Issue: Repairs,Sealcoat&Restripe Parking Lot for Mystique Casino
As required in the Amended and Restated Lease Agreement between the City of Dubuque and
the Dubuque Racing Ltd., I am formally requesting City approval to sealcoat, crack fill,repair
potholes, level sinking areas and restripe the East Parking Lot of Mystique Casino. My
recommendation for this expenditure is $38,650.00. Two bids were obtained to sealcoat, crack
fill, repair potholes, level sinking areas and restripe the East Parking Lot. The bid would be
awarded to Kluesner Construction of Farley for$38,650.00,
The source of funding for the project is the Depreciation and Improvement Fund (D&I Fund),
which has a balance of $655.910.00 and an available amount of $405,910.00 the required
minimum balance for the D&I Fund is$250,000 per the City/DRA Lease Agreement.

1. FAHRNER Asphalt Sealers,L.L.C.(CONTRACTOR)and PURCHASER agree that,CONTRACTOR shall furnish
the labor and materials to complete certain construction in accordance with the following specifications:
Repair asphalt areas using Infrared Seamless Patching System,
Approx 56 heats @ $85.00 per.
Spray heats with Reolamite to create a better bond with the existing asphalt.
Blow out and clean cracks with compressed air and heat lance.
Seal cracks with Fed Spec ASTM D 6690 hot rubber asphalt sealant and over-band using
squeegee.
Crackfilling does not include alligatored areas.
Sweep asphalt clean with vacuum sweeper and/or air blowers.
Apply 2 coats of emulsion sealcoat. Sealer will be blended with fractured sand and
rubber modifier to provide superior mix design.
Re-stripe asphalt as is with white traffic paint.
**This includes Infrared patching & repair at all storm drains and low spots in
pavement.
This proposal maybe withdrawn it not accepted and received by CONTRACTOR within 30 days of the dale above and/
or at any time before performance of the work hereunder upon CONTRACTOR's determination that the PURCHASER Is not creditworthy.
2. If proposal is accepted please sign,retain one copy and forward a copy to our office.
3. The undersigned("PURCHASER")agrees to pay CONTRACTOR the total price of $39,632.55 and/or the unit prices
specified above for the labor and materials specified above which payment shall be due upon completion of each stage of work.

Dubuque Racing Association President and CEO, Jesus M. Aviles, is requesting City of
Dubuque approval to do two projects at the Mystique Casino:
Project #1 — Repairs, Sealcoat & Restripe East Parking Lot to be awarded to the low
bidder, Fahrner Asphalt Sealers, in the amount of $39,632.55; and
Project #2 — Repairs to Sidewalks and Entrances, to be awarded to D & D (Superior)
Concrete (the only vendor in this area that does this specialized concrete work) in the
amount of $11,706.50.
The funding source for these projects would be the Mystique Casino Depreciation and
Improvement Fund, which has a balance of $655,911.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Regarding: Use of Depreciation and hnprovement Funds
As required in the Amended and Restated Lease Agreement between the City of Dubuque and the
Dubuque Racing Ltd., I am formally requesting City approval of the following two projects:
Project#1: Repairs, Sealcoat& Restripe East Parking Lot
Preventative maintenance is needed on the east parking lot of the Mystique Casino to avoid long term
damage to the lot. Two bids were obtained for crack sealing, seal coating and restriping the east
parking lot and I recommend awarding the project to the lowest bid submitted by Fahrner Asphalt
Sealers of Dubuque for$39,632.55.
Project#2: Repairs to Sidewalks and Entrances
During 2014, D & D (Superior) Concrete started a project that was approved to remove, replace,
reseal and paint the decorative concrete entering both the north and south entrances to the covered
walkways and repair uneven seams on different locations of the sidewalks around the building. When
Mystique proceeded with the project it was brought to our attention that the sidewalk was extremely
undermined and had to be removed, pinned and replaced. Due to these unexpected issues, we were
unable to complete the resealing and painting of decorative concrete at that time. As such, we are
requesting that D & D (Superior) Concrete be allowed to complete the specialized resealing and
painting of the decorative concrete near the entrances at an additional cost of$11,706.50. D & D is
the only vendor in this area that does the specialized concrete work.
The requested source of funding for these projects is the Depreciation and Improvement Fund (D&I
Fund), which has a balance of$655,911 as of May 31, 2015 and an available amount of$405,911 as
the required minimum balance for the D&I Fund is $250,000 per the City/DRA Lease Agreement.
