finance and Auxiliary Services Jim Steiner to MVM: request to improve the intersection of McCormick and Bennett Street. UD willing to donate ROW to make such improvements. Improvements not made. August 18, 2011: Email to UD Security Supervisors Jane Herbst and Laura Schauer from MVM regarding No Parking signs on Bennett Street from Algona to McCormick,and McCormick Street from Bennett to McCormick Stoltz driveway, and on Grace Street from McCormick to Helen Hoppman's house. This would only affect UD faculty and staff that parked here. August 23, 2011: Memo to MVM from Gus requesting City No Parking signs be installed on Bennett Street, north side,from McCormick to a point 215 feet west of Algona, McCormick Street,east side, from Bennett to Grace, and Grace Street, south side, from McCormick to a point 340 feet west of Algona. October 21, 2011: Memo to MVM from Gus requesting approval to change a parking designation on McCormick Street per the request of two residents and UD. Re-establish parking on the east side of McCormick Street near 883 and 893 McCormick Street as "No UD Parking". August, 2013: UD installs No Student Parking signs on the east side of West Street from Gilliam to Finley. October 10, 2013: Information packet regarding RPPD "A" sent to Luis Del Toro, 901 Gilliam Street. November 2, 2011: Memo from MVM to Mayor and City Council: set public hearing to grant an easement across Bennett Street to accommodate private utility geo-thermal for Performing Arts Center. (Approved) March 27, 2014: Meeting with City Staff and UD Vice President Jim Steiner to discuss on-street parking congestion and resident concerns. City and UD agreed that UD modify all on-street UD parking signs to state "No UD Student or Employee Parking." August 5, 2014: Letter from Gus to UD President Dr.Jeffrey Bullock requesting and expansion of the UD enforced parking district to include both sides of Mineral Street from Gilliam to Devon, based on citizen complaint,and traffic volumes. August 11, 2014: Email from President Dr.Jeffrey Bullock to Engineering; raises question to effectiveness of August 5, 2014 request and a cause that may just push the problem further down the street. UD's concern with enforcing the growing No UD parking areas around their campus. September 8, 2014: Letter to UD President Dr. Jeffrey Bullock from Gus: second request to extend the No UD parking zone on both sides of Mineral Street from Gilliam to Devon based on citizen request and traffic volume. City responds to August 11, 2014 UD concern of pushing the problem onto nearby streets. City feels there is a line as to where it becomes too far for people to park on the street and walk,and will then begin to park in UD parking lots. (UD approved) October 6, 2014: Anonymous resident requests the extension of No UD Parking district on Algona from Hale to Lombard. Her phone number is 542-7578. October 15, 2014: Phone Call from Paul Andreson to MVM: expresses gratitude for No UD Parking signs that were added on Mineral Street from Gilliam to Devon. October 31, 2014: City Staff meeting to discuss future of No UD Parking zone requests from residents. Decided by MVM that residents must submit such request in writing to City Engineering. Engineering would then send a RPPD information packet to requestor. Engineering would also send letter to UD that would contain the request from the resident and request a written approval/denial from UD back to City Engineering. UD is to approve/deny any No UD Parking zone changes. December 8, 2014: Petition from Adam Schwendinger of1845 Bennett Street to City: requesting No UD Parking district be expanded from Griggs Place to N Grandview Ave. February 3, 2015: Letter to UD President Dr.Jeffrey Bullock from Gus: updating the future process on how all No UD Parking zone requests will be handled by describing the process as decided at the City Staff meeting. The council has approved for the University of Dubuque to erect a new building for their physician assistant program, which is occurring during this time. This was approved in December of 2014. At that time, the Bennett Street neighborhood came to council expressing our concerns regarding problems with parking on Bennett Street and the escalation of this problem, due to a parking lot being removed in the area. Since that time, the engineering department of Dubuque has requested "No UD parking" signs to be placed on Bennett Street. The University of Dubuque has followed up just last month. An e-mail was sent to the engineering department of Dubuque via Mr. Steiner saying that they will not be expanding signs on Bennett Street. We are still seeking a resolution for our stressful situation. Some things you should know/reasons why we request signs: -Bennett Street is one-sided parking -There are residents without a driveway, and need to park on the street -Residents have had to put four way flashers on and park in the street, just to bring their groceries in the house or elderly family members in their homes, etc. -On December 8, 2014...25 residents signed a petition for "NO University of Dubuque" parking signs for students and staff. 20 households signed out of 27 houses surveyed...the 6 that did not sign, were not home at the time, and 1 was vacant. That's about 80 percent of our neighborhood, excluding the vacant home. -The address that I live at on Bennett is 5-600 feet from the nearest UD property. The furthest sign from the UD being nearly 1,000 feet from their property, if not more, located on Finley and University streets. -There are "NO UD staff or student parking" on the following residential streets: West 3"d, Grace, Ida, Auburn, Algona, Pearl, Finley, West, McCormick, Mineral Street, Gilliam, O'Hagen, and North Algona (the street map that the city provided us indicates these streets that have UD signs, but does not encompass all of them) -We are centrally located within all of these streets and have requested signs, but were denied by the University of Dubuque. -Finley construction workers park on the East portion of Bennett Street all the way down to the 1800 block of Bennett. UD students also park up and down Bennett Street, resulting in no parking for residents. -This past year, students have had street storage on Bennett Street, in which numerous times the police had to be called. For several weeks, numerous vehicles have remained parked on our street, sometimes in a way where others could not park around them. -We have been told by students and staff that the reason why students and staff park here is because they do not want to pay the high price charge for a parking permit and Bennett Street is more convenient for them to get to their classes and work, than the parking that is provided. -The residents of Bennett Street do not want to pay for residential city parking permits. -*On Grace Street, there are residential parking permit signs from the city that were installed approximately 20 years ago, which to this day are still a challenge to enforce. Students are still parking there, even though there is a parking lot nearby. Even neighbors on Grace Street are frustrated. -Back lot of Westminister is available but students do not want to park there; security guard Judy has told one of neighbors this. Our Concern and Questions Our concern is for a solution to come about before the upcoming school year. Our neighborhood inquires why our street's request for signs was rejected, since we are in the middle of all of the no parking signs put up around us. What more can the neighbors do on their part to resolve this situation? We have made numerous attempts to contact the Ub and having no one return calls or willing to meet with us, we would like to know if the city has a mediator available to work with the neighborhood in resolving this issue? Mr. Oliverius, who had worked at the Ub, told a neighbor it was the city's responsibility to take care of this. Is this true? This is where I've lived my entire life and where I've grown up. I've seen a lot of changes over the years, and it seems as though whenever there are concerns regarding the Ub's future plans of expansion and parking, the solution always seems to be more parking lots, but that doesn't solve the problems. The parking lots are located on the wrong side of campus, and many students really don't like taking a shuttle service. I remember a quote that said, "If you are not a part of the solution, you are a part of the problem." The UD claims to work with the neighbors, but we see no evidence of this. We wish for a more concrete resolution, and to be more unified as a community. As members of our city government, is there any guidance you can give us to resolve this problem? We respect the University of Dubuque's expansions, but we expect the same respect back as neighbors. Do you have any questions for us? Thank you! I, Enclosed you will find a written request to extend UD's parking district. Residents of Bennett Street have submitted a written request for no student/staff parking on Bennett Street between Griggs Street, which is located 530 feet east of Algona Street, to South Grandview Avenue on the north side. The south side of Bennett Street is already posted by the City with No Parking anytime signs, Please review the enclosed documents and send the City your written approval or denial of the parking request.
