1. Approve Minutes of October 11, 2007
Gieseman moved to approve the minutes of October 11, 2007 as submitted.
Seconded by Duehr. Motion carried 2-0.
2. Communication from Attorney Danita L. Grant Regarding Terry Dolan
3. Communication from Assistant City Attorney Crenna Bramwell
Attorney Danita Grant, representing Terry Dolan, alleged that the City did not
follow Civil Service procedure by conducting an entrance examination for the
Water Pollution Control Plant Operator position. She reviewed the history of Mr.
Dolan's employment with the City and stated that his name was on the certified
list for the position, that he had interviewed for the position and had been told by
Water Pollution Control Plant Manager Jonathon Brown that he was being
recommending for the position. Mr. Dolan was not allowed to start the position
and subsequently, an entrance examination was held for the position. She
stated that Mr. Dolan was qualified, had followed the proper procedures and
should be given the job.
Chairperson Duehr quoted the City Attorney's opinion that the Commission's
authority was limited to conducting examinations and certifying the lists and their
responsibility ended there. He commented that a determination as to whether
the test should have been promotional versus entrance would have to be
decided by the District Court.
Ms. Grant stated that the Civil Service test for the position of Water Pollution
Control Plant Operator should have been a promotional examination open to
current City employees only as there were positsonc ::~;th lower grades in the City

Personnel Manager Randy Peck responded that this was the only position in this
classification and therefore was correctly identified as an entrance examination.
He stated that since Mr. Dolan had previously held the position of Water
Pollution Control Plant Operator, even though he had never tested, his name
was on the certified list for consideration.
Gieseman moved to receive and file the communications from Attorney Danita L.
Grant and Assistant City Attorney Crenna Brumwell. Seconded by Duehr.
Motion carried 2-0.
Commissioner Gieseman questioned Personnel Manager Randy Peck about the
Cashier position in Utility Billing which was recently vacated by the retirement of Pat
Ostrander and whether there was a current certified list. Peck stated. the current list
expires in May of 2008; however, the City did not plan to fill the position until after the
list had expired as there is a part-time Cashier in the department who did not take the
previous examination and the City would like to give the employee the opportunity to
test and be placed on the list. Gieseman commented that people took the Cashier's
test in good faith and that the position should be filled from the current list unless it was
determined there were no qualified candidates on it. uuehi cui ~curi vu a~ ~~ ~-ated the
